Comey Memo FOIA Update: CNN Files Motion Demanding Immediate Production – DOJ Says 60 Days…

Just a quick update in the ongoing court battle for the Comey Memos and Archey Declarations.  [Background Here]  CNN has filed a motion for immediate production (full pdf below)

Two days ago Judge James Boasberg ruled the DOJ and FBI must turn over the mostly unredacted Comey Memos and fully unredacted Archey Declarations to CNN and the media groups represented within the FOIA lawsuit.

However, in a response to CNN dated yesterday, August 13th, the DOJ stated they intend to utilize the full 60-day appellate window before producing the memos and declarations:

It looks to me like the DOJ/FBI is implying they will produce the material in 60 days, and not sooner.  In response to that email today CNN has filed a motion requesting intervention by Judge Boasberg, and demanding immediate production:


There is a possibility the DOJ is delaying production because they want to wait until after the Inspector General report is made public.  Strategically, that might make sense.

[Backstory for those unfamilar] In the background of what was The Mueller Investigation, there was a FOIA case where the FBI was fighting to stop the release of the Comey memos.  Within that courtroom fight Mueller’s lead FBI agent David Archey wrote a series of declarations to the court describing the content of the memos and arguing why they should be kept classified.

The FOIA fight shifted; and the plaintiff, CNN, argued for public release of the content of the FBI agent’s descriptions, now known as the “Archey Declarations”.

After a lengthy back-and-forth legal contest, on June 7th Judge James E Boasberg agreed to allow the FBI to keep the Comey memo content hidden, but instructed the DOJ/FBI to release the content of the Archey Declarations.  On August 2nd the DOJ/FBI changed their position and claimed national security, “sources and methods” would be compromised by the release of the Archey Declarations.

On August 12th Judge Boasberg completely rejected the DOJ and FBI argument.

The issue at hand is tangentially related to the current Inspector General carve-out report, through the aspect of the Comey Memos.  We are currently anticipating a report from the OIG related to former FBI Director James Comey, his writing of the memos, and the leaking of some of those memos to the media via his friend Daniel Richman.  {LINK}

No-one knows the number of memos that James Comey has written.  [We may get that answer in the IG report.]  There are nine memos written by James Comey surrounding contact and conversations with President-elect and then President Trump (2016/2017).

However, based on the court declarations by Mueller’s former lead FBI investigator David Archey, it sounds like there are many more memos than anyone currently understands; including memos about the investigation of candidate Trump, that were written during the “Crossfire Hurricane” investigation 2016 and 2017, that describe investigative details, sources, operations and code-names of intelligence assets used in the investigation.

The Comey memos are not just about his contact with Donald Trump as a candidate, president-elect or president.   The media keeps downplaying the memos as a few notes taken by the former FBI director, but all of the background information suggest the assembled writing is something more akin to a personal diary.

My strongly researched suspicion is that James Comey kept detailed private notes of what was happening during the operation(s) against Donald Trump and his campaign team, both during the campaign and after the election when President Trump took office.  Just take a look at how David Archey described the content and you can see those notes, now called memos, were in addition to FD 302 reports being filed by FBI officials.

Why James Comey would keep detailed notes beyond what was being officially recorded in the FBI 302 reports is likely a question to be answered within the pending inspector general report.   There’s a lot of sketchy non-transparent stuff going on amid all of this….

    Comey’s memos might also be total fiction and may actually hurt Trump. Maybe this is why the DOJ is fighting their release. I wouldn’t put it past Comey to lie through his teeth.

      It’s a diary. Whether it’s content is helpful to POTUS..or is a DIARY! It has, at best, as much validity as what my sister wrote as a schoolgirl (probably less) We must get past this “sources say” nonsense…on both sides of the aisle.

        Mr Comey is a top level executive at a vast Federal Govt Department. They are not anything but a professional journal of his personal thoughts on, “How to workout the, “Problem of carrying forward the so called insurance policy?”

        That is at least my view of the nature of his personal journal.

        I could be wrong, but if I am wrong about them,.

        To ascribe to the view point, “Its a silly little diary, it might as well say this is how, “He spent his time, writing about playing offshore poker winnings and loses, and commenting on the Kardashians.”

            When was that announced? Which court found Comey guilty of perjury?

            When did the DOJ prosecute Comey for telling lies?

            Can you direct me to that case because I must have missed it.

      Well, that’s certainly CNN’s belief, or they would ignore these memo’s like the plague.

      Given who the players are, it wouldn’t surprise me one bit if CNN already knew what was in his memos.

    I am all for the release of the memos and declarations.
    However if the declarations paint a one sided background into all things related to 2016. It would be strategic to have them follow the OIG reports.

    We have had waited, now cnn can wait.

    Otherwise to have, “The msm spin the declarations to the point the OIG report(s) have to fight an up hill battle against an ingrained spin to reconcile the OIG reports vs the declarations at best.”; And at the worst, “Having the declarations out there for how ever long before the OIG report(s) come out only provides time for the swamp to provide media analytic feedback on what sticks and have the OIG report(s) tailored and tweaked to line up with this media analysis.”

    Well cnn can go pound salt.

    That second statement sounds skeptical of the DOJ, does it not?

    First post here…
    My speculation is that the plaintiffs in the suit are worried that Comey has somehow implicated THEM in the soft coup attempt against our beloved VSGPOTUS.
    Hence, THEIR urgency to get ahead of the story. The fact that THEY ‘asked’ the Court for their own ‘dirt’ only serves to shift the narrative away from the notion that THEY are guilty of whatever Comey memorialized in these memos…

    So far Charles Payne has been the only one who has held the line, among the pundits. Is the absolute best among all reporters and that can be attributed to his actually been there, got the T-Shirts and Hats as a failure and success, with respect to Wall Street.

    I am very disappointed in Varney as he has been (still is) a stalwart Trump supporter from the start, even drawing nice thank-you notes from the President at times. Guess he just cannot see the difference between Walls Street and President’s refusal to see his job as guarantying Wall Street’s success as his 5 predecessors did. Let that last sentence sink in for a moment, nearly 40 years of US Government (Democrat and Republican) effort, treaties and polices to ensure the success of Wall Street, no matter the impact on Main Street Voters/Citizens.

      Remember how they and Gruber tried to blame Obamacare on the stupidity of the voters? The votes were already cast. It was the Politicians and the media that failed to examine or question the policy, and squelched any opposing viewpoint

    I AM NOT PROPOSING THAT ANYONE SHOULD DO THIS! I am just pointing out the evil of the enemy that we are battling.

    I would not be a bit surprised if CNN does not have a copy of the memos already. It is possible that Comey or one of his henchmen gave them a.which is why they are pushing so hard to make them public.

      Agree totally. They have known about these since Comey was fired. They cannot release them publicly without having legal backlash from Conservative legal entities as to why CNN would have court sealed documents.
      Their headlines and story boards are all written (IMO).

        I don’t know about that. Comey is a private citizen now, is there any reason why he couldn’t talk about something so long as classified persons and methods aren’t described? God knows other people have no problem talking about Trump or his Administration.

    If CNN already has this document it would have published. CNN wants the release ahead of the IG report, because it maintains the pretence that Comey is credible. The DOJ wants the release to occur after the IG report. The IG report is expected to finally and completely discredit Comey.

If Comey/Archey can, through CNN, force Comey’s version to be released to the General Public, then CNN will immediately see to it that the world immediately hears everything – presented of course as unvarnished truth. (Of course including “proof” that Donald Trump really did “obstruct justice.” Yawn.)

    But, very soon, Comey can now proclaim that he cannot be prosecuted, because an unbiased Grand Jury and/or Jury could not be found that would presume him to be innocent. Anyone else he “conveniently named” could do the same.

    That’s how many a Chicago crime boss escaped the courts: by publishing stories in advance of trial in the Tribune. This is Comey & Company’s inner ring of legal defense, prepared just in case things went south as they recently have.

    After three years of watching the FBI and DOJ slow roll every FOIA request filed by JW, I have come to the conclusion that this is SOP and probably has little to do with timing the release to a particular event. If I understand the details correctly Comey kept notes on his investigative actions against DJT, they will likely include his suspicions and reasoning for the same. These are what CNN wants to use as fodder for their next round of Orangeman bad stories. I can see the headlines now “Comey suspected Trump of being a SPY!”. It won’t matter if the “evidence” was eventually proven false, it’s the allegations and innuendo that will drive the narrative for hundreds of click bait articles that are sure to follow.
    On the other hand JW and the Daily Caller will be looking at the substance of the declarations and how they tie into the false narrative. They may help clarify the timeline of certain events, give us some insight into what Comey did or didn’t know leading up to the FISA applications and who was involved. For guys like Sundance they may indeed be a treasure trove of information “IF” you can read between the lines and parse out those little nuggets of truth buried within.
    It might be well worthwhile to re-read Vol. 2 of the Mueller report alongside the declarations now that it’s been disclosed that Comey was used as a fact witness by the Special Counsel in the obstruction case. Here again you’ll have to don your Deerstalker to sleuth out fact from fiction and make those seemingly impossible connections that the majority of us would miss.

    This whole fighting over the release of the memos between the FBI and CNN makes me wonder what kind of push/pull is going on among our intelligence agencies.

    If it was Fox or Judicial Watch. it would be usual swamp fighting FOIA. But who is behind CNN wanting these Comey memos and what would CNN already know about them because of their standing with intelligence? Brennan? And as a whole, CNN isn’t usually for truth and justice either.

    Barr is delaying release of the archey declarations until after he releases the comey memos.

    The archey declarations are just swamprat spin on the Comey memos anyway.

    CNN and the swamprats want to get their spin out ahead of time in a vain effort to blunt the effects, because they know the truth will be shocking and highly destructive to their narrative.

    When Barr releases the Comey memos, the archey declarations become moot.

    What’s depressing is watching all of these ‘Conservative’ writers doing stories and writing books about what Sundance has been revealing for almost two years now. Despicable. All of a sudden this sedition a story even a Washington pundit can write about. Geesh! Pulitzer for Sundance!!!
