Mueller Grand Jury Term Extended Another Six Months…

In December we began to construct the anticipated timeline, and structure, for the weaponization of House committees toward the larger resistance objective to remove their political opposition, namely President Donald Trump.

In the past week some of the Democrat resistance timeline has gained clarity from: (1) within Speaker Pelosi’s rules, structure and committee deadlines; and (2) today the extension of team Rosenstein/Mueller’s ‘small group’ grand jury endeavors:

Washington DC – A federal grand jury being used by the team of Special Counsel Robert Mueller has been extended, Fox News has learned. The original term of 18 months for the Washington, D.C.-based jury expired on Friday.

Sources close to Chief Judge of U.S. District Court in Washington, Beryl Howell, tell Fox News she has extended the grand jury term.

It wasn’t immediately clear if the extension is for another six months.

A grand jury may serve more than 18 months only if the court, having determined that an extension is in the public interest, extends the grand jury’s service. An extension may be granted for no more than 6 months, except as otherwise provided by statute.

Mueller, 74, took over the federal government’s probe into alleged collusion between President Trump’s campaign and Russian officials in May 2017. Already, his investigation has led to charges for multiple Trump campaign associates, though none of the charges are directly related to any misconduct by the president’s campaign.  (read more)

Additionally, following discovery of Pelosi’s committee modifications there has been some chatter amid the Lawfare group about the possibility of an interim Mueller report to be used as the backdrop for Ejijah Cummings (Oversight of White House), Adam Schiff (HPSCI); and Jerry Nadler (House Judiciary).

It’s important to note when we use the term “Mueller” in these contexts, CTH is discussing the special counsel team and not the individual.   Also when we approach the term “impeachment” we are not discussing it as the technical and legal approach for removal of a President; but rather the political use of the process to damage President Donald Trump.

Professional political Democrats would not be using “impeachment” in the constitutional sense of the process; but rather weaponizing the process -as a tool itself- to target the executive office.

Speaker Nancy Pelosi giving a new, much more narrow, mandate to Oversight Committee Chairman Elijah Cummings, to target the White House exclusively, is evidence of that political fine-tuning and House intent.

As we can see from Pelosi’s outlined rules above, she is giving Cummings until April 15th, under his narrow focus, to deliver a schedule for congressional hearings.  We can infer from that schedule the background material for Cummings will be gathered prior to his setting out the calendar dates for the narrowly tailored Oversight hearings.

Following that path, and anticipating three key backdrop events [¹Cohen appearance, ²Mueller Report (interim?) and ³Horowitz report], we should slightly modify the previous expectation; while keeping in mind that Pelosi also changed the rules for subpoenas and depositions – Cummings, Nadler and Schiff no longer need to coordinate with their minority (Republican) committee counterparts.

The Democrat committee chairs, and investigative staff, can now conduct background investigations (depositions etc.) without notification and/or participation of the minority membership.  In essence they have a lot more room for rapid action against any arbitrary target.

As a result, Chairman Cummings (w/ Nadler and Schiff consult) will likely take a deposition from Michael Cohen prior to Cohen reporting to federal prison on March 6th.  This will help Cummings frame and schedule the substance of the hearings prior to his deadline on April 15th, 2019.   That part of the original outlook remains unchanged.

However, if the Lawfare chatter is correct; and it makes sense that it would be; there is now a greater likelihood that Mueller’s team will present an interim report, also prior to April 15th, in order to accommodate Cummings need to plan out the hearings.

It would make sense, under the faux-auspices of explaining why they are expending so much time, taxpayer money and effort, for team Mueller to present an interim report on ‘muh Russia‘, while continuing down the expanded investigative path authorized by Rosenstein:  ie. “any matters that may arise as a result of the investigation”.

If the Lawfare chatter is accurate, CTH would predict the narrative around an interim report would be the honorable team of Robert Mueller: (1) justifying their magnanimous investigative work; (2) a responsibility to share their current status/findings with a new congress (considering leadership changes); and (3) because they are such honorable stewards of taxpayer funds they owe it to the American public to give a status report.   Blah, blah, blah… well, you get the picture.

This approach by Rosenstein/Mueller would give Democrats the best of both worlds.  A report they can use to begin oversight hearings; and yet the Mueller investigation continues without any end in sight.  So long as any special counsel investigation is ongoing, Mueller’s primary objective is retained:

♦(1) Create an investigation – Just by creating the investigation it is then used as a shield by any corrupt FBI/DOJ official who would find himself/herself under downstream congressional investigation.  Former officials being deposed/questioned by IG Horowitz or Congress could then say they are unable to answer those questions due to the ongoing special counsel investigation.  In this way Mueller provides cover for ideologically aligned deep state officials.

♦(2)  Use the investigation to keep any and all inquiry focused away from the corrupt DOJ and FBI activity that took place in 2015, 2016, 2017.  Keep the media narrative looking somewhere, anywhere, other than directly at the epicenter of the issues. In this way, Mueller provides distraction and talking points against the Trump administration.

♦(3) Use the investigation to suck-up, absorb, any damaging investigative material that might surface as a result of tangentially related inquiry.  Example: control the exposure of evidence against classified leak participants like SSCI Director of Security, James Wolfe; and/or block IG Horowitz from seeing material related to the FISA abuse scandal and “spygate”.  In this way Mueller provides cover for the institutions and the administrative state.

In all of these objectives the Mueller special counsel has been stunningly effective.

If Mueller, the team not the person, can continue their investigation AND congress can simultaneously begin using Mueller’s material to start publicly broadcasting congressional hearings, well, the aggregate resistance effort is amplified.

This approach means the Democrats can continue the ruse/narrative about why they lost the 2016 election.  This approach feeds their base unlimited narrative fuel.

Again, there is very little doubt the approach has already been mapped out in post-election meetings between: Nancy Pelosi, Chuck Schumer, the Democrat committee heads, allies in the lawfare community, political allies inside the executive branch (IC, DOJ, FBI etc.), along with feedback from political networks, DNC (Perez) and major resistance donors.

Key Committee Structure – The House Permanent Select Committee on Intelligence (HPSCI) will be Chairman Adam Schiff and ranking member Devin Nunes.  The House Judiciary Committee will be Chaired by Jerry Nadler and ranking member Doug Collins.  The House Oversight and Reform Committee will be Chairman Elijah Cummings and ranking member Jim Jordan.

Gang of Eight (IC Oversight) – The Go8 line-up will be radically different in 2019 and far more adversarial to the executive branch.  Ranked by influence over IC:

  1. Nancy Pelosi (D) – Speaker of House.
  2. Adam Schiff (D) – Chair, HPSCI
  3. Senator Mitch McConnell (R) – Senate Majority Leader
  4. Senator Richard Burr  (R) –  Chair, SSCI
  5. Kevin McCarthy (R) – Minority Leader House.
  6. Senator Chuck Schumer (D) – Senate Minority Leader
  7. Devin Nunes (R) – Ranking Member HPSCI
  8. Senator Mark Warner (D) – Vice Chair, SSCI

The Broad Political Alliances – Overlaying the DC political alliances within the intelligence community Gang of Eight you see a resistance ratio of 7:1 against the executive branch.

Pelosi, Schiff, McConnell, Burr, McCarthy, Schumer and Warner all allied with the overall UniParty resistance objective; and only Devin Nunes as an ally to the White House.  That’s a ration of 7:1 in favor of “The DC Resistance” against the Executive Branch.

That’s the landscape.

Additionally, Nancy Pelosi has the new House Counsel, Douglas Letter, set up to massively expand as a mini-doj,… and by using the pretense of defending Obamacare, the new unaccountable legal unit [likely allied interests from Lawfare] can receive unlimited taxpayer funding.

A smart, albeit Machievellian construct.

    Underestimating these democrats was a big mistake. They and their media never have really cared if he’s impeached. What they do best is smear and usually imprison a few around the target.

    Allowing Sessions and Rosenstein to fester for so long was an entire other story.

    The declassification of the FISA Docs alone would go a long way toward turning the tide.

    It’s now fully up to Trump to use these tools – or to not.

    Personally, I’m tired of waiting for what so many label as ‘the plan’ (as in ‘wait for the plan to unfold’).
    We either have Law & Order or not – and right now that’s a massively unfulfilled promise that Trump has just let go.

        Even if declassification took place, it is too late! Who would pursue it? Certainly not mueller or the democrats. Nothing has happened to hold those responsible on the other side. As I see it, the only thing left would be to fire rosenstein and mueller. AND that may not even help, and it would cause a Constitutional crisis. In other words, a revolt of We the People! It has come to that point!

    They’ll completely destroy their brand at a historical level.

    First, there’s something called a primacy (first) and recency (last) effect in memory. They plan to shoot their wad well before the election. Primacy recall by voters is next to nothing. They have their base, we have ours–nothing is going to change that. The question for the voter still remains: “Who has a chicken in every pot?”

    Second, VSGPOTUS will go thermonuclear (the likes of which we have not yet seen) on them for at least a year; maybe longer. Normal people are already saturated and sick of the kabuki and they’ve turned it off. They really don’t give a FF about the people that gave them the monthly pain of Obamacare (and the people that didn’t repeal it). The 30% of the Dem/Marxist base already has everything that they will get.

    So, the Marxists will be playing to an empty audience with their congressional games unless they opt for violence of the smokeless powder and accelerant variety among the two tribes in those wonderful vacation spots such as LA, SF, Portlant, Detroit, Memphis, Atlanta, JAX et al. In that case it won’t really matter one bit.

          But Trump has more positive attributes that should serve his aging health better. He is more positive and on the side of loving and caring for the people of our nation, and also on the positive side of rule of law and doing things the right way. Truth and knowledge over lies and conniving.

          The aging progs are intensely embittered, hateful, conniving and furiously angry 24/7!

          Any good doctor and health care worker would tell you, that generally, age for age, biology is going to catch up with those of the prog state of angry, bitter mentality before somebody with Trump’s positive state of mentality.

          Anger, bitterness and hatred are some of the biggest detriments to mental and bodily health.

          Bottom line…your observation is spot on.

    And here is my mad guess: (1) Now that there is a Democrat in the line of succession, push Pence out – try to make him resign the way Agnew did (through exasperation) or failing that the way Flynn did (to protect his family) and if all else fails, some other way. Every single day that Pence hangs on, from here on out, is a win for Trump. I am sure Pence will soon be put under some kind of terrible pressure. (2) If Pence can be disposted of, then try to get Mitt Romney installed as VP in Pence’s place, by scaring everybody into the fear of Nancy Pelosi as otherwise next in the line of succession. Prove that nobody but Romney has the votes to get through the Senate, so it is a choice of Mitt for VP or Nancy Pelosi in the line of succession. Go all out with all media allies in support of this. A nice move would be having the NYT admit some of the many crimes of the Democrats, which would indeed spook everybody into Mittness, which is the actual goal. (2a) If Mitt gets picked, proceed with impeachment, full on, and if it works, then help Mitt get the cabinet he wants, and be re-elected in 2020, so he can restart wars and start emptying out the economy. (2b) if Mitt is NOT picked, then drop impeachment and live with Trump, because Nancy Pelosi in the White House as a consequence of her own impeachment proceedings will be unable to govern.     Forgive me if I am wrong but, assuming Muller continues his investigation for another 6 months and the Dems are only willing to impeach on the basis of his report, (which seems to be the case for Pigloser and Schiff for brains), it seems to me that the Dems have, themselves, run out the clock. If no report is forthcoming for 6 more months the soonest the Dems can organize an impeachment vote would be the fall of this year, assuming the report is ‘damning’ enough. The senate is sure to drag out the process and it could even mean going to SCOTUS for a final decision. All of this takes time. Even then impeachment is a long run. By the time Trump gets rolling on the next set of rallies for 2020 there is no way they will be able to stop him. IMHO the best moment for impeachment was before Christmas, Had muller delivered his report in early November. With every day that goes by the possibility of impeachment become all the more astronomical. This is what I am now counting on. I am actually encouraged by POTUS Trump’s handling of the wall situation. They cannot do a thing without his say so. The same will be so on the impeachment front.

        @Sundance: From what I learned is that Whittaker who took over Rosenstein’s assignment and now is in charge of the Mueller investigation that he ri8pped up the agreements made with Mueller ergo no more denying Horowitz and others involved in investigation necessary documents to complete the reports.

      I agree with you. It almost makes me want to become a democrat. They stick together like glue, they fight like crazy, they organize. They are like a team that busts their ass to win even when playing a much better opponent. You get to hold your head up high knowing you did everything you could to win.

      Being a Republican it’s like your on a team, you look at that better opponent, know they are better then you and you instantly give up, don’t try hard and then ultimately get destroyed. Who the hell wants to be part of a team like that? Except for a few, the GOP is frankly embarrassing at this point.

Mueller will be gone as soon as the AG fires him. Which he should have done as of yesterday. Graham does not want Mueller gone. I want to know why? We all know not to trust the new fangled Graham. support of Kavanaugh notwithstanding.
      Why do Senators who know this is a scam and know what the Dems are doing, asking for the new temp AG to “give him more time”. Why? Am I missing an angle here?

      IMHO, Mueller is biding time trying to extend his operation. He knows there is a ticking clock of how long he has left especially when the new AG is put into place. Mueller is trying to act legitimate by asking for the extension of 6 months. You see, he has so much still to do (not). IMHO, things are going to get quite interesting with Mueller in the next few months and it may not be what he bargained for.

    Almost all of this could be avoided if Trump would order full declassification so all the crimes of the investigators are made public. That would effectively neuter the investigation and give Republicans real ammunition for use in any hearings, especially in the Senate, which could call for indictments of the top FBI and DOJ people who were involved in crimes, like destroying or hiding evidence and illegal FISA submissions and many lies told to judges and others.

    Declassify and begin the real war.

      Most of the evidence is already available to those empowered to secure indictments. Making the evidence public and more Congressional hearings are not required, and IMO would be counterproductive. The hearings do little more than to delay and sow confusion.

      Finding enough individuals within the DOJ with the integrity to do their damn jobs is what’s missing.

        Getting the information to THE PEOPLE is the point. The DOJ is the problem, not the solution. Same with the FBI and 100% of Democrats and about 60% of Republicans. So hearing are not the point. The point is so every citizen can have the smoking guns. And the tiny islands of actual journalism can help take the full document set and publicize the story. The American people must have this information because we are supposed to run the country. Without declassification the only way the truth gets out is by selective leaks, which CTH has consistently pointed out are done to protect the actual criminals.

        We need full declassification now.

    I am old enough to remember well the attempt to impeach Clinton and how difficult that was, and how many months the process took. It ultimately failed, and they had good reason to impeach him. It will also fail in Trump’s respect to. When he gets to term 2 he will choose a cabinet that will absolutely put the fear of God into the Clinton Cabal. No mercy!

    Another 6 months to find some crimes somewhere by someone. Then, he’ll get another 6 months, and another. At that point, he can’t quit because the re-election is in the thick of it.

    And that’s the plan: Keep Mueller acting as blocker for any legal issues that the Obama administration might have. I mean, Trump won’t drop the hammer until Mueller basically writes himself out of a job. It’s all about that leverage you know.

    Trump really is our last hope. Florida just gained I think… about 150.000 new citizens from naturalization (since last election)? I saw that somewhere, Trump won’t win Florida again if most vote D. Then we have mass voting fraud that I think will be the worse ever.

    How far will the police state go? We’ve seen the IRS targeting of conservatives. Government agencies being weaponized against political opponents means the end of the political opponents.

      I believe legislation was introduced in the last session of Congress mandating release. If it isn’t released willingly by Justice, then the Congressional committees will certainly issue a subpoena. It’s almost certain the matter will end up in the courts.

      Who knows? If the report isn’t that damning, POTUS may decide to release it himself with his rebuttal attached.

      • Legislation introduced would need to pass both houses and signed by POTUS. To my knowledge POTUS did not sign such a bill. Just like the Nu es memo and Horowitz’s first report, AG can edit and redact. Mueller is no different than any other line prosecutor and under the executive branch conducting a counterintelligence investigation (at least initially). This all political kabuki theater, if POTUS was worried he could end it all tonight.

          You are right, legislation isn’t going to get Congress the report. The Senate won’t pass it and the President won’t sign it. This approach is pure nonsense.

          Dems in Congress want the unedited report and are certain to issue a subpoena for it. If you listen to their press conferences recently, they are already talking like they expect to receive it. Note that all the talk about delaying impeachment centers around the statement “We’ll have to wait and see what the Mueller report says.” They are establishing expectations.

          One thing is certain. This matter will end up in the courts. Even more likely, it will be leaked which makes this entire discussion about release moot.

    Again, I simply believe that PDJT made a grave error by not declassifying the docs well before the election. The House was important to keep. Deconstructing the cover to expose the criminals would have helped shift support on a number of very close races in both houses.

    Every week and month that goes by enables the left to maneuver, position, build defenses, initiate other offensive actions that put the President on defense. His inaction, for leverage or whatever, could lead to a point where his taking action is miniaturized as a feeble plot to stop the righteous process of impeachment.

      I am always in the “they must know better than us camp”, but you make alot of sense. Emergency wall building and declassification of everything better start soon or else these folks are going to ruin the country.
      He cannot listen to McCarthy or McConnell anymore. He needs to listen to his instincts and Mr. Miller and even his NON POLITICIANS in his Cabinet. McConnell may be holding Senate votes for impeachment against him, which may be on the back of Trumps mind(I take that back, it is not on his mind at all), but things are much more serious than that, and if Trump makes this about the RULE OF LAW, you will see some wonderful things happen. He needs some UNTOUCHABLES to volunteer at the DOJ, FBI and other agencies. YOu will need people who care about the rule of law. Not the rule of Soros, Globalism or the Chamber of Commerce. Just this: “did this person violate the law?’ YES? NO? Indict him or her via a grand jury.

      Whitaker came from within the DOJ, and he knows well the breadth and depth of the corruption there. Since his appointment as acting AG, the appearance of him doing nothing to bring order to the intentionally misguided chaos of the Mueller investigation, punish the malfeasance and criminality of the perpetrators and co-conspirators of the coup attempt, and pursue the Clinton email, U1, and foundation fiascos makes him appear as just another deep state stooge.

  36. I think the House investigations will actually serve two purposes.

    The obvious one is to ‘dirty up’ the President. This has been their goal from Day One.

    The less obvious one is to provide a series of distractions when the Mueller investigation concludes with no substantive material related to ‘Russian collusion’.

    The release of the Mueller report will be — like everything else anti-POTUS — receive its ‘fifteen minutes of fame’ and then the news cycle will move on to the current ‘hot’ investigation.

    The simple fact is that the Democrats are much better at playing the ‘partisan’ game than the Republicans.

    DC cannot and will not stop the ongoing coup until they either succeed or are decisively defeated. It is as simple as that. There is no white knight on the horizon, nor any sane remedy to arrive via the Congress or Judiciary. As in 1776, it will fall to the citizens of this country to take back control of our fate and re-establish Constitutional governance and the Rule of Law. This could take the form of a “yellow vest” type movement beginning with a massive rally in DC during April and then grow organically into a nationwide protest against the entrenched corruption in nearly all branches of the federal government.
