Fired FBI Director Andrew McCabe Requests Criminal Immunity in exchange for Congressional Testimony…

Wait, what?  We’ve obviously come a full 180° from the place where Democrats were proclaiming McCabe’s innocence; and we’ve entered the phase where McCabe is requesting criminal immunity in exchange for testimony about what he knows of the corrupt FBI operations in 2016 and 2017. [Worm Turning Speech Increases]

In a series of letters going back and forth between Senate Judiciary Chairman Chuck Grassley and Michael Bromwich, the attorney for fired Deputy FBI Director Andrew McCabe, Bromwich is requesting criminal immunity in exchange for cooperation.

On May 31st, 2018, Chairman Grassley invited Andrew McCabe to testify [SEE HERE]; On June 4th Bromwich responded [SEE HERE]  Grassley is requesting emails McCabe said he sent to Comey about talking to the media.  According to McCabe, despite his false statements to FBI and INSD investigators (under oath), his conduct was with the full knowledge of FBI Director James Comey.  Grassley was asking for proof.  Bromwich responded by saying McCabe doesn’t have the emails, the current FBI does.

Here’s the response letter:

Chairman Grassley followed up requesting a copy of the Non Disclosure Agreement signed by Andrew McCabe which blocks McCabe from producing the requested documents [SEE HERE] and Grassley also responds to the request for criminal immunity.

First, with respect to your testimony, the Committee’s understanding of various controversies at the FBI related to and following the 2016 election would be greatly aided by your testimony, not only at the upcoming hearing but in a more comprehensive private setting as well.

While I have not yet done so, I am willing to discuss with the Ranking Member your request that the Committee consider seeking a court order compelling you to testify under a grant of immunity. However, under 18 U.S. Code § 6005, seeking such an order requires a two-thirds vote of the Committee, and even if that were to occur, the Justice Department would then have a formal opportunity to delay any testimony and attempt to persuade the Committee not to proceed. Before even beginning to consider whether to initiate that process, the Committee would need to know a lot more about the anticipated scope, nature, and extent of your testimony. The Committee could then informally consult with the Department to solicit its views before deciding whether to proceed formally.  (read more)

According to CNN – Grassley has set the Judiciary hearing for next Monday, but it could be delayed, as the inspector general’s report — while a moving target — is still not public yet. Sources familiar with the report describe it as a massive undertaking, walking through the events leading up to the 2016 election over roughly 500 pages.

    Also, this will be indicative to watch. If Grassley holds out, it means he’s got testimony that will implicate McCabe so strongly that Grassley can drive a harder bargain. It then will be crunch time, and well-deserved, for McCabe, who has violated the trust the nation placed in him.

      The great news about all of this: 1) Grassley doesn’t do the deal-making, DOJ does. Only they have the power to make deals and grant immunity. Congressional testimony is for kabuki theater, 2) The DOJ, which President Trump is the head of, has the power… 3) I expect that we don’t need a single word from McCabe (btw, wouldn’t hold much water as he is already known to have lied so anything he says against another crony would be made into mincemeat by that person’s lawyer) would be unnecessary and useless. 4) He can take the 5th, the evidence we already have can be used to indict and prosecute.

      McCabe has no cards to play. Even if could “give” us Obama, it would mean nothing in the big picture. Obama isn’t going to be prosecuted…but his legacy will be dismantled.

      Remember all the people McCabe thinks he could give us – they, too, have lawyers.

        McCabe is not going to fall on the sword of his jaded Communistic ideology.
        I would die to defend our Republic, for which it stands
        Man’s soul is nurtured by love, virtue and moral clarity.
        There in lies the basis for having the courage, in what I believe.
        McCabe is a rich man on the backs of the American taxpayer.
        At the same time, he has been a traitor to these very people.
        A slug has twice the credibility!

      • Not sure how that worked but seems meany plead the 5th and it seems lime a magical blnket of protection. From what I understand, pleading the 5th means you shut your yap….doesn’t mean that you cannot be proscuted when the evidence is presented. I am gonna take a wild guess there are loads of evidence. Fingers crossed we are gonna get r done with some Gitmo!

          Generally, you can plead the 5th all you want. But once you’re given immunity, that goes away. At that point, if you continue to plead the 5th, even after given immunity (meaning the “I won’t talk on the grounds that it might incriminate me” part) then you can be found in contempt. And THAT means… off to jail with you.

            True but that is exactly what the two assistants to HRC did (in fact about 5 people got immunity, not sure whether all thereafter also plead the 5th).
            So they got immunity from DOJ/FBI in return for testimony & cooperation. Thereafter they plead the 5th and refused to answer. Yet the DOJ simply allowed that to pass and has not rescinded their immunity deals.

            That actually is the most serious part of the HRC email scandal. They also were allowed (as co-defendants) to sit in on interview of HRC, despite the fact that she already had normal lawyers present. But the real scandal is that they plead the 5th after been granted immunity from prosecution …

            Issue here is really the DOJ persons involved. They can do whatever they like and no-one can really do anything against that. Perhaps another prosecutor can try to nail them, but I’m not sure how that would work.

              It was a long tale of unseemly behavior. DOJ gave some of team Hillary immunity, some received limited immunity, some refused to testify and/or took the 5th. To those non-Hillary fans who were watching, it was irregular and disquieting in the extreme. Hillary was allowed to testify not under oath. The meticulous note taker, Comey, took no notes. The business with McCabe’s wife getting the $700,000 from Clinton close associate Terry McAuliffe even though McCabe would oversee the Clinton investigation was similar.

                And when Hillary was interviewed, she also said “I don’t recall” 50 or 100 times… and blamed it on a fall.

                The senior FBI guy then tried an end around Comey, was trying to get Hillary’s medical records. That’s when Comey cut him off, went public and said she was innocent, nothing to find.

                That last straw led him to resign.

        I think, though, that if you get immunity, then lie under oath in your testimony, not only can you be prosecuted for perjury, but immunity is revoked.

        What I think we are all missing here is that from all appearances, McCabe was the head of the ‘small’ group, i.e. conspirators, who met in his office to plot. If this is the case, he could have had direct connections with the White House/State Dept., outside of the official Comey/Lynch channel.

        It would be interesting to see what the “scope” of McCabe’s testimony would entail?

          Even if the “scope” went all the way to Obama, and even if we “proved” it, it wouldn’t yield what is needed. Obama is not going to be indicted. The damage can be done by his “legacy” being destroyed, and if we write the history books, then his malfeasance before, during, and after his presidency will be publicly known.

          I’m not for indicting and messing with Obama in court – not because he isn’t guilty, but it would serve no purpose and be damaging to the psyche of the American people. We should remember there are millions of braindead, brainwashed voters out there – and people ready to riot in New York minute, just because of skin color. That’s a bridge we don’t need to cross to achieve our #MAGA goals.

          If we expose, and get all the nefarious players beneath him, we will accomplish quite a bit.

            I agree with you in general terms. Specifically, though, I have a problem with the fear of riots if or when anyone in the Obama Administration or Obama himself is indicted. The fact is that we already are living through a civil war of sorts, only that up to now it has been fought with words. And yes, it could very well get hot if Obama or, say, Lynch, Comey, Brennan and Clapper get indicted. But, are we to shy away from dispensing justice to these criminals just because of riots? If so, those of us who want the DC swamp drained have lost already.

                  Yes, and changing of documents to “senior government official” instead of White House in one instance. While they’re trying to make it look like it started in 2016, it’s likely Obama was involved long before then. This kind of treachery usually starts at the top and is given as directives to the people who can make things happen.

                  All of this goes to more than just “interfering in free and fair elections” – they were actually trying to rig an election. That’s why they were all so confident Hillary would win – voter fraud, fraudulent vote tallies, etc. Strzok indicated the “back-up” insurance plan, but that can also indicate there were already others plans at work…

      I suspect there is not much McCabe can say that isn’t already known. He had the trust of everyone with the privileges he had responsibility for. He is a traitor to everything this country stands for, and for which blood has been shed. He and others should be shot or electrocuted. Seriously.

      I agree with Lady P, about Obama unless he can be undeniably shown to have done vile things so bad and apparent that even the brain dead liberals want to vomit. Then, he should be shot as well.

      But the most important thing that needs to happen is for there to come apparent a clear line of good vs evil; servants of the Republic vs servants of self/evil so that as large a portion of the constituency is able to become grateful for the law, the U.S. Constitution, and the government which serves them.

      A growing population in this country still cringes at Trump’s deliver, but they cannot help but be in awe of the tracks he’s leaving behind.

      And in time, it will be appropriate for those Patriots who are slowly ensnaring and bringing to light the snakes in the grass, the swamp creatures, and the lurking evil powers and beasts — it will be time for them to also step fully into the light and be recognized by a grateful nations, now awakened to the danger we are in.

    “Way back, I said that McCabe’s defense team would tell him that his best move was to take a plea deal. And certainly his wife had been pleading with him to take a deal. So imagine the distress when the prosecutor says “No deal.” Must have been horrible for him, but consoling to the Rhadamanthine among us.
    I have said that the perps must be having sleepless nights sweating blood. This recent immunity request by McCabe suggests just that.
    2018 is going to be a glorious year.

    Cause, I figure, they are going to need a few truck loads of this IG report when it’s released…
    That’s like 20 Pallets of them in each truck, or more if pulling doubles or triples, eh?…

    I figure it’s going to take them at least 2 days or more to print all those copies, cut them, bind them, and add the covers….When we see the lights burning all one night and into the next, then the report will come that 3rd day or so… Throwing “one copy” on a table for release would be like the Aussie’s meeting up with the footballer’s down at the 3 Feathers’ Pub….not a nice picture, eh?

    It’s the same ploy Mueller is using. Andy just wants the immunity. He has no intention of giving helpful testimony whatsoever, insofar as what Congress knows.

    He’s an actor that has seen the script, or most of it. Only the IG knows the whole story. Andy can give a shoddy synopsis, some red meat, but Congress still has to wait for the curtain, so to speak. They’ve not been trusted, and aren’t, and for good reasons.

    If we’re only just hearing about it, he likely made his request some time ago, and hopes he gets a yea before the IG breaks. He’ll be called, then, anyway.

    On the other issue, betcha Lynch follows suit and refuses to testify, and Comey refuses again. Lying will do neither any good, at this point.

Limited Immunity( NOT Full or Use) 2) IF granted 5yrs Fed time ( NO parole) 3) ALL information furnished MUST be corroborated & verifiable i.e.documents/records etc and the BIG one 4) that your info WILL lead to the indictments of Commiey, Yates, Lynch , Obungo et al.       I hope there is no deal, but if there is, allow me to add two items to your list: forfeiture of government pension (minus individual contributions), forfeiture of government healthcare for the rest of his life. This may not hurt him much, as he and his wife are worth millions, but it does send a message to the corrupt, as well as We the People, who need to see this happen in order to main any semblance of faith in law, order, AND punishment. I know I could sure use it (though I’m wanting jail time….at GITMO….one hour of sunlight a day for the rest of his life)

    There’s plenty of evidence to convict McCabe without his testimony.
    Once he gets a taste of those prison hardcores, he’ll be glad to rat out his swamprat pals just for a private cell and a better mattress.

    Whatever is going to come out about McCabe, it must be bad. His request for immunity confirms it. It looks like I’m not alone in saying, “no way.” The guy’s a snake. You could not believe a word that comes out of his mouth in any event, and I’ll be darned if I’m going to listen to him defend his actions or offer explanations for his criminality and corruption. I want to believe that with the testimony of whoever has flipped so far, McCabe’s goose is cooked, along with many others.

    And as for his attorney Bromwich — swamp creature of the first order. Look up “Kenneth Michael Trentadue.” Bromwich figures prominently in a whitewash of Trentadue’s murder in FBI custody after the bombing of the Murrah building in 1995. A caution, however; some of the photos are disturbing.

    Here is the long and short of it IMHO. Between the IG investigation, the Little Rock investigation and John Huber’s Utah Grand Jury, they know everything already. McCabe can’t tell them anything they don’t already have from 3 or 4 different sources. I’m with Q, NO DEALS!

    There was an old story of a judge, while sentencing a convicted felon, said “You see that big oak tree outside the window son?” The prisoner replies “Judge, there isn’t a big oak tree out there”. The judge turns back to him and says “There will be by the time you get out son, Forty years!”

    under no circumstances should Grassley fall for this. This is going to be a double blind situation. McCabe will ask will for immunity, and McCabe will give some mealy mouthed testimony alluding to Comey. Comey will ask for immunity and do the opposite. McCabe was one of the most powerful intelligence agents in the country, this isn’t some simple truth telling mea culpa. If the intelligence agencies were involved in corruption, immunity is the surest way to get them out of trouble by being misleading

And the only plea deal I’d be happy with is 5 years off his sentence BUT only if he agrees to testify and tell the truth on national TV so everyone will hear it. If none of this is broadcast, they will keep spinning the “made up” version of everything. Not sure if that will result in any healing in the Country but I want it done. It’s the only way some people are going to wake up.

    Congress cannot grant immunity from prosecution that is the result of the IG and Mr. Huber’s work. That is basically what Grassley is saying. Plus the IG report what he finds as he goes along so McCabe is just helping the Swamp deflect and distract.

    IF and I mean IF McCabe were to be granted immunity what does that entail? immunity only for the things he is being questioned on? or immunity for any other issues that arise from that testimony? just curious…
    And Grassley mentioned the 2/3 vote to grant immunity but again, how does Congress compel the DOJ to grant immunity in a criminal proceeding?
    and yes, I too thought it was ironic how outraged McCabe’s lawyer was about leaks in the case…gimme a break…

    Unless I missed something, McCabe is the one who has numerous charges against him. Prosecutable offenses. Weak position. So is he ready to throw Comey under the bus in return for immunity? Seems to me the net is big enough to get both of them without this, but ?

      Others are making a good point. Can Grassley grant any kind of immunity? If that is on the table, hold McCabe to handle his own defense when Huber goes after him. Hearings at this point are just hearings. A stronger effort is running elsewhere.

    Ya take the Fifth if yer guilty or if yer embarrassed. I don’t see anybody goin’ to jail for 20 years rather than be embarrassed, so the jerk just basically admitted he is guilty and is tryin’ for immunity to save his own ass. There is no remorse or patriotism in him.

    If he actually cared for his country he wouldn’t have done the things he has done and would be willing to talk to show his remorse and would be willing to man-up and take his medicine. But to say, “I’ve got important evidence for you about all the perpetrators but I ain’t talkin'” don’t sound very civic minded or patriotic to me. Certainly not the FBI’s dedication to the truth and justice that he supposedly spent his whole career following. LOL

    Even Comey didn’t take the Fifth when he testified to Congress. But, come to think of it, after the IG report comes out, he might change his mind if it turns out to be as damning as they say.

    Even if McCabe testifies, UNDER OATH, ya’ll know damned well he will lie his ass off as he and his cohorts have been doing all along and will continue to do. AFAIC, if he takes the 5th (actually, if any of them take the 5th) it will be proof enough that they are lying about things and guilty as hell – – – at least in my mind that’s what it will signify. But that’s just me.

      Hmm… as far as I can tell, there are only two people Comey could have been “insubordinate” to: Loretta Lynch and Barack Obama. If so, then the question is will Comey DENY that insubordination… which basically would require him to say that any acts (illegal or otherwise) that he committed were what Lynch and/or Obama WANTED him to do. This is gonna be REAL interesting.
