Federal Judge Rules Trump DACA Program Elimination Appropriate and Authorized – Full Judicial Ruling…

Federal judge Roger W Titus (Maryland) has ruled that President Trump acted appropriately and within his authority by announcing his intent to rescind the Obama-era executive order surrounding Deferred Action for Childhood Arrivals (DACA). However, the Judge Titus order does not stop the previous blocks by activist judges currently working through the courts.

Eventually the state challenges to the recension of DACA will work through the appellate courts and arrive at the Supreme Court. It is likely SCOTUS will take the same position on DACA as they did on DAPA; overrule the state challenges and determine the program unconstitutional.

In the interim, President Trump had requested that congress take up the DACA issue as part of their responsibility to put forth an immigration reform bill. Democrats have abandoned legislative efforts to assist those impacted by DACA, and have instead chosen to make DACA a political issue for the 2018 mid-term election.

Current recipients are able to apply for renewal while the cases are pending, but no new illegal immigrants who would otherwise be covered by the program can apply.

A Justice Department spokesman praised the judge’s decision.

“The Department of Justice has long maintained that DHS acted within its lawful authority in making the discretionary decision to wind down DACA in an orderly manner, and we welcome the good news today that the district court in Maryland strongly agrees,” DOJ spokesman Devin O’Malley said in a statement.     • President Trump should do what Candidate Trump promised to do if he was elected. Rescind DACA on day one of his administration. The states that threatened to file suit to end DACA should now file that lawsuit no that six months has passed and Trump still has done nothing to end the program after they set aside their lawsuit. End this illegal alien amnesty once and for all.

        I’m not for DACA and I dont believe ANYONE should be rewarded for entering illegally, even children. I do wonder what will happen if they are not deported. If allowed to remain illegal in perpetuity states, counties and municipalities will put in place stronger and stronger measures to counter immigration law. Children will be raised to be violently anti-American.This will be a neverending process tearing at the social fabric. I wonder sometimes if, after a wall was built, there might come a time when conservatives decide to support legsl residency w/o citizenship.

          It appears that this anti-Trump judge got over his personal opinions and answered that question: “deferred status will expire, and enforcement of immigration laws may recommence in the absence of action by Congress.”

          These are quotes from pages 26 and 27:

          “… The rescission of a policy relating to prosecutorial discretion does not shock the conscience of this Court. Absent congressional action, the benefits given to Dreamers by DACA were in potential violation of congressional immigration laws; the only thing that has changed is that deferred status will expire, and enforcement of immigration laws may recommence in the absence of action by Congress, which the President has requested. There is nothing surprising or unfair about policies, laws, or enforcement thereof changing with an election cycle. Furthermore, the election process, and not federal litigation, is the appropriate method for resolving any fairness implicated in DACA’s rescission.

          “Accordingly, the Court finds Plaintiffs’ substantive due process claim to lack merit….

          “… Nothing in the DACA Memo or in DACA’s implementation suggested to Dreamers that the program was permanent, and individuals in the program were aware that their protections were subject to renewal every two years. DACA’s rescission lacks any serious injustice—let alone, affirmative misconduct by any of the defendants….”

          Clearly, DACA expired and processing renewals of an expired policy is absurd.

      CTH/Sundance has made available an excellent resource here. While calling DACA and EO might not be accurate, the form that created DACA is merely semantics. It is clear that it was an Executive action under Obama’s approval and direction through DHS. That’s the way our executive branch of government works. The courts have held that executive orders, proclamations and memorandums advanced from the Executive branch are to be considered equally binding law, barring any Constitution or legislation violation.

      Clearly, Obama’s singling out a certain group of 800,000 foreign nationals for special protection violated our immigration laws, yet our do-nothing Congress … did nothing to object, even after a court ruled in 2013 against Obama for refusing to enforce certain parts of existing legislation. No U.S. president has discretionary power not to enforce constitutional laws.

      Regardless of your criticism of CTH and Sundance, whom most of those who come here appreciate, what matters is the court’s ruling. In a nutshell:

      “deferred status will expire, and enforcement of immigration laws may recommence in the absence of action by Congress, which the President has requested.” (p. 26.)

    DACA will be the DEATH 💀 of the Democrat Party! What they have done since the start of this year has been a complete gift. From shutting down the government for three days for their DREAMERS to having Nancy Pelosi babble about her DREAMERS for 8 hours on the House floor to voting NO against our President’s four pillar proposal, you couldn’t ask for anything more! Polling is devastating on this topic against the Democrats and in favor of our President.

        Agree filea. If POTUS did expose the truth on Pakland, we could actually start gutting our schools of these dangerous people and policies and really protect our children. Instead of boldly exposing the truth, owning the narrative and moving towards solutions, safety, law, order and learning, POTUS is following their laser light (and so are we) by debating their agenda and false narrative. By hiding the real problems, we breathe life into the gun lies, and give it national whitehouse coverage which is exactly what the left wants. Meanwhile, promise programs go on, uninterrupted, as intended. LE/FBI continue to be political weapons used against us and our Republic. How many criminals roam our streets due to this or similar programs? Why wasn’t this discussed? I guess we don’t import enough murderers, we have to cultivate them here too. No matter how you slice it, patience isn’t a winning strategy. Imo, we need to contact POTUS to disengage from their narrative and just expose the truth. We are always in the dark and being led. We know little more today than we did 14 months ago and what has been exposed remains without justice delivered.               Our children do not need to be micromanaged by a bunch of politicians in D.C. who filch their take from the educational dole, then hide away while they manipulate data to suggest their actions are worthy.

              Not so. Our children cannot read, write, or do basic math. They cannot write or read cursive, draw conclusions from their reading or discussion materials, anticipate outcomes from behavior (especialy UNintended consequences), but THEY CAN play video games.

              Example: How many adults does it take to teach a four-year-old to read? Thousands according to Head Start, which is still, still, still being used to teach reading to youngsters who probably can already pick out letters and the sounds they make from watching Sesame Street. Diacritical marks are not common in the English language, yet they fill the pages of Head Start materials, only confusing young readers who have learn them, then UNlearn them to graduate to advanced readers not written by the Head Start publishers

              We do not need to go the tattooing rout. I agree it is a bad idea.
              They do rely now a eye recognition . Before I was a citizen coming back from Europe my eyes were photographed and the computer compared the image. I thick they should have this computer imaging machine at the borders and everyone need to be put into the data base.

      I agree, completely. The DACA debacle is a time bomb with a short fuse sitting square in the middle of the Dem party. Their bag of tricks is almost depleted and, in the case of DACA, it is dependent upon activist judges who find no shame in being overturned in their efforts to interpret the law to their liking. They have succeeded in delaying the inevitable, but it is an ephemeral victory and history will scoff at its futility.

  4. Just have to laugh at the position the Dems are in. They dare not make a deal with PDJT, because they know he will not sign anything that they consider ‘win’. Their only hope is that activist/obstructionist judges can delay the end of DACA until after the mid-terms.

            Remember, there are more uncontested incumbent Republicans in Texas than there are Democrats. Example: Pete Sessions- unchallenged GOP incumbent with 4 Democrats challenging him. That means 4 more candidates campaigning and getting voters to the polls. Does not necessarily translate to November.

          I just voted and my county is a heavily R county. Lots of press silliness about heavy early D voting, blah, blah, blah. During my 30 minutes at the polling place there was ONE D voter that came through and 17 R voters…

        Voter registration ended February 5th. Early voting from February 20th through March 2nd. Primary is today. Our county has 2,000 more registered than 2016. It is typically red however, a liberal university town. I did not see any conservative groups registering people to vote, but the opposite. This is a very important primary with many key positions from the Governor on down. It’s going to be tough to keep it Texas red with complacency.

Why bother, except as a convenient way to check the enemedia without giving them clicks–that’s all I use Drudge for now.           This is really the point–we need to MAGA at the grass-roots level, taking the local GOP away from uniparty and getting firmly in line with PDJT. My city’s (NOLA) is a lost cause, but I’m getting involved anyway. Could matter for the state and if there is substantial cross-over black vote, as the old, Demonrat party line voters get slapped in the face with how they’re being sold down the river by the DemonNC contrasted with how PDJT/MAGA actually delivers better social and economic conditions for everyone.

        Yeah, right. Two thirds of the local races in my county do not even have a democrat running. Texas has not elected a democrat to statewide office since 1994 and will not do so in 2018. Do you think it matters if more democrats turn out to vote in any of the “blue” counties? If a county official received 10,000 votes in 2016 and that same county official receives 20,000 votes in 2018 what does that matter?

        Let me see if I have this right – DAPA – all courts rule against jugears and say it is unconstitutional – no dissenting courts as it winds its way through the system. But the SC hears it – and also rules against it.

        DACA – all heard the case, and until this most recent court, approved of DACA and shut PDJT down on ending – but the SC would not hear.

        SC could have heard the case and shut DACA down last week but now we have to live with it until the 9th circus hears it and agrees with lower courts that it is leagal (highly doubt the 9th circus votes with PDJT). 9th circuit will slow walk this beyond the mid-terms if they can.

        What’s up John Roberts? This and the fact they can’t seem to handle the FISA court clusterfilth just tells me we have a SJW as chief justice.

        This is very easy to stamp out for illegals to vote. Do not print any ballots in Spanish or another language beside English.
        All immigrant becoming a citizen have to take a test that includes to be able to read English and write basic English.
        Why to we print ballots in Spanish if naturalized citizens have to be able to read and understand English…? This is ripe for fraught and who ever came up with the idea to print ballots in Spanish is helping voter fraught.
        Maybe we need to work for only English for ballots and it is not discriminating because English is the primary language in this country..

    Judges rule on matters of law. There is no law which supports or creates the basis for DACA. That DACA is unconstitutional to begin with doesn’t even factor into how wrong it is for judges to weigh in attempting to block the rescinding of an executive order (or executive action) by the president.

    A judge may rule that an executive order is constitutional or not. But even a constitutional executive order can be rescinded by the president WITHOUT judicial approval because the authority to put it into practice begins and ends in the executive office and so long as the law is not violated, the judiciary has NO jurisdiction over the matter. NONE.

    So we’re going back to the court-challenged DAPA route… What should’ve happened originally instead of this asinine “grace-period” thats accomplished nothing (and no, the activist judge who’s propping DACA up won’t even be punished). The hispanic community aren’t all of a sudden voting Republican in 2018 because of this foolish maneuver, but it did hurt the base that was promised DACA rescinded day one. Mull that over, DACA is unconstitutional and DACA is STILL in effect with permits honored and renewed because of this administration, and anyone who said it would be ended yesterday is eating crow.

    If Trump wants to rebuild credibility on this he must immediately come out and say ICE will be mining the DACA database and targeting everyone who’s on it.

      Agree bul. Your post is a stiff dose of reality. While I enjoy some of POTUS “art of the deal” bluster and maneuvers when it comes to trade and our enemies, not liking it at all when played on us. I’m a realist and learned a long time ago, people’s behavior tends to be pretty consistent. They don’t have seperate behavior patterns for different sets of people. Trump is always dealing and that includes us too. Not necessarily a bad thing, if the deal is a good one, it can be a good thing. So far, we are getting the raw end on immigration.

Make no mistake, many have woken up to the fact that several in the GOP are playing kabuki on immigration (see Grahmnesty and others ‘bipartisan fixes’) and it’s become abundantly clear the Dems only care about how they can use the issue to score political points rather than actually fixing any problems.

          Without exposing that most in office are actively working against the will of the people, removing DACAs/Dreamers/etc will only be a stop-gap measure until the next snake oil salesman comes along and re-opens the floodgates while Congress willfully ignores the issue so they can stay in the good graces of their donors.

I ask her, if I as a Canadian could drive down to the US and start wandering around carrying a handgun and a rifle, would I be covered under the 2nd amendment. Apparently its the wrong question to ask a progressive liberal.

There has been an unfortunate blurring of that distinction as courts became more populated with progressives and just plain sloppy thinkers/writers. As my best mentor once told me, “Judges are mostly C and D grade lawyers. An A grade lawyer can do a whole lot more and make a lot more money than a judge ever will.”

      On a related note, I rarely watch TV, but the little I have seen lately shows me that the full-court press is on to garner sympathy for any hispanic, Latino, Mexican, Central American, etc. From commercials to The Voice. The media captivates the masses. God’s intervention via our prayers is the only solution I can come up with. He can open eyes and minds, raise up fighting, effective people, cause black hats to fail/cease, root out corruption, etc., etc.

      As I go to the polls here in Texas to vote today, I have made a decision to try to become a precinct chairman. Full disclosure: I have never even attended a precinct meeting! Terrible, I know. But I HAVE to do something. I pray we each march into our local battles and know that God will use us, even if it is in a very small way.

      My daughter 48 lost her job two years ago when a company bought up her company.
      She is a Physical Chemist MA. She has two patens under her name but I believe she was to expensive. They told her they were eliminating her position . She was with previous company 17 years. After six months of letting her go they hired a cheaper person to do her job.
      My daughter has gone to top notch universities and was an excellent student. We are told a lot of misinformation like we need women in science. Right ow a German company based in the US is looking at her for less money she had earned before.
      I feel Americans are the hardest people I know.

    Lurking Lawyer here. Three legal observations for those interested.
    1. The Maryland judge’s opinion is masterful. Clearly and expressly addresses each and every plaintiff arguement with lots of legal citatiions. That is important for point two.
    2. This forces the goofy 9th circuit to rebute all these citations rather than wandering around in their self made legal wilderness. In effect, a roadmap for SCOTUS.
    3. Notes the California preliminary injunction presumes DACA lawful. He disagreed but did not go into detail other than to note the executive action was expressly based on prosecutorial discretion.
    Here is why the Maryland judge is correct that DACA is an unlawful abuse of prosecutorial discretion, a well entrenched feature of US law.
    Prosecutorial discretion applies to four ‘criminal’ circumstances: whether to charge, what to charge, what to accept in a plea bargain, and what sentence to recommend upon conviction.
    A. Whether to charge. Usually this involves the degree of evidence that might lead to conviction. Itbis a waste of prosecutor and court time to bring weak charges and lose. Two examples. 1 NJ was right not to retry Sen. Menendez on honest services fraud given the hurdles thrown up by SCOTUS in the Gov. McCauliffe ruling. 2 Comey was wrong not to charge Clinton in the onfidential material in unsecured private server scandal, because the applicable laws DO NOT require intent. They punish carelessness about natiinal secrets as a crime.
    B. What to charge—eg manslaughter versus some degree of murder involves intent and recklessness.
    C. What to plea bargain. The notion is a lesser crime/ sentence saves court time and cost while still serving justice.
    D. What sentence to recommend.
    And example today of b, c, and d is the mayor of Nashville concerning her use of city funds to carry out an affair with the head of her security detail. Plead to a single felony theft count in exchange for three years probation and resignation as mayor.

    None of these considerations apply to DACA.
    A and B. You are here illegally if you do not have a US birth certificate, a green card, or a valid visa. Thatbis black and white evidence.
    C does not apply.
    D provides no discretion. Being here illegally means automatic deportation.
    So the whole DACA rational itself is an unconstitutional perversion of properly passed immigration laws. The only solution (as the Maryland judge carefully notes) is for congress to amend its immigration law—something Trump gave them 6 months and a clear (and generous) template for.
    Wont end well for the Dems.
    Note also that this ruling, plus the SCOTUS denial of cert (bypassing 9th Appeals) expressly contingent on 9th being expeditious, gives DoJ and DHS a second bite at cert in just a few months, well before the election. This ruling amounts to a huge win for Trump in several respects.

    It’s sad that it took a Judge to recognize the obvious.

    Is it even possible that an ‘Executive Order’ could be created that could NOT be changed or rescinded by a successive ‘Executive Order’, either by the same president OR by a subsequent president?

    Any ‘Executive Order’ is either lawful (passes Constitutional muster) or it isn’t.

    If it isn’t, then it is without power or authority; if it is lawful, then it continues until the ‘Executive Order’ is scheduled to expire, or until the ‘Executive’ (the president) rescinds it.

    Neither the president nor the Congress can ‘grant’ RIGHTS. That is WHY government cannot take Rights away; our Rights did not come from government, they came from God, ergo government has no power or authority to take them away.

    ‘Benefits and privileges’ are created and granted by government all the time — as a CONTROL mechanism. That’s what ‘licensing’ is all about. You are deceived into waiving your RIGHTS in exchange for ‘benefits and privileges’, and if you don’t obey the terms of the ‘contract’ to receive those ‘benefits and privileges’, they can be taken away.

    UNLIKE your RIGHTS.

    Which is why we should NEVER ‘waive’ our God-given unalienable RIGHTS for government-granted ‘privileges’.

    So at best, Hussein’s ‘Executive Order’ created some kind of ‘benefit’ or ‘privilege’ for DACA people. And what the government createth, the government CAN most CERTAINLY taketh away — and does so all the time, thousands of times a day, every day, all over the country.

    So why is a ‘Judge’ required for ANY of this?

    It’s ridiculous.

    It’s just lawfare for the sake of lawfare, and any UN-corrupt judge would not even give it standing.
