UPDATE: Waco "Twin Peaks" Shootout – All Charges Dropped, Not a Single Successful Prosecution…

Here’s an update to a story we covered in detail for quite a while.  [All Rsearch Backstory Threads Available Here] After four years of seriously sketchy prosecutorial conduct, likely trying to cover up the number of people killed by police and SWAT units as they shot into the crowd, the McLennen county district attorney has dropped all charges against the bikers involved in the Waco “Twin Peaks” brawl.
That means the old DA and the new DA were not able to achieve a single successful prosecution of any of the 177 bike club members, after the entire group was originally rounded up and locked in jail on $1 million bonds.

This thing was FUBAR from the beginning with nine bikers killed, twenty more shot and injured, and the police trying to say they only fired 12 rounds.  Transparent nonsense made even worse when the police refused to allow the CCTV video to be released or used by the defense teams of those arrested. Total nonsense. Initially CTH graphed out hundreds of shell casings and it was clear the heavily armed police just opened fire into the crowd from three positions.  Some victims were shot while they were cowered in corners.

TEXAS – Almost four years after nine bikers were killed and 20 were injured during a shootout at the former Twin Peaks restaurant in Waco, McLennan County District Attorney Barry Johnson said Tuesday he will dismiss all criminal cases against the remaining 24 defendants charged in the midday brawl.

TEXAS – The video shows the scene inside the Twin Peaks restaurant in May just before the violent shootout that killed 9 people and ended up in the mass arrests of 177 bikers.

A fight and shootout erupts just off camera between a group of motorcycle clubs called the Bandidos and the Cossacks.

The reaction tells the story of the chaos and horrific scene that unfolds as the gunshots start exploding.

Waco "Twin Peaks" Shooting Update – No-One Charged

Interesting news blurb update amid an otherwise memory-holed story now almost six months old.

TEXAS – […] Of the 135 people originally ordered to wear GPS ankle monitors, all but 22 have been allowed to remove them, the Waco Tribune-Herald reported Sunday. Their lawyers have reached agreements with prosecutors to modify the conditions of their pre-trial release.

After initially locking up more than 170 people in connection with the May 17 incident outside Twin Peaks restaurant, McLennan County prosecutors have not charged anyone with the shooting deaths of nine people. At least 20 others were hurt. (more…)

Waco Twin Peaks Update – Autopsies Released…

Several attorneys for the arrested Waco Bikers have formed a website HERE (good to bookmark).  Today, the JOP in McLennan County released the preliminary autopsy reports to include toxicology.
waco 26 overall sideAs you read through the reports (provided at the link) you may want to note the number of bullet wounds indicated, and bullets recovered.  Then compare that number to the highlighted passage in the paragraph from the media which still holds the official response from law enforcement.
Also, note the ballistics (which will identify who shot whom) is not being released yet by the BAFTE.

Tragic – Parents Lose Custody Of Adoptive Daughter After Waco “Twin Peaks” Incident…

‘All your children are belong to us’. – Perhaps someday they will turn this entire fiasco into a Lifetime Movie.  The totalitarian government response to the Twin Peaks shooting apparently has no boundaries.  Tragic, ridiculous, and desperately tragic.

Not only did nine people lose their lives, but many of those who were arrested in its aftermath lost their jobs and their savings.

And for Marilyn and Rob Bucy of Midlothian, that day resulted in the loss of custody of a little girl they called their daughter.  “There was never a dull moment,” Rob Bucy said. “There was a lot of energy, a lot of noise.”

It was a home filled with five children and smiles and hugs and love. Much of it was focused on the newest to the family, five-year-old Alyssa, whom the Bucys were trying to adopt from relatives in California. (more…)

Waco “Twin Peaks” Shooting Update – CCTV Video Released….

Late Friday a CCTV video from Don Carlos restaurant next door to Twin Peaks, was obtained by local station KCEN-TV media.

Apparently the video arrived through email from the law firm of Clint Broden who represents Matthew Clendennen, a local biker arrested in the shooting.  According to KCEN:

The hour-and-a-half long video shows people running, then cops approaching Twin Peaks and crouching behind cars in the Don Carlos parking lot.  There [is] no audio.

Both Mr. Broden and McLennan County District Attorney Abel Reyna said they could not comment on the video because to do so would be a violation of a gag order in the case.

Waco “Twin Peaks” Update – Judge Releases CCTV Video To Defense – But Blocks Them From Sharing With Media…

A Texas judge in one of the Twin Peaks “Biker Gang” shooting cases has agreed to release CCTV video of Twin Peaks and Don Carlos resturarant to the defense. However, the judge has also barred the defense from sharing the video and now placed a gag order to stop the defense team from describing the video to the media.

The Prosecuting State Attorney is continuing the fight to hide the truth, block public scrutiny and avoid the deconstruction of the increasingly apparent fraudulent claims originally made by Waco Police surrounding the shooting itself.

WACO, TEXAS – A state district judge ruled Tuesday that a Dallas attorney can have a copy of a Twin Peaks franchisee’s video of the May 17 biker shootout, but the judge barred the release of the video to the public.

Judge Matt Johnson of Waco’s 54th State District Court also granted a prosecution request to place a gag order in the Matthew Alan Clendennen case, preventing attorneys on both sides, law enforcement officers and witnesses from discussing that case only in the media.

Waco “Twin Peaks” Shooting Update – Defense Attorney Files Motion To Compel CCTV Video Release…

Dallas, Texas  — Clinton Broden of the Dallas based criminal defense firm Broden, Mickelsen, Helms & Snipes, LLP. announced that a hearing has been set on the City of McLennan’s motion to quash  the subpoena he issued to Twin Peaks for its surveillance video of the events of May 17, 2015.

The hearing is set before District Judge Matt Johnson in the 54th District Court at 9:00 am on Tuesday, June 30, 2015.  Presumably a hearing will also be held at the same time on Broden’s motion to sanction the City Attorney’s Office for filing the frivolous motion to quash in the first place.

Broden continued to express bewilderment that the City of Waco believes it has the authority to stop the production of a video that is owned by the Twin Peaks franchisee and which the franchisee is ready, able and willing to produce.  “Everybody needs to understand that this video is the property of the Twin Peaks franchisee.  It is not the property of the City of Waco, theWaco Police or McLennan county.  It is private property,” said Broden. Waco “Twin Peaks” Shooting Update – Police: “releasing video would compromise our investigation”…

Waco Police refuse to provide public any information about the Twin Peaks shooting citing, in general, “ongoing investigation”.  Video, autopsies, forensic and ballistic information will likely be withheld until the trials of the arrested, perhaps several years away.

(Excerpts Via Waco Tribune) One month after the deadly May 17 shootout at Twin Peaks prompted the unprecedented mass arrests of 177 bikers, officials are releasing limited information and say disclosure of certain evidence, including videos of the incident, would compromise their investigation.

[…] Residents have called for police to release all videos of the shooting to the public in order to clear up conflicting tales about the events that transpired before and during the bloody melee. Waco police have declined, citing concerns that doing so would adversely affect their investigation.

Local officials sent the videos to the FBI for analysis. Swanton said the videos include images from at least one squad car dash camera, Twin Peaks restaurant surveillance cameras and a surveillance camera from the neighboring Don Carlos Mexican restaurant.
