Seems to me that if Biden can’t produce some sort of written evidence that he actually instructed someone specific to use the machine to sign something…that this lack of a paper trail should invalidate each and every auto pen signed document lacking such evidence.

It does all need to be codified and made clear once and for all. Otherwise this issue will come up again.
I suggest it should be a rule that if circumstances require a President to use Autopen on anything consequential, he has to go back later and sign a confirmation note as proof he directed the Autopen use.
The chief of staff should maintain a running signature log to note the time, place and document for every official Presidential signature.
Any time the President anticipates that Autopen might be required he should sign a delegation of signature-authority memo that specifies who is authorized to operate the Autopen, for what types of documents, during which time-limited period.
This should all be codified in law passed by Congress. But in the meantime the President should lay it out in an Executive Order.

Americans vote for a President who is capable of exercising extraordinary judgment in matters restraining other branches of government, particularly the Legislative … and in shaping the Judicial branch. Isn’t this why we spend a year every four years vetting the next President?

Regarding “accepted rules” it comes down to whether the president directed the specific use or not. I don’t think it can be a broad authorization like “use the autopen to sign anything you want.” It needs to be at least a direction whose purpose was the intended use.
“Mr. President, here are 1200 pardons.” He looks for one second. “OK sign them.” That would probably be enough.
An analogous area of the law is in wills & trusts. Many, if not all, states have a provision where a will can be signed by someone else “at the director of the testator” (the person making the will).
The idea is that someone might sign a will on his deathbed and not physically capable of signing. This is something that will have been litigated in probate A LOT and would provide good legal reference.
As a lawyer, if I were making the case to invalidate Biden’s autopen uses (or some of them), those wills cases are where I’d look. Because this will all turn on whether he authorized it or not if litigated. And he will say he did — if he is at all capable of being deposed. We haven’t seen him in a long time I would note.
Constitution grants the pardon power as personal only to the President himself. It cannot be delegated. Period. It cannot be exercised by surrogate. It is personal to the President only.

Lack of evidence isn’t proof that a crime occurred. The burden is on the government to prove wrongdoing, and there’s no evidence – unless one of Biden’s aides admits under oath that a specific document was autopenned without President Potato’s prior authorization.
President Trump has said that his administration has emails from Biden’s underlings to the effect that Biden was unaware of the autopen use.
If that’s the case, then they should produce them and test it in court.

The validity of a presidential pardon depends on his/her knowledge of each case and the intent to grant clemency, not the method of signing it. The replacement of signatures does not invalidate the pardons.

In law, the issue here is one that falls under the general legal heading called “Agency.”
Simply stated, when one person with legal authority to do something wants to delegate or assign that authority to someone else who otherwise does NOT have the authority (in other words, to carry out the act “for and on behalf of, and in the stead of” the person who holds the authority in the first instance), then in law the person with the authority — and ONLY the person with authority* — must expressly create what’s called a “principal-agent” relationship that has, as its specific purpose and design, the definitive and intentional transfer, delegation, and/or assignment of the authority to the person so designated.
Most people have heard of the concept of “power of attorney,” where one person, in writing, grants specific authority to another person to do something on behalf of the first person. It’s done all the time, for any number of reasons, and it’s perfectly legal. There are a myriad of circumstances one can imagine where the use of this legal situation might come into play.
And so, if the second person, under a valid and legitimate power of attorney, signs a document on behalf of the first person that’s within the expressed scope of the authorities so granted, then in the law the document so signed is for all intents and purposes considered binding upon all parties concerned “as if” the first person had actually signed the document instead of the second person.
This is exactly what we’re talking about with regard to the use of the President’s auto-pen, except the “second person” in this instance is the auto-pen itself, properly loaded with the document to be signed, together with the person who physically controls and eventually pushes the computer button that tells the auto-pen to “sign document.”
If the person who controls and pushes the “sign document” button does NOT have specific, verifiable, express written authority to sign the document “for and on behalf of, and in the stead of” Sleepy Joe, then that person has no more authority to effectuate the document than the Man in the Moon.
We’re not trying to solve for the theories of quantum mechanics here. It’s simply common sense. If the Joe Biden regime cannot come up with the written, documented, expressly-stated authorizations (powers of attorney) for someone other than Joe Biden to sign, by use of the auto-pen, a specified document on his behalf and in his stead, than any document improperly so signed is completely worthless, and has no legal effect whatsoever.
But Trump can’t just make this declaration on his own. That, too, is worthless, and carries no legal weight.
Any issue regarding the validity or legality of the multitude of documents signed by other persons on behalf of Biden by use of the auto-pen will need to be decided in a court of competent jurisdiction after the issue is properly raised. And at that point, we’ll need to look at something we call “admissible evidence.”
Until then, we’re all just screaming into the dark night.
*Sometimes a statute or other law will preemptively grant a second person the legal authority to sign something on behalf of the first person.

WRONG!!!! The Constitution is the ultimate “law”. If the president cannot perform his duties, then the succession of powers as laid out in the Constitution governs who is next in line for authority. No where in the Constitution does it state the president can hand over his power to whoever or however he wants.
