Hunt tries to argue ‘separation of power’ which is exactly the point Miller is making. Judge James Boasberg is overstepping his authority within the judicial branch by attempting to instruct the executive branch about ‘national security’ determinations.
The producers are trying to send Hunt instructions electronically, and while Hunt is checking her devices for instructions, she struggles to hear the arguments presented by Miller and organize counterpoints. CNN looks silly. WATCH:

In I think it was 1949 ? the SCOTUS rendered a decision in a case where, after the cessation of hostilities of WW2, the administration expelled a German National using the Alien Sedition act, and answered her question, stating that not only did SCOTUS have no authority in the matter, they had no authority to even hear the question.

Why use the Alien Enemies Act? Just use USA PATRIOT Act. Declare them “Terrorists,” and therefore ENEMY COMBATANTS. No Federal District Judge has any authority to stop apprehension followed by swift removal to sites unknown or GITMO. The Liberal Democrats and the Wall Street Republicans wanted USA PATRIOT ACT, and the Enemy Combatant designation with no recourse to what happens to the “enemy combatant.” The bastards who wanted that law can now just sit there, shut up and suck on it.
