I DO care. When criminals escape punishment it sets an example for other would-be criminals to pursue. The pardon might keep them away from federal prosecutors, but it does not free them from the court of public opinion. I should think these so called “pardons” would be null and void due to the fact that none of these people have been charged or even accused of a crime. The theory of a “preemptive” pardon needs to be adjudicated and IMHO be thrown out as being unconstitutional. If this kind of abuse of power cannot stand.
from what i read in the article 2 section 2 clause 1 (in 1886 the supreme court refered to the presidents authority to pardon as unlimited except in cases of impeachment and extending to every offense known to the law either before legal proceedings are taken or during their pendency or after conviction and judgement)so he can pardon even before being charged with a crime.but i believe the supreme court also said that by accepting a pardon you are admitting guilt.if so couldn’t schiff be impeached in the senate for his crime in the house.
The USSC can re-look at the past decisions and correct the error. The 2 examples that come immediately to mind are Dredd Scott and Roe v. Wade, and there may be others earlier decisions that have been reversed. Being pardoned before being charged is a load of you know what.
