This is quite remarkable. Alec Baldwin broke down in tears during court today because the trial judge dismissed the case against him.
Apparently, the prosecution received a box of live ammunition from a witness. The ammunition was from the same lot used on the set of Rust. That evidence strongly suggested the live ammunition that made its way on to the set came from the prop supplier, rather than from the film’s armorer.
The question has always been, how did live ammunition get into the gun on the set? The prosecution team hid the evidence and never told the defense team, a clear Brady violation. [Print Media Report Here] WATCH:

As much as I dislike Alec Baldwin, this judge did the right thing. The evidence was at the center of the prosecution and withholding it was a gross violation of ethical responsibility of the prosecution. The charges should have been dismissed, and they were.
Right is right, even if nobody does it. Wrong is wrong, even if everybody does it. Using corrupt lawfare tactics and hiding Brady material is wrong. The prosecution should be sanctioned.

This is not judge judy. The court is not concerned with morally right or wrong, but the law. – Which in this case, seems to have prevailed unless there is some hidden elaborate scheme.

It really astounds md the number of people commenting here that obviously have not followed the trial closely and all of the testimonies and evidence.
There is ZERO evidence this newly discovered ammo made it to the set of RUST, or even to the state of New Mexico where the film was shot. But it seems no one involved in this trial, including the judge, seems interested in investigating this very questionable allegation.
The allegation was that this previously undisclosed ammo came from Seth Kenny in AZ, who supplied all the other guns and dummy and blank ammo for the set.
This was all covered in detail at the armorer’s trial and it was found that the only live ammo that made it onto the set, was leftover ammo from the set of ‘1883’ where live rounds were on set for some reason. That ammo was also supplied by Seth Kenny but sworn witness testimony was that ONLY dummy rounds and blanks were supplied and delivered to the set of RUST from him.
The bigger story is that Alec Baldwin cheaped out for RUST (it was his production along with a few other investors) and he hired a young, inexperienced, koolaid haired, coke snorting armorer (testified to that she had given her baggie of coke to another set person to hold after the murder in case they searched her hotel room).
Baldwin seemed to pay little attention to all the red flags involving this girl during the shooting of the movie – including two previous ‘accidental’ gun discharges.
Right before Helena was shot, many of the crew walked off the set the day before, protesting these lax conditions and safety precautions on set, including Baldwins behaviour and attitude himself.
Seems this whole RUST shitshow was an accident like this waiting to happen.
This new ammo that magically showed up from a third party (who had nothing to do with the movie, btw) was allegdly attained from the young armorers father – a longtime respected armorer in the movie business.
This would be no surprise as they had already established in the armorers trial, that she herself brought that same type of ammo from her father’s home cache, as mentioned above, that was leftover from the 1883 movie set – mistakenly mixing it in with other dummie rounds.
There is so much more in the details than the average YouTube video or story on this leads one to believe. I watched several of these yesterday, and they are filled with incomplete information and gaslighting.
Again, I am amazed by the number of people who comment without knowing all the details and therefore are taking someone else’s word that this whole dismissal makes sense. It doesn’t.
Finally, how ANY of this live ammo made it to the set is completely irrelevant in Baldwin’s trial. His trial is specifically about whether he a veteran actor with years of movie set experience, was careless with his handling of a real gun on his set (and perhaps how he hired this inexperienced armorer to save money), and that THAT was – in part – the reason Helena was shot and killed.
Precisely! Even with live ammo, she would still be alive if it weren’t for Baldwin’s failure to follow proper gun safety protocol.

The reason stated at trial for the live ammo used on the set of 1883 was that someone (Kenny?) was giving some gun training. Now why they need to use live ammo for training is a mystery to me.
I watched much of the trial. The prosecutor taking the stand was most interesting, but her excuse for not entering as evidence the live ammo which was handed over was weak in the eyes of the judge, notwithstanding it never was on the “Rust” set. It had relevance to the case since it was produced in the same “batch” as the live ammo that was found.
I agree that Baldwin should be accountable to some extent since he was one of the producers. There was obvious negligence on his part that resulted in that death.
That armorer should have gotten more prison time, being she was the PRIMARY responsible party. Her father did not train her very well.
She is still a kid, especially in our delayed childhood culture. She was surrounded by powerful people that she felt that she needed to please in order to get future jobs and she has suffered the worst consequences. I hope that she studies very hard when she gets out and becomes a total harda$$.
It would have been very pleasing to everyone if she had done her job well, keeping blanks and dummies clearly in their own boxes and live rounds completely off the set, a preparation that she could have confirmed at any time. Trying to just look good is a poor substitute for actual performance. And if one can’t do a critical job for whatever reason, they should never have that job. Pretty basic stuff, I think. No excuses are valid, here, in a life or death role.
And I hope she stops using Coke.

No one should handle guns if they can’t do so responsibly, meaning with full adherence to the basic four rules and also the many more. Alec is clearly a case in point. It isn’t one of the four most emphasized rules, but checking an arm and making sure of what you are dealing with is also very basic. I wonder if the movie industry will decide that being handed a gun and being assured that it is “cold” is not a sufficient confirmation, as it proved not to be here.

Either the defense has the right to all police/prosecutions’ evidence or it does not.
That is a simple yes or no conclusion.
If I say yes, then you can say “Well, this gives the defense the opportunity to fabricate lies about the case and a murderer could walk away!” And you would be correct.
But if you say no, that evidence can indeed be hidden from the defense, I can say “Well, this is a clear violation of defendant rights under the Sixth Amendment and opens the door to kangaroo courts!” And I would be right.

All true. The central questions concerned Baldwin’s negligent handling of the pistol and possibly the poor management of firearms on the set. But when the state’s case is tainted by incompetence and also dishonesty, how far can you go in saying, “Whatever we do wrong is okay, but we sure are going to get you for the thing that you did wrong”? The state lost its moral standing to try Alec for his very obvious carelessness resulting in homicide. However it may be phrased, there is no question that Alec pointed a gun at a person, and then he manipulated it actively in a way so as to increase the chances of the hammer falling and striking a primer. Most think that involved pulling the trigger, but pointing and manipulating at the same time are sufficient violations of basic safety in any case. The prosecution simply blew their right to prosecute, when simply doing the right thing and allowing the evidence to be considered would have been so easy.

If you followed the reactions on twitter immediately after it happened you would have seen tons of antifa/portland/union psychos with roses in their bios dancing on the grave of the armorer. They got their wish, initially celebrated, then realized they needed to STFU and let everyone fight with each other about Baldwin.

Should have been dismissed WITHOUT prejudice. He should be tried again. He pulled the trigger. Anyone handling a gun has responsibility to insure it’s safe, even if you are a famous entertainer.

It was a rehearsal for filming.
He was told what to do by the person he shot, the director.
Was he told to point the gun at the director?
Was he told to cock the gun?

In this case the Judge made all the difference and did what she should have done given the evidence.

If the NM Board of Professional Responsibility wants to stop this kind of criminal behavior by prosecutors, it can start disbarring them or suspending them for a lengthy period.
