Judge Merchan has yet to release the public version of jury instructions, however he previously decided last week that the jurors do not need to agree on a predicate crime in order to fund President Trump guilty of trying to hide one.

In NY, a person can commit burglary while trespassing with the intent to commit a crime. In NY, it is NOT necessary for the prosecution to prove an intent to commit any particular crime in order to obtain a valid indictment or conviction.
The unspecified crime can be proven by the circumstances of the trespass. IOW, we know from the details of your illegal entry that you entered with the intent to commit a crime – – we just do not know what crime: larceny, assault, criminal mischief etc.
Whether this legal reality wrt burglary applies to making a false business entry with the intent to hide another “crime,” I do not know, but guess that Bragg’s theory of the case uses analogous reasoning.
If so, the jury instruction to look for would say that the intent to hide another crime can be inferred from the circumstances of making the false business entry.

But to find Trump guilty of a felony, they must identify the 2nd crime beyond the false ledger misdemeanor (expired). A defendant has the right to know what that crime is in order to defend himself.
And that is absolutely not the case here, particularly since the felony crimes seem to involve federal election laws, not state, which the State of NY has no authority over.

The prosecution’s presumption is Trump is guilty of a felony because he committed a misdemeanor. And, of course, he never committed a misdeanor to begin with since Cohen lied & submitted false bills. But the prosecution never told the jury what 2nd crime he committed, nor did they allege it in their pleadings.
A defendant must know what he’s being charged with in order to mount a defense. And, of course, the judge denied Trump from defending himself by denying his witnesses, badgering Costello & excluding other evidence.

Right now, it looks like they’re trying look at corroborating evidence of Trump’s participation in the misdemeanor by looking at Pecker’s testimony because they don’t trust Cohen’s testimony. They were also asking about the weight of his testimony to be given ala jury instructions.
But now I’m hearing we won’t know what the underlying predicate crime is if the jury votes “guilty.” And there was very little evidence on 2 of the predicate crimes given to the jury & no tax evasion evidence whatsoever.
