The Fourth Amendment to the United States Constitution says: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
Late last night, early this morning (after midnight), the United States Senate passed a FISA reauthorization bill that directly and specifically violates every tenant of the 4th Amendment.
The Senate voted to authorize warrantless federal government searches of every American’s private papers, effects, emails, electronic data records, cell phone calls, contact lists, text messages, buying habits, purchases, banking records, social media posts, direct messages, private communications and every keystroke of every electronic device in your life. All of it continues to be subject to the capture, review and surveillance of an unelected opaque law enforcement mechanism, and Congress supports it.
The issue is magnified, because the Supreme Court has never ruled on the constitutionality of the FISA-702 data collection system, because the Supreme Court also says no American has standing to challenge the federal government violation of their 4th Amendment right to privacy. It’s all infuriating… It’s all FUBAR!
Oh, and if you are reading this… you’re likely on the list.
Last night, Senator Dick Durbin (D-IL) teamed up with Sen. Kevin Cramer (R-ND) and added an amendment that would have required the government to get a warrant before reviewing any communications incidentally collected from Americans. The amendment was the last effort priority for a smidgen of hope; the IC railed against it, saying it would stop them from acting on critical “national security” information in real time. It failed by a vote of 42 to 50.
Another Democrat Senator, Ron Wyden (Oregon), a senior member of the Senate Select Committee on Intelligence, vowed and pledged that FISA-702 would never be renewed by any measure that required his signature. “I’ll do everything in my power to stop it,” he previously said. “Searches have gone after American protesters, political campaign donors, even people who simply reported crimes to the FBI. The abuses have been extensive and well documented,” Wyden argued to colleagues. Wyden’s effort to strike the language failed by a vote of 34 to 58.
“Egregious Fourth Amendment violations against U.S. citizens will increase dramatically if this bill is passed into law,” Utah Republican Senator Mike Lee warned. Senator Rand Paul (R-KY) offered an amendment to block DHS, FBI, DOJ, IRS, and various ancillary intelligence, law enforcement, national parks and government agencies from buying Americans’ electronic NSA data from third parties and federal contractors. Paul’s amendment failed by a vote of 31 to 61.
The House and Senate bill does include provisions that would force the Intelligence Community to notify political leadership in Congress about 702 database searches involving lawmakers, but you, Comrade Citizen, are not allowed to know about the searches done on you. You, comrade prole, must improve your elite status if you wish to participate in any benefit from the shredded and reconfigured 4th Amendment, now reserved for the entitled class.
As noted by The Hill, Senator Mike “Lee offered an amendment to require the Foreign Intelligence Surveillance Court to appoint an outside lawyer to argue for the rights of a U.S. person the government wants to surveil secretly. It would have also required government employees appearing before the FISA court to disclose factual evidence that might call into question the accuracy of their statements. It also failed even though it had previously passed the Senate with 77 votes in 2020.”

I was thinking that, for those voting for this that live (State) in county with a Sheriff of Constitutional worth, the Sheriff could arrest them when visiting said county.
A law they could be charged with would have to be on the books. The oath required by the Constitution says “I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”
I don’t know if there is any mechanism for the People to charge them with treason and the State or locality to arrest and prosecute them for treason….or if there is anything in the Constitution that denies the ability of the People and their State or local law enforcement agencies to do so.

No, Treason is NOT the appropriate charge for failing to uphold the Constitution, and specifically the Bill of Rights.
If you WERE going to try to pursue legal charges, a civil rights violation would, I submit, be the coarse to follow.
However, you would run smack into a roadblock, a device the tyrannists have constructed to use the Constitution to violate the Constitution.
The POTUS, as the head of the Executive, is CiC, and so he (and they say, by ectension the Ececutive branch) have PLENARY, Constitutional authority over National Security.
His authority (and they say by extention or DERIVATIVE authority various Depts of the Executive) can NOT be questioned or challenged, either by the Courts or Congress.
After all, if the POTUS deems it necessary to bomb Syria, and so orders, we can’t have someone running to Court, nor having Congress pass a law saying he can’t.
The Courts have therefore deferred any challenge to the Executive (Fan Belt Indpectors, etc.) whenever they make a claim their actions are motivated by “National Security”.
And so, that leaves the only potential “check” on the Executive overreach, as being the Legislative and we have just seen how THAT check is neutralised.

I must have misread an earlier vote on this from Vance (he voted nay on a cloture vote) — not sure why he was listed as Not Voting on the final vote, but maybe because the vote was going to be so lopsided for it. But yes – Brown did vote against it for the right reasons. He is liberal on a lot of things, but every once in awhile, on things like tariffs, e.g., he and Bernie Sanders actually side with President Trump. He’s a quirky one. But Vance has been pretty rock solid MAGA on most things – I am grateful for him.
Interesting – my two Ohio senators, the liberal Sherrod Brown (who is up for re-election against Bernie Moreno, but occasionally joins with Bernie Sanders in being right once in awhile), and JD Vance (who I love as my senator) both voted against it. There is so much packed into the above scripture. I go back over my lifetime! I own all my thoughts and actions that have brought me to right now. So self focused, I approved, worshipped idols (success, independence, my personal freedoms etc.) didn’t question, didn’t run things against the only truth there is (God’s Word).
It’s been a process to think of the things I want to tell God I am sorry for (He knows but He is worth it for me to humble myself and tell Him how sorry I am.) I know I am forgiven. I just need to come down a buncha pegs.

There were unconstitutional changes made to the election processes in 2020. Many are therefore not constitutionally elected officials. If many of them were not duly elected, then it would seem they have no authority to legislate.
“Duly elected” and “the consent of the governed” appear to be missing here.
So, to ask again, under what authority do those in DC currently operate?
DC is bankrupt, both morally and otherwise. We can see the “morally” part. Maybe we need to look closer at the “otherwise” part.

I think Americans are currently in the stage of “disposed to suffer, while evils are sufferable”. But in some places your question is becoming very relevant. In Colorado, the legislature is trying again to ban guns (indirectly by banning selling them). It is blatantly unconstitutional, and flagrantly violating SCOTUS rulings, but the state government’s hope seems to be that people will comply while the lawsuits go (again!) through the courts. I don’t get the sense people are planning to comply. And if not, then we have a tacit agreement that Colorado authorities in fact have no authority due to their violation of the laws of the land.
Should be interesting if they pass these “laws”. And if not, then that right there says that the people of Colorado will not let even the completely blue government do whatever they want. New Mexico also faced down a gun grab in Albuquerque last year.

Both Cotton and Boozman are my senators. I have voted in favor of their primary challengers (IF they have one) for the last 2 cycles. I live in NWA, very red, MAGA county. However, they won their primaries…Boozman was endorsed by Trump. Trump just needs to stop endorsing anyone. Period!

There’s a nurse where my wife works at that has gone missing. She’s been missing for over 3 weeks now. The police have looked thru her phone location history to trace where she’s been prior to going missing.
The J6er’s phone location was used against them.
When I have a conversation with someone that has a smartphone, I get adds on my home PC for products that come up during our conversation.
We are under warrantless search all the time. The companies that are collecting the data are sanctioned by the US government to do so.
I do not own a smart phone, I do not trust my PC and when not in use it is powered off.

It was March 2003. That month, interrogators would waterboard Mr. Mohammed 183 times at a secret overseas C.I.A. prison in the mistaken belief, Dr. Mitchell said, that a nuclear attack in the United States was imminent. But Mr. Mohammed still was not saying what his captors wanted to hear.
“We walled him,” Dr. Mitchell said on Monday, explaining that he and his colleagues had rammed their prisoner backward into a wall, to punish him because they feared he was talking about 9/11 to distract them from another looming crime.
The idea that Mr. Mohammed was punished for talking about that topic in his first month of U.S. detention is new to the proceedings. Dr. Mitchell has been testifying in pretrial hearings in the death penalty cases at Guantánamo Bay since 2020 and never mentioned it before.
