Three judges from the Washington DC Circuit Court of Appeals have denied the immunity request from President Trump.
In a rather stark decision reached by the panel [SEE Ruling Here] “We have balanced former President Trump’s asserted interests in executive immunity against the vital public interests that favor allowing this prosecution to proceed,” the court wrote in its ruling Tuesday. “We conclude that the interest in criminal accountability, held by both the public and the Executive Branch, outweighs the potential risks of chilling Presidential action and permitting vexatious litigation.”
WASHINGTON – The judges put their decision on hold only until Monday to allow Trump to ask the Supreme Court to take up the immunity fight on an emergency basis. If he does so, the decision won’t take effect until the high court acts on his request, the appeals panel decreed. (read more)

Three Republicans — Colorado Rep. Ken Buck, Wisconsin Rep. Mike Gallagher and California Rep. Tom McClintock — joined the Democrats in voting against the resolution to impeach Department of Homeland Security Secretary Alejandro Mayorkas.
I think someone in another thread said Buck isn’t running for re-election, so that explains why he’s a puss for this vote. Not sure yet about the other two.

Should they (can they) file both simultaneously and request that the Supreme Court direct the Appeals Court to hold the en banc hearing as the SC would like to see all possible appeals avenues exhausted before they consider it.
En banc might buy him a little more time. En banc is granted when a majority of the active judges (none of the judges on senior status) vote for the hearing. A majority vote to hear the case doesn’t mean a majority want to reverse the panel, just that they think the issues merit consideration by more than a three-judge panel.
I think that makes logical sense but apparently the court said that the only stay would occur if a Supreme Court appeal is filed by Monday.
A request for en banc, which could be rejected, would not create a stay. Full speed ahead if he goes the en banc route.

The interesting thing here is that Biden hasn’t intervened to protect the prerogatives of the Presidency. He did this at least once earlier, in the National Archives litigation, where he waived President Trump’s privilege to allow his records to be subpoenaed. Usually, Presidents at least consider that it’s bigger than the occupant or former occupant of the office and come down on the side of protecting the office for all future Presidents. Retired Magistrate here: We can all save ourselves some anguish when we realize that nothing which comes out of the D.C. Courts will be in favor of President Trump. These are not judges; they are emotional politicians.
The Supreme Court should rule in President Trump’s favor with regard to immunity; however, so many judges have been compromised that I just don’t know.
I do remember that when Ruth Bader Ginsberg was on the bench she said something to the effect that the Court shouldn’t just look at the Constitution, it should look at what other countries have done. Of course, that statement went directly against the oath she took to uphold the Constitution, but apparently that doesn’t matter much anymore.
If President Trump wins and returns to the White House it will be because GOD wants him in the White House. Continue to pray that GOD will give us grace and return President Trump to his post as Commander in Chief.

The Constitutional Republic squarely rest on the Supreme Court, if they don’t rule in favor of President Trump in the Colorado ballot case and the Presidential immunity case, it’s over.

In other words, Jack Smith wanted to bypass the normal procedures that govern appeals.
On December 22, 2023, the Supreme Court denied Jack Smith’s petition.
In other words, the Supreme Court adhered to the normal procedures in the face of Jack Smith’s attempt to bypass them.
The Supreme Court should do the same in the face of the D.C. Circuit’s decision.
Otherwise, it is political.

This 3-judge decision is a Writ of Attainder. It only applies to President Trump specifically. Biden and all future presidents will now just issue themselves and their administration a full blanket pardon on their last day in office for all actions taken during their terms. It won’t apply to them. It also will never be applied to Obama or Clinton (or Carter if he is still breathing) because Dems will never attack their own and GOP is too cowardly to attack the Dems. Bush will get a pass because he is enough of a globalist and war-hawk to be protected by the Swamp. Only Trump would ever be targeted this way.
Can’t federally pardon State crimes.
A sitting President cannot commit “a State crime.”

Are you aware that there is an entire area of law devoted to the legal niceties of sovereign immunity, immunity, and qualified immunity? Reams, and reams, and reams of cases, not to mention some statutes, teasing out when or when an official is or isn’t liable for an act committed while holding office?
For example, use of excessive force by a police officer. In general, a cop has immunity for official actions, but actions that are outside the scope of official duties do not receive immunity, while in certain instances qualified immunity is an affirmative defense.
The only thing new here is that this is the first time former President has been charged with a crime.
There is an available body of law on which to draw.
It doesn’t have to be all black and white. “Free reign to rape babies” versus “OMG no one will ever run for office again” does not accurately describe the range of options.
It is possible to rule that a President has complete immunity for all official Acts taken while faithfully executing the Laws of the United States (which is a defense President Trump has in fact stated here in this case) without extending that immunity to the actual breach of the Laws of the United States (such as murdering US citizens who are non-combatants abroad).

Biden is not faithfully executing immigration law. His decision has resulted in plenty of murders and other crimes that negatively affected law-abiding citizens.
Starting today, a federal pardon would not protect a President from being an accessory to these types of crimes.

In other words, the court cannot change him to “Citizen Trump” for the purposes of this prosecution of things he did while still President.

If this cowardly 3-judge panel actually believed that President Trump was not entitled to absolute immunity, then they would have just written the decision and left it at that. Then, it would be incumbent upon President Trump to seek a stay of the order from the 3-judge panel, pending his motion for en banc hearing.
The lawfare “jurists” on the 3-judge panel should not be able to dictate the terms of subsequent appeals or petitions for writs. I hope that either the DC Circuit en banc or SCOTUS slaps the 3-judge panel, hard, for using such gimmicks.

Today’s decision by the Democrat-controlled DC Circuit Court of Appeals is as predictable as it is wrong.
Members of Congress are immune, both civilly and criminally, for their officials acts.
So are federal judges.
Why wouldn’t the President of the United States–any President?
Four DC federal judges did not even establish at a baseline level that the President of the United States cannot be thrown in prison by his successor based upon his official acts.
They ignored the Constitution’s separation of powers.
Thus, the Supreme Court must take and decide this case.
This case is much bigger than Trump.
This precedent is very dangerous and highly destructive to the presidency–thus, our Constitution and country.
This means the Trump 47 Justice Department can prosecute Obama–along with his aides like U.S. Circuit Judge David Barron, Obama’s legal advisor at the time–for capital murder for their extrajudicial drone-striking of American citizens (including a minor).
This also means the Trump 47 Justice Department can prosecute Biden for his illegal release of dangerous migrants into the United States and the natural and probable crimes they commit.
Will the Supreme Court do its job?

I tried to copy the paragraph from their decision that dealt with this specifically but it wouldn’t let me copy and paste.
On page 25 of the decision they claim that PDJT’s actions fell outside of his official duties and violated existing criminal statute.
They appear to be saying that any act that violates criminal law is not an “official” act.

This is nothing but political theater, and judicial abuse of process. This Court perfectly well knows what the SCOTUS has already ruled concerning Article 2 and the one-person Branch of Government created thereby.
Specifically: that he is tasked to “take Care that the Laws be faithfully executed.” In case you have forgotten, Election Fraud is a Federal crime. None more serious than when a Presidential election has been stolen, thereby causing 335 million people to become Plaintiffs. The President must speak and act, and he alone chooses how to do so. He cannot commit any offense by “being the President and acting the part.”
Every NeoCon Federalist Society character who talks about “the rule of law” is talking about this. Nothing else. Just this.
The first punt will be a request for the whole DC circuit to hear the appeal. Then SCOTUS. Then if both appeals fail, substantial time for pre-trial proceedings and discovery. This would likely push the case to around September..

I am not sure that this is bad. They were never gonna get a conviction in the Senate. The vote was 215-215 with 1 Scalise not present. And Al Green barely made the vote, as he was absent prior to that.
A bit embarassing, but they would have looked like worse fools if the Senate wouldn’t get any d votes. Better to impeach closer to elections to expose the vulnerable D Senators who wouldn’t vote against the Cuban now.
