None of the justices provided any explanation for their vote.
The court majority sided with the Biden administration policy of removing razor wire to permit illegal alien entry without impediment. Justices Samuel Alito, Neil Gorsuch, Brett Kavanaugh and Clarence Thomas voted with Texas, in favor of national border integrity.
WASHINGTON (AP) — A divided Supreme Court on Monday allowed Border Patrol agents to cut razor wire that Texas installed on the U.S.-Mexico border, while a lawsuit over the wire continues.
The justices, by a 5-4 vote, granted an emergency appeal from the Biden administration, which has been in an escalating standoff at the border with Texas and had objected to an appellate ruling in favor of the state.
The concertina wire along roughly 30 miles (48 kilometers) of the Rio Grande near the border city of Eagle Pass is part of Texas Gov. Greg Abbott’s broader fight with the administration over immigration enforcement. (read more)
God, I pray for stability right now, because this is infuriating.
The irony and hypocrisy of the Supreme Court having a security perimeter for their own security yet dismissing the establishment of a security perimeter for the citizens of the country is not lost on me.

The Constitution used the term, “invasion,” without ever defining it. But, this is exactly what “invasion” means. You could introduce an Army into this nation and deploy them anywhere you like, as long as they weren’t in uniform. Sun Tzu would be laughing.
If this decision were to be honored by the People, which it should not be, then effectively there is no immigration law at all, no need for passports, no right to “verify” anyone at all.
This would also mean that “human trafficking” could proceed without restraint.
So: Texas and the other States should calmly reply as Jackson not-so-calmly did. And five Justices should be impeached.
Will Texas back down? I expect they will.
Again Tomas Jefferson quote comes to mind ….in other words ….we must not be constrained by laws that are preventing us from saving our very existence as a country. Save the country first, then go back to the rule of law.

This is what I am thinking. What if Gov. Abbott keeps the border patrol away from the wire and won’t let them cut it. What if Gov. Abbott lines the border 3 or 4 deep with his guard troops. What if those troops are armed with lots of rubber bullets and they are authorized to fire at will at anyone who attempts to breech the barrier or remove the barrier?
The Supremes may have made their ruling on the basis that enforcing the borders is a federal responsibility so it may technically be a justifiable ruling no matter how wrong it is but, how could the feds actually stop Abbott from enforcing the Texas border? If Abbott is really serious and he does have a spine, this could really get interesting.
The Defense of the People, against Invasion and otherwise, is not “only” a Federal responsibility. And the obvious reason why has just been demonstrated here.
What if the Federal government, instead of enforcing immigration law and otherwise defending the People, for whatever reason decided to do the opposite? Here we literally have five(!) people telling 335+ million(!!) other people both that they will not be defended, and that they are “not allowed” to defend themselves. This is untenable, and unconstitutional.
The “emergency” ruling should be ignored. States, cities, counties, everyone, has a fundamental duty of Defense.
The Federals are conspiring to distribute an Invading Army, albeit “not in uniform,” throughout the entire territory of the country. And they pretend not to know what they are doing and why. But: “Texas does.”
Congress enacted immigration laws. The Executive and/or Judicial Branches cannot rewrite them nor supersede them. The Executive, in particular, must “take Care that the Laws be faithfully executed.” Not to write them for himself.
Civil War, and a crap ton of States will side with Texas and protect ourselves from the feds.
AG Ken Paxton will not back down, nor his supporters.
Unfortunately, Abbot is not likely to be a supporter in more aggressive moves.

There will be a requirement for proper identification. But that requirement will only be for United States citizens. Our laws only restrict us, because we abide by them. The millions who are here illegally have no law to which they must abide.
Boils down to Biden breaking the immigration laws……So the SCOTUS is stating that TX must comply with his law breaking.
The entirety of DC is corrupt and here is another example. Imagine coming from a place of corruption and knowing you need only get to one person. One! This one person trumps the ninth and tenth amendment. How does any of that make sense? If I am Texas I announce “Chief Roberts has made his decision, now let’s see him enforce it”.
This will add fuel to the fire of the TEXIT movement.

As the video explains, the NG were still letting illegals come in… they were just doing so by directing them to a particular “legal point of entry” (hole in fence). The border area is only 2 1/2 miles long.
This was so they could screen them to ensure they were not on some list they have of bad guys.
Which begs the question, why does the fed gov want certain people to slip through undedected?

isn’t exactly true. The judgement really doesn’t speak to whether Texas is permitted to protect itself or not – but rather, that Texas cannot keep DHS from NOT preventing illegal border crossings. I know that may sound like a distinction without a difference – but… this is the world we’re currently living in. :-/
Ken Paxton’s lawsuit at the trial level will continue. At the trial level they’ll establish the CBP & new hirees are being compelled to greet & process illegals by the President & DHS & catch & release, etc.

I know I’m late to this thread, but I think we should rethink the replacement theory as the reason the Biden Administration refuses to enforce federal immigration law. Given Homeland Security, the NSA, the DOJ and the FBI are all about maintaining their authority to electronically surveil ordinary Americans, the number of illegals entering the country, including from states that sponsor terrorism, constitutes a perpetual justification for the surveillance state to which we find ourselves subject.
Imagine if we ever have a corrupt president who was making so much money from hidden payments from an enemy country that he just ignored the oaths he took to protect the country and allowed the country to be attacked and damaged so badly that there was no possibility of our being able to fight back. For instance, he sold the nuclear weapons launch codes, because the words nuclear weapons were not in the Constitution. Now, we have absolute proof that the SCOTUS would sit back and ignore the danger, as long as they were getting their cut. We owe Obama so much.
SCOTUS is made up of too many unserious people. They voted to maintain a status quo for rogue infested institutions that will be worthless to patriotic citizens when the invasion is complete, at which time those institutions will be fully turned against us.

It is annoying. The argument might be that the Texas National Guard cannot keep the Federal border patrol from the area, likely due to the Supremacy Clause. However, can the Texas National Guard keep the Federal Border Patrol from breaking federal (and now state) law regarding illegal immigration?
