The complaint is moot before the court. But hey, it’s Lawfare… and we all know Lawfare is created for public media consumption, so that takes us directly to the biggest point.

Yes, that’s correct. As long as President Trump appeals the decision to the Supreme Court, the appeals court stays their own ruling – essentially indefinitely. The Colorado primary ballots printed, and the primary election will be over, before the Supreme Court puts this on their docket.
In addition to the virtual guarantee the high court will overrule this political nonsense, SCOTUS can make the entire issue moot before them by following their own normal schedule for submissions, arguments, deliberation and opinions delivered by the court.
The Colorado appellate court knows this, that’s why they put this self-stay into their 4-3 ruling. It’s a politically correct way of giving the optics of telling their tribe, ‘hey we’re with you,’ without the ramifications of the political backlash. In other words, psychological lawfare stuff – intended for media consumption.
Making the issue that much better for Donald Trump, the efforts of the Prescott-Bush clan (look it up – they live in CO) will backfire bigly. The public backlash against a judicial ruling that interferes with the right of the citizens to determine their own election candidates plays perfectly into the sunlight operation against the Lawfare left.
This backlash will be epic, albeit hidden by MSNBC and the rest of the insufferable media. Why? Because it doesn’t fit the Lawfare narrative.

Today’s decision is the latest election interference tactic to silence political opponents and swing the election for whatever puppet the Democrats put up this time by depriving Americans of the right to vote for their candidate of choice.
The 14th Amendment was part of the “Reconstruction Amendments” that were ratified following the Civil War. It was passed to prohibit former Confederate military and political leaders from holding high federal or state office. These men had clearly taken part in a rebellion against the United States: the Civil War. That makes it all the more absurd that a left-wing group in Colorado is asking a federal court to disqualify the 45th President on the same grounds, equating his speech to rebellion against the United States.
And there’s another legal problem: Trump is not a former “officer of the United States,” as that term is used in the Constitution, meaning Section 3 does not apply. As the Supreme Court explained in Free Enterprise Fund v. Public Company Accounting Oversight Board (2010), an “officer of the United States” is someone appointed by the President to aid him in his duties under Article II, Section 2. The term does not apply to elected officials, and certainly not to the President himself.
The Framers of the 14th Amendment would be appalled to see this narrow provision—intended to bar former U.S. officials who switched to the Confederacy from seeking public office—being weaponized by a sitting President and his political allies to prevent a former President from seeking reelection. Our country is becoming unrecognizable to our Founding Fathers. (read more)

The Colorado GOP will convert to a “caucus” primary vote system and withdraw from the primary ballot if Trump is removed. As a result of this purely political move by the liberal judges, I predict Trump has a very good chance of winning CO in November.
The name of the law firm Ballard Spahr in the list of attorneys for the amici curiae sticks out to me. It’s a large law firm with several offices around the country now, but the original office is the one in Washington, D.C., and one of the partners there is Joseph Fanone.
He is apparently the father of Michael Fanone, who was the D.C. Metro police officer who was tased on January 6th and then honored at the following Super Bowl. Michael Fanone also received a Congressional Gold Medal and a Presidential Citizen’s Medal, was hired by CNN, testified to the January 6th Committee, and he has a book out.

Natural Born Citizen is the requirement for a US President, the only position for which it is required.
Naturalization takes a minimum of five years, so there’s no chance his parents had become US Citizens in the two before his birth, rendering him a non-natural born citizen.
Green Cards do not a citizen make, nor do holders thereof create natural born citizens.
He was born in the USA, he is a full citizen and always has been.
Citizen and Natural Born Citizen are not the same.
The distinction is essential and the requirement in the Constitution is clear.

In the unlikely event that there are more then three SCOTUS judges who take the case, there are no immediate consequences. On the other hand, the exclusion will affect many other states, and all this in the interests of those who have carried out the state intervention through four Indictments with various criminal charges. like left-wing legal group “Just Security” with Andrew Weissman (Mueller probe) or Michael Dreben (Mueller probe).

I have a question for the lawyers out there … What is Jena Griswold actually saying here about what she will (or won’t) be doing after January 5th 2024 in regards to her official decision as Colorado SOS to include, or not to include, Donald Trump’s name on the ballot?
Page 9 of the court ruling states that if President Trump asks for
review and SCOTUS doesn;t rule either way by Jan 4th then his name
must remain on the ballot pending SCOTUS ruling CO has some rule
that names must be confirmed by Jan 5th so if no ruling he remains on

I read her statement as a bone to her fellow radicals that, “hey, I might just rule myself on whether his ballots are valid depending on a court ruling”.
I have said it before and will say it again. CO is lost as long as they have permanent mail-in balloting. It has been trending to the left for some time, mail in balloting are the nails in the coffin, and Griswold is the hammer.
I wish it were different, but I can’t see the COGOP acting decisively enough to change anything.

There are three MAJOR fraud magnets which you can’t win against: mail-in balloting, dirty voter rolls, and worst, the fraud-in-a-microsecond election machines.
But many in Colorado are fully awake to these problems and working on them, even in the state that’s the test kitchen of election fraud!
We don’t have time to dismantle the fraud piecemeal – we have to get rid of it all at once by demanding transparent elections: in person, on paper, hand counted at the local level, one day. Argentina and Holland went from machines to paper ballots to conservative winners in just a few months. We can too – counties are already required to have disaster preparedness plans and preparations including if there is no electricity (i.e. paper ballots, hand counting.)
There are additional areas; AS they used Bush v Gore as the manufactured Crises they could “not let go to waste” to justify Federal investment in State election processes, and so introduce the machines, they had to do a complete re-write of ELECTION LAWS, and many insidious, not obvious at the time changes were inserted into the law, such as special requirements of “standing” and extremely short time limits.
I am all for all efforts to move us towards transparent, fair elections with One day, hand counted, paper ballots w/voter I.D.
However, we are NOT going to get that, Nationwide by 2024 election.
Well,…actually I can think of ONE way that mail in ballots COULD be eliminated, ….Nationwide I THINK.

What if a complainant were to “assert” in court that Joe Biden is cognitively impaired and must therefore be removed from a state’s ballot in accordance with the 25th Amendment?

Decisions like this make me wonder what is real and what is not in our national conversation. Is everything propaganda, a trick, a manipulation of a trusting public? How can judges decide in this way, make a joke?
Because we have lost our purpose. We are no longer a serious people. Those who choose to lead us down the path are certainly ruthless and evil, but they are not really all powerful if we know what is up. We have no future if these people keep getting their way, no set course to agree upon.
If we elect Trump yet again, it would seem chaos would be next in their playbook but to me it is chaos already.

I think there may be more to the CO court trickery than that page 9 stuff.
Deep down the majority in that decision hope that the SCOTUS does nothing, Trump’s name stays on the ballot, and the primary takes place.
Then a new CO lawsuit after the March primary is filed to keep Trump off the general election ballot. The court will make an immediate ruling that is virtually the same as their initial ruling, with the objective to keep this issue before the public as we head toward the November general election.
Hopefully the SCOTUS will see this ploy and make a ruling soon that takes the 14th Amendment issue away from the Dems for good.
This is no laughing matter. It is yet more evidence that Leftism is the death of law, justice and jurisprudence, and the beginning of Gulags and death camps. The idea that Trump’s January 6th speech at the mall was an “insurrection” or caused an insurrection is preposterous, but they don’t care; Leftism trumps common sense, reason, and sanity. All that matters to those four justices is that their side wins, and they will destroy every law in America to make that happen.
I hope it is overturned, but I would not assume it will be; Chief Justice Roberts is a never-Trumper, as well as very weak, spineless, pathetic excuse for a human being, and he has inordinate influence over Kavanaugh and Barrett. (Barrett is certainly a better human being than most on the SCOTUS, but she is a woman and women tend to be submissive.) This is not a slam dunk in the SCOTUS. Not at all. (Has anyone noticed that the SCOTUS stayed the censorship case [Missouri & Louisiana v. Biden] indefinitely, which means that the Deep State is still free to coordinate with big tech to censor speech?)
The fact that the supreme courts in the liberal states are throwing out law and common sense to get Trump is no laughing matter, and it bodes very ill for America.

In the lower court, Judge Sarah Wallace ruled that PDJT did engage in insurrection but did not disqualify him from the ballot because it was not clear to her than the 14th Amendment was applicable.
The CO Supreme Court just accepted her “insurrection” ruling and cleared up her reluctancy to apply the 14th Amendment. One group of Dems upholding another Dem.

Overall, I think the states that fail to enforce fair election practices (ballot validity checks, names on the ballot, uniform definition of phrase ‘popular vote’) should be viewed by other states as a threat to the Union.
And the other states whose elected representatives and courts agree to work with the Union’s common framework on the national matters, should demand these outliers like Colorado, and others to be expelled from the Union.
I get that everyday voter in Colorado may not feel ‘responsible’ for the decisions of the executive or judiciary branches in their states — but they are responsible. And the consequence of electing judges that dress up their political believes as ‘legal decisions’, should be very visible to the voters.

Bush . . . then the recount . . . I think I still have the box out in the garage of all the “Newsweek” and “Time” magazines through those six weeks. A promise to make lemon squares for a neighbor when the recount was finally called for George W.; two batches of lemon squares, woo-hoo – and one of Grandmother’s afghans thrown in for good measure. We were so happy.
But then George W. was silent all through the Obama era – okay, if the point was to stand aside and let the next guy do the job – but then why was it all right for Laura to pen an Op-Ed published in the WSJ against President Trump regarding his border policy?
And then crickets when Afghanistan was abandoned, and the Taliban left with all that equipment to wreak more suffering on their people.
The Bush Family should really give the country and the people in it time to heal! Let them retreat for a few generations and give us all a rest.
