Consider this statement a gag order forbidding all parties from posting, emailing or speaking publicly about any of my staff,” Engoron said. “Failure to abide by this order will result in serious sanctions.”

In other words, it’s the equivalent of having a small town sheriff who determines who broke the law, and then acts as judge and jury.
Per the 35-page ruling in which the judge summarized the case from its inception, AG James both investigated the facts and determined on her own authority that these facts indicated violations of law, and that under Executive Law in NY state, that fact ALONE was sufficient for the judge to render summary judgement, thus precluding the need for further evidentiary hearings to prove the validity of these specious charges or to allow cross-examination of witnesses and or further evidence. In other words, under Executive law, Letticia James fulfills a dual role, that of sheriff and judge. Hence, summary judgement was rendered ordering the liquidation of assets and loss of business licenses strictly on the basis of James’ investigation and her own determination. WHAT GOOD IS OUR FEDERAL CONSTITUTION WHEN LAWS SUCH AS THIS EXIST?
These sham Executive Law statutes do not in any way comply with US Constitutional requirements and should be struck down. And that is the result that I hope is attained if this case needs to be appealed to the Supreme Court.

Q: Can a CIVIL case judgement be appealed at the Supreme COurt?
As I understand it, it can’t be appealed in Federal court (including SCOTUS) because it’s entirely a matter of state law; but it CAN be appealed in the state appeals court and state supreme court (or whatever they choose to call the equivalent in that state).
(… unless they can find a federal constitutional issue or something, maybe, I’m not even american let alone a lawyer.)
Every judge in NY State is like this partisan lunatic. Appeals will be fruitless. It’s a totalitarian state and this has all been planned for a long time to railroad Trump and confiscate his property.

This is not a criminal trial. No jail time can be attached on the judgment of the case itself unless he is hit with a contempt charge on the gag order before proceedings are over and the time is very limited, if even feasible due to his status as a former President. The threat of jail time seems like bluster for the headlines with this particular case.
Other mistaken assumptions a lot of Treepers are making (some trivia but with meaning are) in their understanding of the legal system are:
1. The AG is acting as a Plantiff, not a prosecutor which is the appropriate title in a criminal case, as this is a civil hearing;
2. There is no such thing as a ‘conviction’ in this type case. Convictions are for criminal trials. There can only be a judgment or ruling in civil type cases.
3. Upon study today, it appears to me that the way the NY judge and AG were able to avert granting a right to a jury was to proceed with this case as a violation of Consumer Protection laws in NY that are apparently treated akin to something like administrative law, where only a judge or panel makes determinations.
(This was a deviously slick legal maneuver and was probably thought up by someone smarter that the AG or judge. )
For edification for other Treepers regarding jury trials:
Criminal – most, if not all, use a unanimous decision to convict;
Civil – most states use a “preponderance of evidence” to determine judgment. Jury is usually an overwhelming majority (in my former state 9 out of 12 jurors)
Administrative – varies but usually uses ‘clear and convincing’ or something close to that as a standard to make a ruling. Judge or panel have unilateral decision making authority, but adverse rulings can be appealed to the next higher court of jurisdiction.
In other words, he could lose, but appeal up and at some point, probably win or should win, but they are eating up his time and money doing this. Classic LAWFARE!
I’m sure Marcia or another licensed lawyer could clean up any of my shortcomings here, but this info should be real, real close to help everyone understand legal parameters within the system.

The video of the judge presiding over this sham speaking to law students, I assume, is quite disturbing in so many ways. But the best of his statements came when he was discussing the subject of a jury arriving at a wrong verdict. He started to say “Oh my God” but he stopped before God could come out of his mouth to be replaced by “for heaven’s sake”. I guess he didn’t want to get cancelled by the students for even mentioning the name of God. Typical leftist commie who hit the jackpot in his ability to judge others who don’t agree with him. What a loser!

For the second time in a week, a left-wing activist has been murdered in a major US city, where soft-on-crime Democrat policies have resulted in record crime.
On Monday, social justice advocate Ryan Carson was stabbed in the Crown Heights neighborhood of New York City.
According to police, Carson was walking with his girlfriend after a wedding when a suspect approached and asked “What are you looking at?” before stabbing Carson in the chest several times. The victim, 32, was pronounced dead at Kings County Hospital.
