Apparently, the Florida takeover of the Walt Disney Co. Reedy Creek special development zone has run into a snag. As normally happens in such events, within the battle of wits the government will always lose; that’s ultimately why they need guns.
Days before the five DeSantis appointees showed up to take control of Walt Disney World zoning board in Orange County, the former board held a public hearing to codify pre-existing rules and covenants extending for “21 years after the death of the last survivor of the descendants of King Charles III, king of England living as of the date of the declaration.” Essentially, the new board is moot, except for deciding on roadways and bridges.
As a result, a long and protracted legal battle is now anticipated, which will likely cost Florida taxpayers millions in lawyer fees as the appointees of the board try and challenge the construct put into place prior to their arrival. Either that, or the board will be reduced to a weekly meeting for coffee and donuts as they discuss things of minor relevance to the district.
FLORIDA – […] Ahead of an expected state takeover, the Walt Disney Co. quietly pushed through the pact and restrictive covenants that would tie the hands of future board members for decades, according to a legal presentation by the district’s lawyers on Wednesday.
The Central Florida Tourism Oversight District’s new Board of Supervisors voted to bring in outside legal firepower to examine the agreement, including a conservative Washington, D.C., law firm that has defended several of DeSantis’ culture war priorities.
“We’re going to have to deal with it and correct it,” board member Brian Aungst Jr. said. “It’s a subversion of the will of the voters and the Legislature and the governor. It completely circumvents the authority of this board to govern.”
Disney defended its actions.
“All agreements signed between Disney and the district were appropriate and were discussed and approved in open, noticed public forums in compliance with Florida’s Government in the Sunshine law,” an unsigned company statement read. (read more)

It’s a fair point that people are making that maybe DeSantis planned to have Disney do this all along. But I suspect it came up afterwards as a stalling tactic by Disney’s lawyers. They worked the system using the rules of how those districts are managed by a board of directors through restrictive covenants (like an HOA). I suspect FL will try to dissolve the district or announce a “reorganization” that merges this district with a nearby one which would nullify the covenants.
If Disney is just a 3rd party that attends these meetings, it’s unlikely that the board had authority to cede its inherent powers to a 3rd party anyway. The FL “special tax districts” are GOVERNMENTAL functions. So it’s likely the prior board’s actions to revise the covenants can be undone by the new board. You can’t turn a government tax function over to Disney any more than you can turn control of a military aircraft carrier over to Carnival Cruise Lines.

It appears to me to be a deliberate, mocking reference to a flagrant violation of the Rule Against Perpetuities. It seems to me the lawyer who wrote the agreement was assigned to write a contract he despised and thought would never be read by the people signing it (like Congress with legislation) nor upheld in court, and added a clause in it to make sure the court had an easy job in nullifying the contract.
Likely the attorney drafting it worked for the old board and wants to work for the replacement, and knew there would be no repercussions.

I’m not sure that he has really done much for ordinary Florida citizens, other than a really good PR campaign to focus on himself. The FL electricity rates are projected to rise 40-50% in June.
Supposedly he has spent so far $2.8 million on legal fees due to his “anti-woke” agenda and those are quite likely to rise if he fights this. All while there are thousands of people who have yet to receive anything from insurance companies for damage from Hurricane Ian.
Rhonda has not addressed the problem in the FL insurance market, which essentially allows the lawyers to run roughshod over the insurance companies, which results in a 25K roof claim turning into a 100K roof claim. No wonder the premiums are skyrocketing and the carriers are running for the exits. But it appears Rhonda will do nothing to rein in the legal lobby. Meanwhile, he spends his time on his campaign(book tour), and drops in occassionally to pass out checks to a voter group.
And how are you feeling about your electric bill? If you look closely at what DeSwampis has actually accomplished (with the full support of a Republican legislature) he’s not all that great. This reminds me of something I’ve been telling my neighbors about a developer they’re fighting to prevent a massive new high-density filing (hundreds and hundreds of homes in the middle of 5-10 acre ranches). It’s not enough to go to the first meeting. You have to go to every meeting up through the County Commissioners meeting. Then, even if the BOCC votes your way, you have to stay involved to ensure they don’t pull a fast one afterwards or try to change the approved plans. The people in charge should have been attending all the meetings specifically to prevent this from happening.
Anyway, it’s probably a speed bump. Rather than engage in a protracted legal battle, FL can probably just dissolve the district or merge it with another one. That nullifies the covenants. Then, they just stand up a new one. It’s a pain and might take a few months, but this feels like a stalling tactic by Disney not something they can sustain.
I am enjoying watching those woke a-holes at Disney continue to go to war with voters and attack our kids with gay/tranny pornography. The Left will use this as a way to try and damage DeSantis, but most regular people are looking at this as yet-another example of Disney going off the rails into madness.

If his campaign printed and distributed those t-shirts then that is campaigning for president. He is already showing us that he is a cheater and does not mind pretending to obey the law all the while breaking the law. What a liar and a cheater!

And copycat too. That is the same tactic used by Jeremy Clarkson on Clarkson’s Farm. The local Town Council forbid him from selling Clarkson Farm T-shirts, pictures and show memorabilia because those items weren’t “grown on his Farm”. So … he charged $45.00 Quid for a bag of onions … which included a FREE T-shirt and signed picture.
