A letter from lawyers representing Michael Cohen to the Federal Election Commission in 2018 should end the case being attempted by Manhattan District Attorney Alvin Bragg. However, given the highly political nature of the DA bringing the case, it is possible the ideologically driven witch hunt will continue.
The 2018 letter states that Michael Cohen made a payment to Stormy Daniels without any consultation with Donald Trump. This undermines the cornerstone of the prosecution’s case.
(Via Daily Mail) The bombshell document, exclusively obtained by DailyMail.com, could throw a wrench in the works of prosecutors pursuing criminal charges against Trump over the payments. Cohen, Trump’s former lawyer and the star witness in the case over which Trump reportedly faces imminent arrest, claims that Trump got him to pay $130,000 to Daniels to keep her quiet about her alleged affair with the real estate mogul, just days before the 2016 presidential election.
[…] But in a February 8, 2018 letter to the Federal Election Commission (FEC), Cohen’s attorney Stephen Ryan wrote: ‘Mr. Cohen used his own personal funds’, and that ‘Neither the Trump Organization nor the Trump campaign was a party to the transaction with Ms. Clifford, and neither reimbursed Mr. Cohen for the payment directly or indirectly.’
The letter was written in response to an FEC probe launched after complaints of campaign finance violations, lodged by Paul Ryan and the organization Common Cause.
‘In a private transaction in 2016, before the U.S. presidential election, Mr. Cohen used his own personal funds to facilitate a payment of $130,000 to Ms. Stephanie Clifford,’ Cohen’s lawyer, who worked at McDermott Will & Emery, wrote.
‘Neither the Trump Organization nor the Trump campaign was a party to the transaction with Ms. Clifford, and neither reimbursed Mr. Cohen for the payment directly or indirectly.
‘Contrary to the allegations in the complaint, which are entirely speculative, neither Mr. Cohen nor Essential Consultants LLC made any in-kind contributions to Donald J. Trump for President, Inc., or any other presidential campaign committee. (more)

Well, I am not an attorney however, it is my understanding that a prosecutor does not have to present exculpatory evidence if they didn’t know about it nor would they have to search the entire 600 pages of documents for evidence helpful to the target of the investigation – Trump – however, if they knew such evidence existed they would have to disclose it. The last witness called before the grand jury I think on Monday was one of Cohen’s former attorneys – testified to the grand jury most of the damaging exculpatory evidence that makes up the 600 pages he originally gave to the prosecutors. So technically now that the prosecutors know about it including the grand jury – I believe the exculpatory evidence must be presented. This opinion is backed up by a comment attorney Alan Dershowitz made on NewsMax “He didn’t show the grand jurors most of the emails that Costello provided him,” Dershowitz said. “He failed to disclose exculpatory information.” I assume Dershowitz knows what needs to be done in a NY court.

Michael Cohen and Stormy Daniels (as well as her convicted lawyer) concocted this fake story, in order to try and frame trump. Cohen is a long-time Democrat who volunteered for the Dukakis campaign. Magically, in March of 2017, he switched his registration to Republican. (sure he did!/sarc) And then switched it back to Democrat a few months later.
As Trump’s long-time attorney, he had nearly carte-blanche to act on behalf of Trump from a legal standpoint. So they were able to make up the affair story and exchange money without even having to discuss it with Trump or anyone at the Trump campaign.
Cohen later billed the Trump Organization for his legal services — as he had always done for over a decade. Within his bill, he hid the extortion payment under NDA services. As Trump is one of the richest, most powerful and well-known men on the planet… they have lawyers on retainer, specifically to deal with this kind of nonsense. The chance that bill even came across Trump’s desk is likely 0% because that would go to his accountant team. They likely wouldn’t have seen anything wrong because $130k frankly isn’t a lot of money in that world. His bill’s are probably always in the hundreds of thousands, or even millions and NDAs are probably being drawn up all the time business-as-usual. But that 130K is a LOT of money for a gross Porn-Star.
You know who else handles their legal departments this way? Every major corp. in the world. I work for a giant bank and as a Record officer, I see nonsensical lawsuits against us all the time from disgruntled employees, states, regulators, activist associations and idiot customers that are obvious proxies from special interests. People have filed lawsuits with every accusation in the world leveled against our CEO… and I bet she never even sees these. The lawyers take care of it all – that’s what they are there for — to handle legal matters with their certified expertise as proven from their law degree and bar license.
What makes it more obvious that it was a fake extortion, concocted by Cohen? Because he privately tape recorded Donald Trump, in an effort to try and entrap him into saying something. He failed as Trump didn’t say anything.
