Last week, South Dakota Governor Kristi Noem broadcast a warning on the Tucker Carlson show about a bill that passed her State House and Senate that she was forced to veto because it changed the definition of money and banned non-govt-issued cryptocurrency like Bitcoin. {Broadcast Warning Here}
The bill stems from the generally innocuous Uniform Commercial Code (UCC), which Daniel Horowitz describes as, “a set of standards to facilitate interstate sales and commercial transactions such that all definitions pertaining to such commerce are uniform and clearly understood.” It looks like Horowitz was the first to transmit the public warning, as identified by two members of the South Dakota House Freedom Caucus, and then Kristi Noem became aware – thus the veto.
Governor Noem warned that the bill was already passing through several states, and if you look at the UCC Amendment tracking page [DATA HERE], she is correct. The states in green on the map below are states where the UCC revision bill has already been introduced.
As Daniel Horowitz notes in his initial warning dated March 2, 2023:
“The revisions to Article I are very clear now that Bitcoin will not be money, because even though the definition provides for electronic money … it says that an asset that is adopted by a government as its medium of exchange will not qualify as money … if the electronic asset, such as Bitcoin, existed before it was adopted by the government. So Bitcoin, of course, exists today; it existed before El Salvador adopted it as its currency … so it will never be money for UCC purposes. The same for other kinds of crypto currencies.” So there you have it. Officials clearly mean to pave the way for CBDC while explicitly barring all competition. (more)
This is obviously alarming.
Additionally, with the timing of this national revision taking place very quietly; and with the failure of SVB and Signature Bank following a few weeks later; and with specific impacts to the cyptocurrency market; one is left wondering if the current bank “failure” and Biden team intervention was not an intentional crisis with a motive to push government controlled central bank digital currencies into the mainstream.
In essence, was the SVB banking collapse, a designed crisis? And as a result, was the federal government response predetermined and just waiting to be triggered?
When asked last week why her legislature would do this, Noem responded the state politicians likely did not read the bill as it was constructed by lobbyists. Noem is exactly correct and hits on a subject we have discussed here frequently {GO DEEP}. However, one of the more alarming aspects to Noem’s discussion of the issue is that around 20 other states are considering similar legislation. WATCH:

Meta again with 10,000 jobs and you can expect the other tech companies will likely to do the same over the next couple months just like last time. Like a chess board all the systems/industries in place are designed to enforce compliance. When you are forced to choose over and over again, you may realize that you are being whittled down and over time as options become more limited one step at a time.. It’s just the illusion of choice. The only way out is to build new systems, new organizations, new industries and hopefully they will be more careful about how they are run in the future.
GOD has given all of us the FREE-WILL to exercise our choice; the COURAGE to make that choice is up to each of us!

I don’t have time to write up a detailed post here, but cryptocurrency “bans” have no practical means of enforcement. They can- and they absolutely will- mess with “exchanges”. But anyone can have a wallet and transact with another wallet and it is completely secure.
RIGHT NOW is the time to GET YOUR CRYPTO OFF EXCHANGES. We have a saying in the crypto world: Not your keys, not your crypto. If you have your coins on an exchange like Coinbase, Binance, Uphold, etc- get a cold storage wallet like a Ledger Nano X.

I recommend signing up for Coinbase. There are several steps because you have to prove you are you, etc. It will be confusing but if you take it one step at a time, you will get through it. Or ask if any of the other folks in your company have bought BTC and get their help.
A potentially easier approach is that you can now buy BTC with Cashapp. And the hardest part of that will be that you will need to move the BTC out of cashapp into a “wallet.” There are online wallets and hardware wallets. Again, take it one step at a time and “practice” with tiny amounts so you know you are doing it right.

Seems WV has a definition of virtual currency in the legal code.

Money is legal tender. If, e.g., a client, customer, tenant, etc. owes me a hundred dollars. He comes with cash. I cannot refuse to accept that in payment. I CAN refuse his check, promissory note, class ring, credit card, or other offering of “payment”. But not cash. If a cryptocurrency were designated “money”, I would have to accept that. Just isolated Missouri’s bill and read it. It hasn’t moved out of committee yet but a “public hearing” was completed on 3/3/23. It has no co-sponsors and the sponsor is a republican. 7 pages of legislative and legal gobbledegook so I circled a few sections to follow up on. No inkling whether the bill would protect or harm money as we know it, but I suspect the word has gone out from Evil Central to soften up the States for whatever they start rolling out, IMHO, in a very short time frame. Got rid of my cell phone years ago. Getting ready to ditch the computer and internet too. I’ve read about places in Europe now requiring the scanning of a cell phone to gain entrance to food markets. It’s getting real folks! How much longer do we just sit on our hands and allow these mentally ill, bully parasites to gleefully destroy us?

I just read the other day that because of what is being implemented to travel in and out of the UK, a cell phone will be required…along with facial recognition and fingerprint bio-metrics. I will NOT sign into any medical institution using my finger on their sign-in pad. I either use my knuckle, a pen/pencil, or ask for assistance and have one of their employees sign me in. WE NEED TO TAKE A STAND! We do that non-violently by simply not engaging. What will they do if 70 million folks (MAGA) throws out all their cell phones? Eventually, they’ll think up a new ploy, but it certainly can delay things.

Pretty inexpensive to start, but the sky’s the limit. I got started in the 60’s building a Heathkit radio and stringing a long-wire antenna on top of the house. My parents weren’t particularly amused. Listening to space stuff was my main interest. Paper route money funded it.
My gut is telling me it might be the only way to get unfiltered information soon.

Hussein passed out ‘free cell phones’ for a reason. It wasn’t to simply track everyone, which they do, but it was all part of the ‘plan’. It’s becoming more and more difficult to conduct business without one. The only truly resistant thing all an do is ‘disconnect’. Nearly everything is now requesting, and soon requiring, a cell phone. Throw them out!!! I realize how addictive they’ve become and how ‘convenient’ they can be. But if everyone begins to simply stop using them, it will throw a wrench in the works. It’s the biggest non-violent step all can take. We need to ‘break out’ of this electronic prison before we simply can’t.

I remain confused. “Money” is nothing more than a recognized medium of exchange that is generally accepted in a society and enforceable as such by its laws. Even gold and silver originally were “fiat money” as a substitute for exchanging cows or wheat, and albeit tangible (not mere paper or an electronic record), still have limited intrinsic value.
If the system ever crashes, we will go back to more direct barter. I’ll give you these trucks; you deed me that piece of real property. I’ll do your landscaping; you go to the market and bring me these items of food. I’ll build you a, b, or c; you sign a contract in return to deliver to me once a month for a year x, y, or z. That “x, y or z” can be anything the parties agree to.
So would someone please explain to me why it matters what the UCC defines as “money”? The UCC governs, inter alia, negotiable instruments and commercial contracts. It does not regulate money. Bitcoin is not “money” but more akin to negotiable paper or a contract. Is that the problem? That people were thinking that cryptocurrency was money?
I might be wrong, but seems to me that one of the differences between a contract and “money” is that money must be accepted as a medium of exchange, whereas it’s up to the private individual whether to accept a check, promissory note, tangible commodity or something else as a payment.
As I see this issue — and PLEASE, I’m a virtual ignoramus in this matter, so if there’s a banker or lawyer here who can explain the implications and how or whether I’m wrong, please do:
If, for example, bitcoin were not an electronic concoction but rather something else such as… I dunno… a certain kind of trading card or stamp, and its popularity burgeoned to the point at which it was being used as the equivalent of money, and the UCC were amended to declare it to be “not money” but a negotiable instrument subject to UCC rules on negotiable insruments (like, e.g. a check or promissory note), how and why would this be a problem.

Not being conversant in crypto, I do note it is often expressed as related to dollars, so a generally agreed upon currency is apparently still a basis for negotiating value for a particular product or service even if not paid for in dollars.
I think the alarm is, in general, about removing choices and freedoms, a real trend of late, particularly during the Covid operation. A caution against more government control and the attendant reduction in freedom and liberty and self-determination.

Yes, thank you. I am not well-versed in cryptocurrencies. Contra, the UCC. Which functions pretty good. I do not understand the implications of declaring a privately-produced item to not be legal tender, but rather akin to negotiable paper or a contract (a coupon is evidence of a contract, like a check.)
I also do not really understand the implications of government-sanctioned digital currency. How is that different than pretend Fed Reserve paper transactions. Would that require a dinosaur such as me to have some kind of technology to accept a “digital payment”?

I’ve now read through the Uniform Law committee’s recommended UCC changes, and I am unsure what part of it is the sneaky problem. Many statutory changes have iatrogenic consequences. Bad wording here or there. Often a sentence or two.
I am trying really hard to grasp the issue and I am not getting it. The best that I can come up with is that maybe designating cryptocurrency to be not government-sanctioned money but akin to negotiable paper will prevent an underground economy that the government cannot reach for taxation, bankruptcy, or to prevent fraud on creditors, or whatever. But straight barter does this too.

Cyptocurrency is NOT a coupon. It is an encrypted portion of a blockchain.
Think of the blockchain as triple debit accounting.
This portion of the blockchain is accessed by a key which looks like this:

Holding this key is what means you own the crypto.
This is what is stored in your “wallet” and this is what you send to pay for something using BTC.
The other essential thing to understand is that the blockchain was designed to be decentralized.
The closest thing to paper money is if you had a piece of paper with the private key printed on it.
That key is what allows you to access your crypto, store your crypto, use your crypto.
It is NOT controlled by a computer terminal though if you store it online, you are giving up control to whatever entity is storing it.
No one “owns” the blockchain. Each coin, like BTC, has its own blockchain which is distributed over a network of computers with many computers validating the transactions but no single computer controlling it. It is truly decentralized and while some have corrupted the usage like FTX, the decentralized blockchains themselves are proving quite robust. Why else do they want to sideline it?

Left an comment on here couple days ago. I remarked that I had a sudden change of heart about Bitcoin. If you can get some then get it off the exchanges using a DAP Wallet do it. There’s a reason the oligarchs hate it. They can’t control it. They can manipulate it like they do Gold & Silver with derivatives. But they have ZERO control over supply. This is why it might pass the test of time. A little flash drive with a 16 digit code is hard to find and recover too. If it is ever lost that Bitcoin is forever gone. It can not be increased or duplicated.
