There have been multiple times in the history of Congress when multiple ballots are required to nominate the House Speaker. However, at no point in history has the same person failed to capture the majority on six ballots and remained determined to keep trying.
At this point, the hubris of Kevin McCarthy is becoming awkwardly embarrassing, which is to say, perfect. Kevin McCarthy is becoming a human meme.

Six ballots with an almost identical outcome, yet California Representative Kevin McCarthy refuses to accept that no path to the speaker’s office exists despite him already moving in there. Unless, and this is where it gets sketchy, the House votes to change the rules which would allow a plurality of the vote to determine the speaker…. which could happen.
After failing for the sixth time, the House Republican caucus requested an adjournment until 8:00pm tonight. Democrats objected, but the Republicans won the voice vote.

What If the House Can’t Elect a New Speaker?
Jason Chaffetz’s long-shot candidacy for House speaker is predicated on chaos.
The Utah Republican is making no claims that he—or anyone else—can defeat Kevin McCarthy when the 247-member House Republican conference gathers behind closed doors on Thursday to elect their next leader. But Chaffetz’s theory of the case is that no matter what happens in that meeting, McCarthy can’t get the 218 votes he’ll need to formally win election by the full House as speaker.
At least 30 arch-conservatives in the House Freedom Caucus will oppose McCarthy during the floor vote on October 29, and then the House will be deadlocked.
That scenario is precisely what frightens rank-and-file Republicans.
The House could become institutionally paralyzed until it found a candidate that a majority of its voting members supported as speaker.
And if the Republican leader fell short on the first ballot, there’s no guarantee the party would quickly settle on someone else. “We’ve got to figure out how to get to 218 before we get to the floor. Because otherwise we could be literally doing this through the fall,” said Representative Tom Rooney, a McCarthy ally from Florida.

There are at least 10 “moderate” Republican congress critters that have either gone on record as saying they will work with Democrats to select a consensus Speaker, or strongly signaled that intent.
So here’s the deal; McCarthy must know he’s toast now, so my guess is he’s cooking up a deal with the Dems to elect him Speaker. But that will fall through because the price the Dems will demand will be too great–even for a RINO like McCarthy.
But the other back room deal that is going on is the 10 or so “moderate” Republicans who are negotiating with the Democrats to select a consensus Speaker.
I hope that happens and here is why; it will drive a stake through the heart of the Republican Party and cause a cratering of support that not even the GOPe donors can rescue.
The Republican Party cannot be saved and does not deserve to be saved. It needs to be ignored and boycotted, it’s donor base ostracized and its non-MAGA members banished for life from politics.

No Speaker means no new Congress, no passage of any laws good or bad, and President Biden gets to rule by Executive Order/Emergency Declarations, since Congress is unable to perform any of its duties making law without both parts able to function.

Trump needs all the votes he can get in 2024, and the GOP does too so we can maintain the House majority and win the Senate majority. This cannot happen with MAGA votes alone, we need independents too, and Dem walkaways. All negativity compromises our success and we’ve already had so much of it we really can’t afford much more.

What the Constitution Has to Say About the Election of a Speaker of the House

………. there is some ground for thinking that the Constitution bears on the conduct of [House] business. Article VI requires that “. . . Representatives . . . shall be bound by oath or affirmation, to support this Constitution . . . .” Until the new Representatives are sworn in, they can’t conduct business, it seems. And the Speaker swears them in.
But here’s the thing. The Constitution itself doesn’t require that the Speaker be the one to administer the oath.
The difficulty here is that a federal statute says that the Speaker must administer the oath–and that this administration must occur “previous to entering on any other business.”
So, by legislative precedent, the House can’t take any other action until a Speaker is chosen, but legislative precedents are effectively norms that can be broken. The statute is a different matter.
Accordingly, the better conclusion seems to be that the statute requiring the Speaker to administer the oath and that the oath must precede other business is valid.
Moreover, even if the statute is invalid, it would take a majority vote of the House to adopt a rule permitting someone other than the Speaker to administer the oath. And the same faction currently blocking the election of a Speaker might well block such a rule.
Thus, until a majority can agree on something, the House is stuck.

Funny I just remembered that the English royalty also called the signers of the Declaration of Independence the equivalent in 1776. Those 20 folks will be remembered as true patriots. I hate McCarthy too, but telling him to step down really isn’t reasonable. He has the majority of the GOP votes right now, by far. What he needs to do is negotiate with the holdouts, give them what they want, so they can move on and start to do real business and stop providing more material for the Dems and anti-Trumpers to leverage.
Imagine if it were the other way around. Imagine if a MAGA person had 201 votes and there were 21 GOPes/RINOs who were preventing the MAGA person from being chosen Speaker. Would we tell the MAGA person to step down? (Of course not.)

What if the top GOP candidate were MAGA and it was a small number of GOPes or RINOs holding out. What would your advice be to fix the problem? To tell the MAGA person to step down because there are a few holdouts? It doesn’t make sense to do that. McCarthy has 90% of the GOP votes. I do think he needs to compromise to win over the holdouts, but he shouldn’t step down.
