All 12 railroad unions vote individually to ratify their contracts, unless congress intervenes and imposes a contract which forces all to abide. The railroad unions representing a majority of the railroad workers remain in dispute with the currently proposed contract with no resolution in sight and a potential labor union strike looming on December 9th.
If one union within the collective group strikes, all of the unions — which represent more than 115,000 rail workers — would almost certainly join in solidarity, triggering an industry-wide freight rail work stoppage.
With the unions at an impasse over sick pay, Joe Biden has asked congress to intervene and impose a contract based on the terms of an earlier agreement.
(White House) – I am calling on Congress to pass legislation immediately to adopt the Tentative Agreement between railroad workers and operators – without any modifications or delay – to avert a potentially crippling national rail shutdown.
This agreement was approved by labor and management negotiators in September. On the day that it was announced, labor leaders, business leaders, and elected officials all hailed it as a fair resolution of the dispute between the hard-working men and women of the rail freight unions and the companies in that industry.
The deal provides a historic 24% pay raise for rail workers. It provides improved health care benefits. And it provides the ability of operating craft workers to take unscheduled leave for medical needs. Since that time, the majority of the unions in the industry have voted to approve the deal.
During the ratification votes, the Secretaries of Labor, Agriculture, and Transportation have been in regular touch with labor leaders and management. They believe that there is no path to resolve the dispute at the bargaining table and have recommended that we seek Congressional action.
Let me be clear: a rail shutdown would devastate our economy. Without freight rail, many U.S. industries would shut down. My economic advisors report that as many as 765,000 Americans – many union workers themselves – could be put out of work in the first two weeks alone. Communities could lose access to chemicals necessary to ensure clean drinking water. Farms and ranches across the country could be unable to feed their livestock.
As a proud pro-labor President, I am reluctant to override the ratification procedures and the views of those who voted against the agreement. But in this case – where the economic impact of a shutdown would hurt millions of other working people and families – I believe Congress must use its powers to adopt this deal.
Some in Congress want to modify the deal to either improve it for labor or for management. However well-intentioned, any changes would risk delay and a debilitating shutdown. The agreement was reached in good faith by both sides. (read more)
A national freight stoppage would be bad for the entire transportation sector. Moving oil, coal, ethanol and derivatives needed for diesel transport would be almost impossible with a freight railroad shut down. Congress has needed to intervene in this contract process several times before.

Who gets sick leave any more? My industry -made up almost entirely of white collar professionals – hasn’t had separate “sick leave” for decades. It’s lumped in with our vacation leave.
It sounds like the issue may be the fact that when they’re sick, they sometimes need to take unscheduled leave. That seems to be a reasonable thing. In my situation, when the company combined the two together, the formal process to “request” and be “approved” to take vacation time went away.
Federal government workers get 4 hrs sick leave /paycheck (104 hrs/year) for as long as they work, in addition to paid time off.
In addition, they are allowed to ACCRUE any unused sick leave year over year–they never lose it. In fact, many bank so much sick leave hrs over the years that they retire early–up to two years early–and convert sick leave hours as paid leave.
Essentially, you can build up thousands of hours in sick leave, stop working at 63 and and get paid until 65–being “sick” for two years at full pay and benefits.
Another option is to work until retirement, and if you have 25 years in govt, you can get a certain percentage of your unused sick hrs paid out to you, tax free. 4k unused sick hours @$50/ hr or so…..fed govt are making bank on unused sick hours-and we pay.

The explanation is pretty easy to understand. The Federal Government’s labor unions are negotiating with managers, who are getting their paychecks from the taxpayers, The taxpayers have no say in the contract negotiations. Government managers have no issues with the Government Labor Unions, because they don’t need to make a profit. Instead, they feed at the same trough the Union is feeding at.
It is not hard to see why the contracts between Labor and Management go very smoothly at the Government. It is also not hard to see who gets screwed on every new agreement these two groups make. Because of the obvious conflict of interest between Government Managers and Taxpayers, there was never a need to have any Government Labor Unions in the first place. This is only one of the many reasons Government spending is completely out of control, but it is certainly one of the biggest reasons.
For the exact same reason, it requires about 4 Government employees to produce at the level of 1 private sector employee. So, what do we get? More and more Government workers. I bet you are watching closely how that comes out. Take, for instance, the Teachers Unions. It is obvious the Communists in the Teachers Unions are running everything down at your old school.

In New York we have what is known as the Taylor Law which prohibits public employees from striking.

Well, to start, Federal employee wages and benefits are set by Congress. Federal employee unions cannot bargain them.
If you read the Union contracts (eg National
Treasury Employees Union, American Federation of Government Employees) you will find nothing that is not already codified in Federal labor or other laws.
For example, the NTEU contract for CBP prohibits working employees longer than 16 hours, unless an emergency. Identical language appears in title 19USC. I think its a prudent rule/law but others might want the limit set much higher. But bear in mind there is a risk when driving a vehicle or using a firearm while sleep deprived. I digress.
What can Federal unions bargain? Well, mostly impact and implementation. This means if management wants to establish a new policy, a change in work practice, then local bargaining must occur. The Union cannot refuse the new policy, their purpose is to ensure fairness, or to put it bluntly, that everyone gets screwed equally.
Much of the Union work revolves around health and safety, and defending against adverse actions and disciplinary action.

My father in law retired from the post office on 9 months worth of medical leave.
So many myths are perpetuated here by people who lump Feds in with state, county, and municipal workers who go on strike (Feds can’t), run up OT in their last 2-3 years to jack up their pensions (OT does not count in pension pay, only base rates), and get the “Blue Flu” their last year or so to use sick pay to leave early (doesn’t work that way for Feds).

Having recently retired from the federal government I can assure you that sick leave in the Federal system is NOT converted to paid leave. Unused sick leave counts toward your years of service for pension calculations, however. Annual leave is converted to cash, up to 240 hours that are carried over from the prior year, plus whatever balance you have accrued in the year you retire. Some agencies use Time Off Incentive Awards as rewards for high achievers; this never goes away and can be carried over from year to year forever, but has no cash value when you retire and simply stays on the books, unused, unless you come back to the Federal government.

I work in IT for the feds and get paid about 60% of what I could have in the private sector. Of course, I don’t get fired. That is the trade off.

That is NOT how sick leave works. You can NOT retire early because of sick leave. Sick leave is used to calculate the total # of months of service, you have 6 months of sick leave, you get 6 months of leave added to the total.

That isn’t so employees can take a 2hr. lunch break. I promise you the carriers, if the office has them assigned to it, are still out on the routes. It simply means that the PO is closing for 2hrs. because they were evaluated and needed to slash window hours. I would bet that the hourly numbers were run and those hours were the least utilized by customers.
I can guarantee that no clerks are getting a 2hr. paid lunch.
This cushy benefits package is common in government at all levels. It is not unheard of for retirees to actually receive a pension that exceeds their pay, after a few years of automatic COLAs. Employees can often double dip, receiving pensions from one government program from which they “retired” while still working in another government job.
I used to work for a city government. We’d see retirement payouts of accumulated sick leave and unused vacation pay exceeding $100k (this was late 1980s). We were instructed not to mention it outside of the office.
Later, I worked in a for-profit company. Vacation was take-it-or-lose-it. Paid time off included sick days and you could only accumulate 6 months of extended benefits. Retirement pensions were modest and did not have COLAs. This was caused not by the greed of capitalists but by a combination of business necessity and government regulation.
The railroads have a point based attendance system that penalizes employees for missing work due to illness.
Four points per day are assessed unless you have written documentation from a physician, then you are only assessed two points. Once 20 points is reached you may be subject to disciplinary action.

How is not getting penalized until you have five sick days in one year that did not get excused by a Doctor’s visit. The doctor can also tell your employer that you will have to be out for a week each time you actually are sick. So, don’t forget to get your documentation from your doctor when you are sick.
My sick pay was far worse than yours and it never did matter. Because in 47 years, I never had to take more than 3 sick days in a year. But I worked in a time when my employer could trust me and I could trust him and that was the biggest part of the bargain we had.
I wish we had that in the fed govt. I work with two sickly people that take months off at a time. I do their work. We need a way to push them out.

Yes, as a retired teacher I am able to say we could earn sick days each year, and if not used, they would be rolled over to the next year. In SC, when I retired (40 years teaching eighth graders), I was capped at 90 days of accumulated sick leave payment at a reduced rate. Unfortunately, some teachers who had more than 90 days would use their remaining sick days before their retirement date and could find a doctor to write an excuse.
We had to use sick days for personal illness, our children’s illnesses, doctors’ appointments, marriage, death in the family, and maternity leave. If one did not have enough sick leave banked from yearly rollovers, the leave was without pay. Anything longer than six weeks for maternity leave was frowned upon, and now they take three months. Yay for the newborns!
We were afforded two personal days a year that could not be carried over to the following year. We had to put in writing why we were taking a personal day. It was infuriating that we had to share what was personal.
I was one who was never sick and even joined others to gift some of my sick days to a first year teacher whose wife gave birth to a special needs child and needed his help when baby came home from the hospital. Isn’t that what sick days are for…?

The company I work for just recently brought it on. We have our PTO and then an additional 40 hours of sick pay that we can use. The job I previously had NEVER had it and still doesn’t to this day nor PTO.
In the industry I worked sick leave was no paycheck for the days you missed. It really kept people coming to work regularly. Now if you were truly sick or injured, there was long term disability insurance.
When Milwaukee Co legislated/mandated 7 days of sick leave… private employers changed their policies to allow 7 days of vacation to be used for sick leave.
In the end, all that the employees got was a repeal of punitive attendance policies.

Operating huge diesel locomotives takes training and experience and is very dangerous in untrained hands.
The people in Washington DC think they are godlike but a massive walkout might teach them how little they can do with a determined populace.
FYI … it was also “impossible” to replace all the Air Traffic Controllers that Reagan FIRED. But we did.

They did this in the 90s and it had to do with a railroad strike too. It lasted all of 2 days before congress forced them back to work. I suspect the military might get involved with transportation if it doesn’t work, but their vehicles run on diesel so good luck.
Good, that would drain the military personnel, in addition to all those running the Branch 4 wars overseas and leave dependents wide open for mercenary action. Militarizing the railroads would also bring bad optics to the fore, even with the propaganda machine fully cranked up.

Rail companies have estimated that it would cost roughly $688 million a year to provide 15 days of paid sick leave to rail employees, who work long and erratic hours and are often expected to be on call 24 hours a day. To make matters worse, rail companies’ attendance policies punish workers for calling out sick or taking a day off to see the doctor.
BNSF has urged Congress to intervene and force rail workers to accept a contract with no paid sick days, something Senate Republicans tried to do via the unanimous consent process in mid-September. Sanders, the chair of the Senate Budget Committee, blocked the GOP legislation, allowing the collective bargaining process to continue.
“They can settle this at the bargaining table,” Ferguson added. “But, the railroad executives who constantly complain about government interference and regularly bad-mouth regulators and Congress now want Congress to do the bargaining for them.”

I was married to a BNSF exempt employee for 23 years. Non-exempt (union) benefits were better than management’s. A train crew is never on call 24 hours a day; if train or track problems delay the schedule, the crew will “die” where they sit and be picked up by a passenger van bringing in a fresh crew.
At the time the railroad owned a small private railroad spur which was used to train exempt employees to operate a train in case of a strike. Many in management had come up through the ranks and could easily be certified.
I no longer have any insider information but saw the Great Northern Railway as it merged with other regional players and innovated intermodal and yard management practices into the industry leader that Berkshire Hathaway bought.

Also, one needs to examine rail pay and benefits over the last couple decades. The numbers are out there. Even as a non-union business owner, I can see why they’re at the table.

Rail Workers, will they be heroes or villeins? A strike would likely put the country into a recession, but the lack of fuel for its engines could do the same thing. If they continue to work, then Biden remains in office for a few more days.

In a rational world, the Secretary of Transportation would have been directly engaged from the outset, monitoring negotiations and encouraging solutions. But like everything else in this mockery of a sham of an incompetent administration, all is calculation and ad hoc-ery to maximize political gain in service to the transparent but unspoken agenda. The US government seems to have a habit of adopting certain ideas, values, groups, etc., and then losing control of those entities. Ever notice that? Well, here we have Biden, purposefully interfering with supply side economic issues, making fuel so expensive that the entire trucking/shipping industry begins to collapse. One would expect that he would appreciate the destruction of the rail industry (until it can be supported by solar panels and windmills…lol)m as part of that collapse of supply side economics. Of course, that appears to be a step too far…??? The point, of course, is that Biden didn’t mind putting truckers and small businesses out of work, due to ‘energy concerns’, while destroying the supply side, but insists on keeping the big business/government rail industry afloat.

Surely he would want to destroy this, until the rail industry is supported by windmills and solar panels, no?
