The Australian Open is scheduled to begin January 17th in Melbourne, the epicenter of Australia’s totalitarian COVID mandates. However, one of the biggest and most important sporting events in the country has turned into a national embarrassment as the world now sees the arbitrary and nonsensical nature of the Australian rules and regulations surrounding their COVID response.
Judge Anthony Kelly dispatched the government argument, squashed the visa cancellation and further ordered the Australian Government to pay legal costs and release Djokovic from detention within half an hour. An overwhelming victory following well-presented legal arguments based on reason and logic from Djokovic’s lawyers.
In court the lawyers for Djokovic outlined all the steps their client had followed to ensure he complied with all of the government rules and regulations before being granted his visa entry to compete in the Australian open. [Court filing Here]
The judge heard about all the steps Djokovic had taken, and also heard about the ridiculous, and consistently changing rules and arbitrary responses from border authorities when he arrived at the airport, presented his approved visa and was then put into prison because he was not vaccinated. Judge Kelly asked the court the same question that Djokovic asked the border authorities: “What more could this man have done?” in relation to fulfilling the expected requirements for a medical exemption. The Australian government did not have an appropriate answer for the eloquent, commonsense and matter-of-fact delivery presented by the Djokovic team.
As a result of the sheer madness represented by the indefensible bureaucratic mess the Australian government attempted to justify, Judge Kelly ordered the government to release Djokovic and overturned the visa cancellation. However, his ultimate fate is uncertain as the Australian government may still deport him regardless of the judge’s ruling. More insanity.

Actually, the Australian Government dropped their defence of the case rather than have the Court formally rule against them and thereby establish a strong legal precedent on vaccine exemptions.
So yes, the Court concluded that Djokovic had been denied procedural fairness, but the fact the ‘consent orders’ agreed by the parties and the Court were 100% in Djokovic’s favour tells you where this was heading.

He obviously gave it “no” weight or it would have been front and centre.

No, if the Govt had a ‘knockout’ rebuttal to the question posed, by the Judge mind you, not just Djokovic’s lawyer, they would undoubtedly have used it. The wording of the consent order unsurprisingly speaks only to the specifics of what has been agreed and is not akin to a judges written findings in the event the case had proceeded to judgement. We can only speculate what the judges findings may have been, but the Govts acceptance of highly unfavourable consent orders provides a hint.

I am an Aussie. Pre covid I loved my country, and it was the best in the world. Now I am angry with the politicians for their evil (and illegal) oppressive rules. What he mentions about driving laws are spot on. Last time I visited, my in-laws told me I had gotten nabbed by a speed camera several times, totaled over $1500. Three offenses, all less than 5kmh over the posted limit. Two were in the same place at the bottom of a steep hill out in the boonies that I rode the brakes the whole way down.
Hell, you can’t even rest your arm on an open window while driving, because you _might_ get in an accident and have your arm severed. Oh, and that’ll be a couple hundred bucks fine says the cop…yes I have personal experience with this one.

Since then the Federal government has continued to gain power and the States and individuals continued to lose more power. After the 1930’s and 40’s the States had become little more than administrative adjuncts to the Federal Government. Starting in the mid 1960’s with LBJ’s Great Society program Individual Rights became dependent on belonging to the right minority group. Now the remaining vestiges of Individual Rights are being ceded to the Federal Government using Covid fear as a justification. We are on the verge of becoming a totalitarian state. Whether or not this final issue is decided at the ballot box or by force of arms remains to be seen.

Australian bureaucrats lack common sense. While touring Australia in 2017, when I got back home in the US, I received a speed camera ticket for $30 Aus. I had leftover currency of over $30 Aus. So I paid the fine sending the currency with the ticket. In a few weeks, I received a check from the Australian govt for $30 Aus stating that I could only pay by credit card or debit card. As of today, the check remains uncashed (shredded it) and I opine that the govt Australian bank has the money for the fine, so I paid the fine.
Why wouldn’t the ticket people take cash? They obviously deposited the money into a bank account, so why didn’t it pay the fine? Who knows what screwy regulation they followed or misinterpreted? They were trying to collect from a person who lives in the USA, how were they to enforce it? Deprive my visiting Australia again? I toured for one month on my own, and saw everything on the Australia bucket list, and I wasn’t planning on returning, especially now.
If Australia doesn’t back down, Serbia – and other countries – *should* immediately cut diplomatic ties, and professional tennis’ governing body should likewise disestablish the Australian Open as a major, and withdraw all official support for it. Won’t happen … but it *should*. Let these totalitarians be the isolated, imprisoned pariahs they so obviously want to be.
