A three judge panel in the U.S. Court of Appeals for the Fifth Circuit in Louisiana has temporarily blocked the Biden administration OSHA vaccination mandate [Court Ruling Available Here].
A group of states including Louisiana and Texas along with businesses, religious groups and organizations filed their petition on Friday with the court. The Biden administration must reply to the court by 5:00pm Monday thereafter the court will decide if a permanent injunction is warranted.
New York Times – […] At the core of the legal challenge is the question of whether OSHA exceeded its authority in issuing the rule and whether such a mandate would need to be passed by Congress. […] The suit against the mandate stated that President Biden “set the legislative policy” of substantially increasing the number of Americans covered by vaccination requirements, and “then set binding rules enforced with the threat of large fines.”
“That is a quintessential legislative act — and one wholly unrelated to the purpose of OSHA itself, which is protecting workplace safety,” the suit said. “Nowhere in OSHA’s enabling legislation does Congress confer upon it the power to end pandemics.”
A separate lawsuit against the new rule was also filed on Friday in the Court of Appeals for the Eighth Circuit in St. Louis by 11 Republican-led states, among them Texas, Mississippi, South Carolina and Utah.
The Fifth Circuit panel said in a brief order, signed by a deputy clerk, that the judges were blocking the regulation “because the petitions give cause to believe there are grave statutory and constitutional issues with the mandate.” It said the rule was suspended “pending further action by this court.” (read more)

I was looking at whether this stay applies only to this Circuit or the entire nation. Interesting that OSHA rule challenges go directly to Circuit Courts. Those filed within ten days in Circuit Courts go into a lottery and then Washington, supposedly randomly, picks a Circuit where all of the cases are handled. I am assuming (hopefully) that most of these challenges are being filed in good Circuits (not the Ninth obviously). I would really hate these cases to end up in a liberal Circuit. The person who wrote this article thinks that the Fifth Circuit may be trying to get its opinion out before the cases get assigned to a different Circuit. Government is to respond Monday.

Good point. Since the virus has never been isolated OSHA might not be able to find it. PCR tests don’t distinguish between covid and flu.
I don’t know about that. I had that bad summer cold/flu in August that was going around, with a low grade fever, stuffy nose, fatigue, congestion, initial sore throat, and sporadic cough that lasted two weeks. I thought it might be the Delta variant, and did an Abbott home test that came out negative, but wanted to be sure. (If I had tested pos for covid, I wanted to get monoclonal antibody treatment right away, before it got worse. I am 66, and my mom who lives upstairs is 91, so I take precautions.) The teledoc ordered a PCR test, since my symptoms could have been Delta, and that test also came up negative. Just saying, it surprised me that in my case, it DID distinguish between cold/flu and covid.
Interesting that Louisiana A.G. joined in. LA has a dem governor, and a major corporate hospital chain in LA is mandating its employees get the Franken-Jab.
But we knew TX A.G. Ken Paxton would be all over this!

I cannot see how this is allowed to be enforced when some groups are exempt like the post office and illegal immigrants. This shows it is not real and not necessary. Let’s see what the Supremes do now. I do not think they can punt this one.

I can’t see how such a mandate can be enforced when we already know that the vaxxed can still catch and spread the virus. That invalidates the purpose of the mandate.

Another thought … maybe the reason the deleterious effects of the vaccine aren’t noticed in senior citizens is that we tend to live a more sedentary lifestyle. Young adults are far more active, living a more active and vigorous lifestyle, especially among athletes (notice how often stories appear of heart problems among athletes).
Heard the local evening propagandist (AKA the local newscast) talking about this court action and putting such a spin on it as though it just might only impact the states under the 5th circuit’s purview.

Perhaps not, the penalty would’ve been paid and life would go on and the objective of dominance would not have been achieved. By implementing an unreasonable penalty it would force many companies into bankruptcy or immediate collapse as it is well known that there is a significant percentage of workers that have not and will not ever submit to being vaccinated. The result would be the collapse of private enterprise and the institution of state ownership of production, their dream. If the mandate strategy fails, they have another one up their sleeve, and another one.

OSHA has a number of problems here:
1) What, exactly, is the great “emergency”? They issued an ETS back in June covering healthcare businesses with staff likely to have direct contact with COVID patients. but failed to apply the standard to all other industries. Why do it now when they had the ability to do this five months ago? Why wasn’t it an emergency then?
2) OSHA oversight is limited only to the work place. If there is at least an equal chance of contracting the virus outside of the workplace, then this is beyond their scope of authority. In other words, OSHA standards are limited to only those problems unique to a industry, industrial process, work practices, or a specific workplace.
3) OSHA’s letter claims, without proof, that the workplace is a primary vector for spreading COID-19. They are required to back up their claims with actual scientific proof.
4) OSHA is required to seek the least invasive means to address any perceived safety issue.
5) Strangely, the OSHA statement requires non-vaccinated workers must wear masks in the workplace and submit to weekly testing. If this is an acceptable option, why mandate the very-invasive vaccination requirement at all?
I’ve read where OSHA ETS’s are often knocked down. Another point: Associate SC Justice Samuel Alito is assigned to the 5th District. A lot of things have to happen before this thing gets anywhere near SCOTUS. I’m thinking Alito has the power to determine whether or not the case has standing; if not, the Appellate Court ruling stands. Could be wrong on this, will have to review how the process works going forward.
If I’m employed as a carpenter framing a house, there’s a distinct and very real possibility I could be struck on the head by a piece of lumber. That’s why OSHA, and my employer, require that I wear a hard hat on the job site at all times; being struck on the head by a board is a risk that predominately occurs in this particular industry or work situation, thus the OSHA mandate is applicable.
Catching a flu bug can happen anywhere at any time whether I’m at work or not. I have just as much chance catching it in the local grocery store as in the office. OSHA cannot force my employer to mandate I take a preemptive flu shot as a condition for employment; which is why it’s never been done before now. Getting the flu is NOT unique to my particular industry, job, or workplace.

If this mandate is allowed to be in place, it will destroy the economy and millions of people’s lives and families. If this happens it will lead to an inevitable Civil War. If you read the clear language of the “emergency standard” OSHA is restricted to issuing an “emergency standard” to mitigate a grave threat to workplace safety. When over 99% of workers survive SARs CoV2 I can hardly see the “Grave” threat – can you? Let’s not forget that the super majority of those dying from SARs CoV2 are over the age of 75, and the number of over 75 year olds in the workplace where is the “Grave” threat. Words matter, to all I guess but the tyrants.
Just as in elected positions appointed positions are not immune to scoundrels.And that goes double for the military. Ive come to think the Founders could not have forseen what SCOTUS would become. Ive also come to the conclusion that term limits must be imposed on the Supreme Court. A lifetime position shouldn’t be guaranteed in any branch of government. Especially when decisions rendered have such a profound effect on the Nation. We must also realize that age doesn’t necessarily confer wisdom. A good example was the animated cadaver once known as RGB. I rest my case.
