The trial of Derek Chauvin, the former Minneapolis police officer accused of killing George Floyd, began today with opening arguments. Officer Chauvin has been charged with second-degree murder, third-degree murder and manslaughter in the death of Floyd, a 46-year-old Black man, who died in police custody in Minneapolis, Minnesota.
Forensic evidence showed that George Floyd died from a “cardiopulmonary arrest complicating law enforcement subdual, restraint, and neck compression.” Other significant conditions were listed as “arteriosclerotic and hypertensive heart disease; fentanyl intoxication; recent methamphetamine use.” (link)
A memorandum filed by the Hennepin County Attorney’s office on June 1 indicated that chief medical examiner Dr. Andrew Baker, who listed Floyd’s death as a homicide, thought the amount of fentanyl in Floyd’s blood was “pretty high” and could be “a fatal level of fentanyl under normal circumstances.” “[Dr. Baker] said that if Mr. Floyd had been found dead in his home (or anywhere else) and there were no other contributing factors he would conclude that it was an overdose death,” the memo said.

I thought last summer maybe they’d get him on manslaughter…until the body cam footage of the other officer was released which tells the rest of the story. There is video of a prior arrest where George Floyd also complained “I can’t breathe” and resisted arrest in the same manner: Feigning confusion, refusing to comply with orders, claiming he can’t breathe, that he’s claustrophobic . He was stalling for time, and trying to destroy evidence.
I think “I can’t breathe” is a callback to Eric Garner, a catchphrase Floyd used to intimidate police.

As another commenter noted, Floyd was saying “I can’t breathe” for a good 10-15 min before they even tried to get him into the car. There was also a struggle when the officer went around the other side of the car to pull Floyd into the back seat so they could close the doors. Derek Chauvin did not have George Floyd’s blood toxicology report when he arrested him. He is not a doctor, nor a licensed medical first responder. Derek Chauvin is a police officer. With that badge comes a policy guideline for arrest and restraint procedures that he is duty bound to follow.
As I have read the MPD restraint procedure guidelines, when George Floyd stopped struggling, Chauvin was required to remove his knee from his neck.
George Floyd was a thug. But that does not give Chauvin the right to ignore procedure.

Probably not, but that doesn’t give Chauvin a pass to violate procedure. I don’t think he should be charged with Murder, but he did not follow procedure. He will pay a penalty.
Make no mistake, the policy will be on trial here. Chauvin knew there was a crowd, video and body cams. There was a reason he did what he did (agree or disagree) we just haven’t heard it yet.

In the actual manual. Looks like it has been updated to completely prohibit neck restraints.
The manual in use at the time of the incident allowed used of neck restraints to gain control of the suspect. Once control was regained, the office had to remove the knee from the neck of the suspect. Where Chauvin messed up is that he continued to keep his knee on Floyd’s neck for 3:00 minutes or so after Floyd stopped struggling and resisting.
I have no problem with Chauvin usig force to arrest him. Once he was in cuffs, face down and wedged against the tire, Chauvin had no need to keep his knee on his neck. Move his knee 6 inches and he has no problem whatsoever.
Why don’t you try restraining a 6’8” 280 man high on something? You wouldn’t let him up the moment he stops struggling. He’s gonna get up and kick your a$$.

Based on the body cam video, the officers suspected Floyd had taken drugs due to his erratic ramblings and actions.
My only question is whether there was a point when the knee hold should have been released for humane reasons. (I have not re-watched all the videos. I will leave that to the attorneys to present.)

The initial 911 dispatch call indicated black male over 6 foot under the influence. Included from convenience store employee to 911 dispatch was vehicle information including license plate number.

I have. It started out just trying to restrain him. He had superpowers. He jumped from the ground to the hood of a car. He never had a vertical jump like that. That drug is bad news.
That’s really the crux of the matter. Chauvin was not compressing the neck, he was holding his knee above it to keep Floyd restrained. I would say that had the officers quit restraining Floyd and rendered aid once he became unconscious they might not be in this situation but that didn’t help the cops in Eric Garner.
The Minneapolis police are instructed by ER physician trained instructors to keep the Fentanyl overdose person completely still until the EMT arrives because movement only accelerates death. In any event the overdosed person typically dies before the EMT arrives anyway. We have too many police haters here today!

True, and I think that this will be argued by the prosecutors. But “not following policy” isn’t going to produce a murder-2 or murder-3 conviction. 2 requires them to prove Chauvin intended to kill Floyd. 3 requires them to prove Chauvin was deranged and did something that caused Floyd’s death.
At most, I think maybe they get him on a manslaughter charge. Depends on how MN defines Murder-3 and voluntary/involuntary manslaughter.
It won’t be lost on the Defense to show that Floyd was saying all the same things long before he was in the street. So the officers had to assume it was an act and it might not be wise to remove the restraint lest Floyd resume fighting.
They’ll probably get Chauvin on a lesser charge like manslaughter that has some jail time. But that’s a stretch, and he could walk based on the other body cam footage shown.
Floyd died as a result of his own poor decisions. How was Chauvin to know whether or not Floyd would resume his efforts to resist being taken into custody? What if Floyd managed to take an officer’s firearm?
Sheriff David Clarke said it best: “Comply and you won’t die”

I think its a fair statement. But, I would also add that according to the county ME’s report (assisted by Air Force ME) there isn’t any evidence that Chauvin’s knee on the neck caused any physical damage before or after Floyd stopped resisting, nor did it cause asphyxiation. There is no way to tell what kind of pressure was being applied if any from a video.
It didn’t look to me like Floyd ever stopped struggling.

After I watched this video I looked online to see if the vehicle was indeed stolen and what the outcome of this traffic stop was. The woman seemed to be protesting too much for there to be nothing to this. Here is the news story that followed up this ridiculous display by her. The car was actually involved in a shooting! Of course she claims she knew nothing about any of that and claims the only reason she resisted and was so hysterical was because she felt threatened being a black woman stopped by police. In my opinion she was trying to get out of trouble throwing the race card. Sickening what these police have to put up with.

I am not interested in the light it shows the officer or suspect. How tall was the suspect, how tall is the officer. The officer will use all means to maintain control of the suspect. This may have not been the best choice in restraint, however the officer didn’t know he was on fent, meth, THC, plus had underlying health issues.

the Office of the Armed Forces medical examiner agreed with Baker’s findings that Floyd’s heart stopped while cops were restraining him.
“His death was caused by the police subdual and restraint in the setting of severe hypertensive atherosclerotic cardiovascular disease, and methamphetamine and fentanyl intoxication,” officials from the Office of the Armed Forces Medical Examiner wrote. “The subdual and restraint had elements of positional and mechanical asphyxiation. … We concur with the reported manner of death of homicide.”
Based on these assertions as reported via Fox News, it doesn’t seem to me that the Medical Examiner or the Armed Forces Medical Examiners office can say with certainty that Floyd died as a result of Officer Chauvin’s actions.
IMO the most they can say is the Floyd died while in police custody.
If I was sitting on that Jury with these facts in evidence, I would not hold Chauvin accountable because the medical examiners cannot directly link Floyd’s death to Chauvin’s actions.
Floyd had health problems, those problems were likely exacerbated by his drug use so IMO he is culpable for his own actions.
At the most, I can see Chauvin getting convicted of manslaughter. But, as I said before, I am not sure I would even go that far.
Meanwhile, Floyd’s family got a huge payday before the trial started based largely on MSM’s biased reporting and political posturing by elected officials at all levels of government. What a load of manure.
In your last paragraph, the payment settlement is mentioned. It was $27 Million. This amount is unimaginable for some kind of restitution, but I am not familiar with legal guidelines on such a thing.
However, could the fact that this “payday” has occurred, and with its huge amount have an influence over the jury’s verdict? Technically, it should not. But, jurors are human beings, and with that comes a sense of justice that may not always follow legal, religious, and rational considerations.

Today being the start of the George Floyd show I was thinking about all those terrible old Tarzan movies showing stereotypes of African black culture and possibly even being racist. They don’t play those old things anymore because they are perceived as derogatory to African Americans, or so I thought when I wondered why Al Sharpton is in town.
Those old racist movies that so many think are bad show a lot of supposed tribal culture, including witch doctors getting the tribes all worked up in order to send them out to attack somebody. Lots of shouting, chanting, screaming and urging the tribe to rise up with fires and gathering to make sure the entire tribe believes the witch doctor, without any concern that the witch doctor is using the tribe for his own personal power. Once they are all under the spell of the witch doctor, the movies showed the tribes picking up weapons and heading out to attack whoever the witch doctor identified. At least I’ve heard all this is racist stereotype.

The tribe is all screaming JUSTICE, yet they have no idea what justice means, because to them, Chauvin is guilty and then the witch doctor……….

The MSM already tried this case in front of the public. Officer Chauvin was already found guilty of killing Floyd and the Judges already awarded Floyd’s family $27,000,000 (twenty seven million dollars) in compensation paid for by the non-grieving public denied a trial in a legal court by licensed lawyers and a sworn in Judge and 12 unbiased Jurors.
It is not legal to try a person twice for the same crime. Case closed. Either the MSM is guilty of practicing law without a license or the people of Minneapolis blackmailed the city $27 million in exchange for not burning down the entire city.
I’m sorry to say I can’t find it now so I guess it’d be appropriate to take this with a grain of salt. A month or so after Floyd OD’d, a retired Minneapolis cop posted an analysis of the video of the incident as well as the city’s police training materials. To net it out, everything Chauvin did was by the book. If the little angel had expired in the hospital no one would know his name and Chauvin would perhaps still be on duty.
Floyd died some 45 minutes after the EMT arrived!

Just heard a ridiculously untrue and inflammatory comment made by a radio DJ on my way home from work. He said, “this trial is not a trial to determine if Derek Chauvin is a murderer, this trial is a trial that will determine if Floyd is considered a human being” , good grief the vitriol surrounding this trial is so overt how can people not see the set up being made for more riots?
Race baiter Tariq Nasheed says on Twitter: “There has never been a case in the history of this country where a Black person murdered a white person on camera, and the Black person walked free. ”
Obviously the issue is whether there was even a murder by Chauvin. That’s what we’re having a trial about. A counter factual to Nasheed (black cop shooting unarmed white man) was the shooting of Dillon Taylor on 8/11/14 (two days after Michael Brown) by Salt Lake City officer Bron Cruz. There was body cam video that was made public and Cruz was never charged. Also, nobody burned down any cities.
Third prosecution witness is a 33 year old who has been on videos yelling at LE officers at scene of Floyd incident.
Testifying having background in community college level wrestling, martial arts training, MMA fighter at amateur and professional level. He claims to have trained LE, military members in local gym on hand to hand combat techniques.

In the military there is the concept of an illegal order stemming from illegal rules that are or should be obvious to a reasonable, moral, common man. That’s what Nuremberg established. That same consideration applies to anyone. Your departmental rules do not protect you from the law.

I don’t think the departmental rules should protect someone either. But it’s clear this officer was in fact following police regulation.
I don’t think we are going to agree that police are protected from unreasonable reflexive stupidity at all. After all, the Police Chief is going to testify AGAINST Chauvin. I am not sure what to make of that, after I starting looking at the very regulations and rules laid out for cops under his authority. I suspect the police chief is trying to save his own ass and deflect all the responsibility to chauvin.
Now, if we are to agree on some cases where police have acted criminally, I can show you a case where a cop shot a guy running away, like over a dozen times. THAT is criminal.
This one is a criminal case, but they will have to prove the cop had used unlawful force, exceeding the threat, and demonstrating excessive force THAT CAUSED THE DEATH.
in order to do that, and prove his guilt of these serious allegations, THE PROSECUTOR WILL HAVE TO LEAP OVER THE REALITY THIS GUY WAS PUMPED ON DEADLY DRUGS.
I don’t think the jury is going to do that. I don’t think a reasonable jury can form an objective fact based decision that leaps past the reality this floyd doper was full of junk and was just as likely to crash on the ride to the hoozgow. It’s very possible.
What we just saw on video is compelling if you don’t take into account the massive amount of dope.
In fact by the same videos, and cop cams, you can hear the cops talking about this issue. They were very aware of the peculiar behavior…they asked the man several times. Some have stated there is evidence that floyd “hooped” his drugs into his rectum to hide his drugs and not get caught with them….If so, that’s very dangerous…we don’t really know if that report is accurate and true yet. But we do know the tox report..and we know from oathed statements and also evidence collected he was junked up and also had “percoset” which wasn’t perc at all. It was meth and fentanyl disguised as perc…because you know…dopers like to conceal class 1 into class 2. There was also amounts of cocaine and MORPHINE in the tox reports. Just prior to arrest also reported floyd ate at least two of those perc tabs.
The jury is going to hear these facts. They have a duty to consider them carefully before laying the entire thing on the cop. As they should.
I harbor no reasons to mistrust the police as a general policy. I look at them just as I would anyone else in very difficult positions of responsibility: often, you find yourself in a situation where there are no clear and easy decisions. So you go with your training. You work it by the book. This cop seems to have worked it by the book in a very difficult situation where there was no easy decision to be made.
If the neck compress was so dangerous, one would expect no police department would ever consider making it a police power and regulation. Few are harmed with it, and it IS effective.
the contributing factors to this death are not these rules…but a drugged up criminal who was already a walking corpse….just one inch away from the worm bed.

I would argue your “version” of nuremberg calls that ANY German soldier should be held to account for any harm they caused. But that IS NOT WHAT nuremberg was about. If I was his attorney, I would call a witness who would use Officer Chauvin as an Exhibit . That witness will ask officer Chauvin to kneel on him or visa versa in the exact same manner , for the exact same time period and have him get up and walk back to his seat.
I would bet it has already been tested. Just not sure what would happen upon cross examination.

Also, putting 150 lbs onto 350 lbs doesn’t do anything to the 350 lbs. Putting 350 lbs on 150 lbs may create some damage to the 150 lbs.
All that said, he should have taken his knee off of him with all the people watching at that point. At the very least to quiet the crowd.
But that doesn’t equal murder. It equals a tragic accident casued by the deceased. He committed the crime. He resisted arrest. He asked to be placed on the ground. None of this happens without his actions.

When I first viewed the photo above that allegedly depicts Chauvin kneeling on Floyd’s neck, I commented that Chauvin was so callous to kneel on his kneck while keeping his hand casually in his pocket. My wife pointed out another video that showed the the officer had black gloves on that blended in to his paints. In addition, Chauvin can be seen getting up using his left leg to pull himself up and that the right leg was on Floyd’s shoulders. It appeared to me that his left leg was not on Floyd’s neck but place in a position to do so if the time came to stop Floyd. Have not seen the defense show this video in social media that I am aware of.
