The opponents and haters of President Trump are deep into symbolism. Expect the vote in the Senate to occur on or about March 15.
There is no court in the country that would allow this to happen.
If a civil litigant tried this, and was successful, the opposing party would file a writ/appeal to have the order rescinded. Here, however, there is no court to appeal to. None. A nice self-contained impeachment trial where the rules can change at any time, and the person on trial can do nothing abut it.
Four decades trying cases in federal courts and I have seen a lot. This situation, however, makes my head spin with all that is wrong with it. President Trump is still a citizen, right? Or did I miss that part of the trial?

It is being reported now that McCarthy is disclaiming the rumors about his telcon with the President and his recounting it to Rep. Buetler Herrera (R-WA). CNN apparently came out with that story yesterday and Raskin is using it as a basis to call her as a Zoom witness. .

Mitch McConnell and Majority Leader Chuck Schumer apparently agreed to a 51 vote threshold to call witnesses. This was a surprise to President Trump’s legal council. They were not appraised of this.
Impeachment Manager Raskin made the move to call a Republican hearsay witness, a newly elected Congresswoman Jaime Herrera Beutler ( R- Wa.).

Old, dying nursing home patients have no political voice. They don’t matter, in Cuomo’s political calculus.

What may be going on with the witness gambit:
The House knows it won’t get to 67 votes to impeach. So the next thing would be to bar Trump from future office under section 3 of the Fourteenth Amendment:
“No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”
The House couldn’t prove that Trump incited the rioters, but now is trying to say that once the riot started in the capitol, Trump’s failure to stop it became his participation in an insurrection.
The House (and Senate Dems) are also assuming that this ban only needs a majority vote. To remove the ban on political participation would require a 2/3 vote, which they know Trump would not be able to get.
Of course, the House does have the problem that Representative Jaime Herrera Beutler’s alleged conversation with Kevin McCarthy about an alleged conversation McCarthy had with Trump is double hearsay. To get it in, they would need to call McCarthy, and then say that Trump’s statement is an admission, which would be an exception to the hearsay rule. Not to mention Beutler has a problem in explaining why she waited until now to come forward. And whether McCarthy remembers the conversation the same way is another problem.

The argument they make rests on the assumption Trump had any power to stop the riot.
What was he supposed to do?
The failure to top the riot at its inception and afterwards is squarely on the Capitol PD and the decisions made before, during, and after it started. Perhaps this opens the door to the issue of who could have stopped it and why it was able to take place. That’s a door I would like to see opened.
Exactly. That would be the defense argument. The House may say that Trump should have “called” for the rioters to leave the capitol, but how would they have received the message? Were the rioters on a listserve? Were they watching television?
Criticizing the Capitol Police is tricky because some of them helped the members to safety, and one is getting the Congressional Medal of Honor.
I think the best bet would be to follow up on something Trump’s lawyer said yesterday: “What did Speaker Pelosi know and when did she know it?” and call her. The Capitol Police are under the jurisdiction of the Speaker, and if she had advance knowledge, then she enabled the insurrection by not having adequate security in place.
Also what did McConnell (and Shumer) know would be a big story. But no one will go there.

Technically the President did stop the “insurrection or riot or whatever” via the conduct of the Metro Police, Secret Service and Parks Service. The Capital was OPEN for business on 6 January and the congress convened to certify the election results.
Then there is this little detail that the 14th amendment only applies if the President is declared an insurrectionists in a court of law by a jury, as congress does not have the authority to conduct a judicial trial.
True, but the Dems and RINOs are desperate. This Impeachment gambit is flailing towards failure. Trump’s approval ratings are steady. He’s kept a low profile during this. They tried the spaghetti maneuver during the first part of the trial, but nothing stuck to get anywhere near 67 votes.

As I understand it, the Capitol is sacrosanct. No outside law enforcement can enter unless invited in by the Speaker of the House or perhaps the leadership of the Senate. Trump’s offer of additional security was vetoed by the Sergeant at Arms of the House because of “optics”. He has since been removed from duty by Pelosi. Both Pelosi and that man should be called as witnesses if they’re going down that road.
I would suspect the FBI knows exactly what went down and who was responsible. I also suspect it would be bad for the dems, therefore FBI won’t release any info because of “sourceess and methods”.
Insurrection will have to proven and President Trump found guilty of insurrection in a court of law, before the votes per the 14th amendment can take place. Congress does not have power to try a criminal case.
Plus, there is this little issue of Capital being re-opened for business on 6 January and congress convening to certify the election on the same day, as well.
Also good points for the defense. The congressional Democrats (and a few GOP RINOs) are just scrambling to find some way, some how, to bar Trump from future office.
With regard to the issue of hearsay, I suspect it may be a House maneuver to pressure Trump into testifying.
If McCarthy’s testimony tends to hurt Trump, the only other person (that we know of) who can testify to what Trump said was Trump himself.
Yes, they probably want to question Trump, but I doubt he’d do it. His lawyers have already challenged jurisdiction, so he can say he does not recognize this proceeding.

The purpose of calling witnesses is to drag out the trial…probably until the mid term election 🙂
1) There needs to be vote on simple majority basis to subpoena specific witnesses
2) If they vote to subpoena a witness, then trial will slow down dramatically. They will need to recess
3) Then after the deposition, the senate would need to set new guidelines on what do to with the testimony that derives from the witness.
