In a disappointing majority decision announced shortly before 6:30pm Friday evening, a majority of Supreme Court justices refused to take up a Texas lawsuit challenging four states in the 2020 election.
The court, with two dissenting options by Justice Alito and Justice Thomas, stated that Texas lacked a legal right to sue and did not have a legal interest in how other states carried out their elections.
The court rejected the Texas’ lawsuit without considering the specific merits of the state’s case.
Texas had asked the court to delay the official vote of the Electoral College, scheduled for Monday, Dec. 14, or prevent the four states from casting votes in the Electoral College for Biden. Justice Alito filed a short statement regarding the court’s disposition of the case and was joined by Justice Clarence Thomas.
The position of the Supreme Court raises an important question that now sits unresolved. If an individual citizen is determined not to have standing to challenge an election result; and if a group of citizens represented by their interest in a state, any state, is also denied standing to challenge an election result; then who can constitutionally challenge an election, any election, that is mired in controversy and demonstrable evidence of fraud?
From the Alliance:
- An individual voter does not have standing to sue for election misconduct. (He/she is only one person and everyone cannot sue all the time for all elections.)
- An official who may be adversely affected, cannot sue before an election in anticipation of bad conduct because it is speculative (not ripe)
- An official who was adversely affected, cannot sue after an election claiming bad conduct because it is too late (latches)
- A state does not have standing to sue on behalf of its citizens to remedy other states’ bad election conduct (no standing)
The result appears to be that no lawsuit involving the recent election cycle has been heard on the merits. Insofar as I am aware, the substance of misconduct claims have not been heard in court. (In fairness, there has been no decision on whether a state can sue itself for election misconduct.)
The U.S.S.C has created a constitutional right to abortion from emanations and penumbras. It has told us there is latitude to provide jobs and college admissions based on race or sex. The high court has created a constitutional right to burn the flag.
The Supreme Court, and other courts, have determined limits on constitutional rights to: free speech, bearing arms, freedom of assembly, religious worship, who can use which bathroom, whether the state can hang a murderer; whether men can compete in women’s sports; whether you can operate a restaurant, how hot your coffee can be, etc. ad nauseum.
However, when it comes to the citizen’s right to make sure his or her vote counts and is not nullified by corrupt and dishonest practices, the courts have decided that it is imperative they restrain themselves from taking a position on the merits.
They have thoughtfully informed us of constraints on them that no-one knew existed. The Friday ruling cites only a conclusion, but no reasoning.
If a state sues, is it not representing its citizens? Isn’t that, at the root, the only function of a state government? Are the citizens’ rights to an honest vote not affected if another state runs a bogus election and the first state’s votes become nullified?
Does a state not have standing to sue because the court anticipates it will not succeed on the merits? Why do courts ever bother to write legal opinions when they can save time and tell us the outcome they have in mind right away?
My untutored mind is having difficulty figuring out just who, and under what circumstances, has a legal right to a fair election.
It seems the current answer is: no-one.
I’ve said this before, forget about trying to wade into the minutea of the legal issues in these super high profile case (my God, the Supreme Court used the penumbra of rights under the 1st amendment to justify Federal protected abortion)…this is pure power politics…the outcome is determined by the desire of the majority block of the Court…the legal justification is just the means to the end (see Robert’s, John Obamacare tax)….the PROBLEM is the Conservative members never play hardball like the liberal members of the Court…that is, if they were conservatives in the first place or just “Federalists”, or if they are compromised, or bought off, or just plain cowards…since this sort of intimidation only comes one way from the swamp…THIS is why we keep getting these “sellout” decisions, NOT anything about the soundness or consistency of the legal arguments…pure power politics in which the Conservative justices are just 90 pound weakkings
Well if there is no standing for other states to complain how another state does there election business, then no state can challenge a state’s legislators from picking the electors they want.
It’s an esoteric argument that the SC cowardly chose to avoid…on one side, it can be argued that in isolation, PA etc actions didnt affect TX’s internal process of choosing their state electors (No standing)…on the other side, viewed as TX being 1 of 50 states in the Electoral College, TX rights are harmed when PA, etc. cheats (standing)…the SC should have heard evidence to determine which argument should prevail…but some of the justices are compromised by extra-judicial factors (mainly, McConnel and the Bushes)…yes, it’s disappointing and these new Trump appointees should wear a scarlet “C” for Cowards hence forth, but they still could have heard the case and still elected for the narrow view of standing… I think what’s disappointing is that we could have had a national hearing here where evidence of fraud was laid out for all the country to see OR a stay to stop the electors on the 14th…which is why the court cut this off at the knees, so we couldn’t see it, damned the precedent set now that there might not be Original Jurisdiction now where a state can challenge another state
That is true, but you can rest assured that some group or individual in that state would sue if the state chose electors not consistent with the popular vote. And the SCOTUS would damn well take that case, esp. if filed affirming a civil rights violation. That is the tactic Texas should have used. The suit should have alleged that minorities in Texas were disenfranchised by the illegal votes in the contested states. The case would have been accepted. Texas should refile.

The people you criticize, the “conservatives or just Federalists” are simply behaving as they do because there is no groundswell of citizens sufficient enough, nor has there been in the past, to force them them physically (heretofore unthinkable). force them psychologically (easy to do as long as citizens band together and study the tactics that research shows can accomplish this), force them socially to submit to our will.
We keep thinking always in terms of influencing them politically and professionally and sadly we seem always to limit our definition of “professionally” to their office-holding capacity or incapacity. All the evidence one needs to see our failures is to observe the behavior of the GOP members of state houses in the battleground states since the election.
My conclusion, brutalus1? It’s our fault. We’ve relied too much on one man, Donald Trump, while for many, many years we’ve witnessed the Left operating without even so much as a volley from us, much less any cannon strikes or nuclear missiles.
By not getting to the merits, the Court made it worse. As bad a decision in the annals as Dred Scott and Plessy.

I would agree with the Court if this were an election for Governor of GA. TX isn’t involved. And TX isn’t directly involved with the voting in GA on 11/3/2020. BUT–there is a second election in the Electoral College on the 14th, and this is why I would find that TX has standing. When GA violates Article III of the Constitution and chooses it’s electors through fraud, TX is directly harmed in the Electoral College. Fraudulent votes cast in the Electoral College vote are no different than fraudulent votes cast in polling places on 11/3. Those fraudulent votes disenfranchise the state of TX and its electors. This issue isn’t going away. Republican voters are not going to tolerate being disenfranchised, and the actions taken by the Democratic officials in these swing states DID violate Article III of the Constitution.
What is noted about the electoral college is extremely interesting.
From Article II, Section 1:
“The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President.”
A state would unquestionably be impacted by a compromise in the selection process of any of the electors in other states by fraud and so forth. How’s that for standing?

They dispensed of the Texas lawsuit instantly.
Accepting and arguing the case would have taken a long time and would have probably ended the same way.
Now there is time (before all the “deadlines”) for the other lawsuits to make their way to the SC.
The Texas lawsuit, coming out of nowhere, TBH, was a long shot from the beginning. If you look at the Alito and Thomas dissent, their words were not all that encouraging with regard to a Texas win.
It is not a disappointing decision, it is a devastating decision. We will eventually look back at this as a watershed event in a watershed moment in American history.
And today Trump is saying neither Barr or Durham will do anything about the Hunter Biden crimes which is really saying they will do nothing about the Chicom moves on the US. And his talk of what will happen when the next administration takes over tells me he doesn’t expect to serve in the next four years at all. I would argue, consistent with case law, wrt to national elections, particularly with non standard deadlines. whether by fraud or non malice intent creates injury. those that followed law are injured by irregular practices AND THOSE OBVIOUS RESULT EFFECTS made by those states that chose to ignore the deadline standards all others followed. it’s a very solid case! reminder:. millions of votes were counted well after deadlines used by other states. in no unambiguous manner has THAT action created the harm. it would be akin to allowing only a certain division of NFL teams to draw an extra innings,the fifth in order to qualify for playoffs when otherwise the standard 4 innings would have never created such a fraudulent means to qualify …no other teams were allowed the 5. only the four teams…only the 4 states

How are we supposed to win when not one court has allowed testimony or evidence?
There are several states where it has been shown, beyond reasonable doubt, that the election laws of the state were not followed faithfully, and/or that the conduct of the election was in violation of state law, federal law, and/or the Constitution of the United States or of the particular State.
There will probably be no opportunity to submit proof of this to a court, much less to a jury, where such court will grant any sort of relief. In the event some court grants relief, it will likely either be insufficient, or a higher court will reverse it. If any such case proceeds to the Supreme Court, it is unlikely that they will do anything contrary to what I set out below.
The Trump Campaign has been working within this reality from the start. They are coaching the legislatures of these states to help them understand their powers and duties in regard with the election of President of the United States. They are bringing evidence to prove the initial claim, above, to the legislatures.
The Electoral College will meet and vote on Monday. While the date is not set in the Constitution, the power to set the date is granted to Congress by the Constitution. Congress will not be changing the date.
These states, through the same executive who failed to properly effect the elections in their states in the first place, will assign slates of Electors pursuant to these tainted elections. Those Electors were essentially (if not actually) selected by the Biden Campaign, of course, and thus they are expected to vote for Biden.
The legislatures of the states have the plenary power to choose their Electors, period. It is probably too late for the legislatures of these states to choose any different slates of Electors, and to have them vote in the Electoral College, either on December 14 (not enough time) or later (too late per law, per Constitution).
It is not too late for the legislatures of these states to declare that the Electors who will vote/voted on December 14 are/were not chosen by the legislature, and thus are not/were not Electors, and that their votes are void.
It is important to note that no justification is needed whatsoever, except to satisfy any state laws surrounding Electors. In the case of Georgia, for example, our dirtbag Governor helpfully pointed out that under State Law, the Legislature cannot appoint Electors to circumvent the results of an election. However, Georgia law does not prevent the Legislature from voiding the appointment of Electors who were selected through an illegally-executed election.
The executive body of the State of Georgia failed to properly poll and canvas the will of the People of the State of Georgia, with regards to several various contests in general, and with regards to the selection of Electors for President and Vice President of the United States in particular.
Since the will of the People of the State of Georgia with regards to this contest cannot be known with surety, and since the will of the Georgia General Assembly was not faithfully and properly executed with regards to this contest, the Georgia General Assembly should resolve that any persons appointed as Electors under color of law in this contest were so selected unlawfully, their appointments void, and any participation in the Electoral College of such persons is void.

Find a Republican Gov. and or others in a swing state where a large urban county pulled this voter fraud
Have that Gov. or other person with a power of the purse to refuse to fund any state funding for that county and state that said county via its fraud vote has no standing any longer in the state.
Force the county of fraud to go to the courts and have the case that due to voter fraud they have been refused state funding of say School meals, or welfare and or unemployement funding.
Fix it so the fraud counties have to admit fraud to get funding.

This isn’t the case to lose your marbles over. There are numerous other cases that are weaving their way through the courts, including SCOTUS. The Texas case was a long shot and this outcome was predicted by many.
