Heading into an election season without the full complement of justices could prove to be a nightmare scenario. Nobody wants a split decision on the Supreme Court with the election in the balance.

Last week I saw a meme that hit me really hard. It was a picture of a newly born baby, just out of the womb, with arms outstretched and crying (why not? it’s cold and very unexpectedly bright out there!). The caption was, “Please don’t abort me. I promise I’ll be a good baby!”

I believe in the maternal instinct, and when a woman goes against that it destroys something in her soul. Already, Collins and Murkowski have come out and said they won’t vote BEFORE the election? Why? Well, in Collins case, it just makes her re-election effort that much more intense. Sherri, I was fascinated by your comments. Although I understand your comments, to some extent I think they were in part generational in your reaction. I was working during the start of Affirmative Action. As you recall “sex” was added as a criteria in 1967. Historically, it is part of my thinking on a well rounded work force. President Trump is a very successful business man from my generation. At least in some nook of his mind, Affirmative Action is probably part of his thinking.
To demonstrate generational thinking I will use my middle school grandson as an example. This summer we watched the first season of Perry Mason. It was made in 1957. Since it was the first time my grandson had ever seen the program he was sorting out the characters in his mind:

President Nixon originally envisioned affirmative action as affirmative outreach. It was supposed to identify minority candidates so they could qualify for under represented positions. This laudable goal quickly degenerated into quotas and timetables within the bureaucracies and courts. A policy of merit became a policy of color and status based outcomes. Fair enough, here goes.
You make a sound philosophical argument regarding the adoption; and one I agree with. What I have trouble with and find to be “weird” as I put it, is the foreign nature of the folks who you’ve described as having “little chance of grabbing the ring” that shes sought out. Foreign being the key; not race or ethnicity.
If I were one who had the means to (As she apparently does) extend that opportunity via adoption to such persons, it would be from the many, many Americans who are in that low-opportunity group, lets call it. Whether black from the inner-city, or white from Appalachia, or Indian from a western reservation, etc. there are plenty of Americans who deserve that chance in equal measure. I find it a core principle or citizens (I use that word for a reason) to help your fellow countrymen first. I find it strange to go out of your way to select someone from a foreign culture, with all that that attends. Being a practicing Catholic who keeps up with the Catholic “system” from Vatican on down, I am acutely aware of some of the programs and umm, let’s call it “factions” within our Church that follow and push for this type of thing.
In general, those factions are suspect to me and are usually, though not exclusively also ones that participate in other activities under the guise of what they think is Catholicism I find to be “anti-American”/anti-nationalist.
Secondly, and you may give me heat for this but I have no reservation in making this statement: With a job like hers the time must be demanding, and her husband’s job is also high-profile, big time (former USAttorney I believe and current big-shot firm partner?)….I have long days in my mid-level executive corporate job. I’m sure theirs are both certainly longer. I find it “weird” that people with such high-time commitment and demanding jobs would opt to have 7 children, both of their own making and adopting more. Money isn’t everything…I question if they are really giving the parenting effort I would expect given their professional time commitments, to each one of those children. With the good living them make, I’m sure they have the $ to farm it out, and I suspect (though again just suspect) that is what they do. That is weird to me.
Finally, one might counter that she follow her Catholic dogma in the most strict sense and does not engage in birth-control of any type thus the high number of children. OKAY- absolutely nothing wrong with that and I personally find that admirable. However, again, if you are one who makes that choice, then I question also making the choice to pursue such a time-demanding career for yourself, AND seek a partner who also has such a time-demanding career. The two lifestyles just don’t jive to me. Thus, I find those decisions made in tandem to be weird. Personally, I think children deserve a lot of time, love and effort from their parents while being raised, when at all possible. I know it is my priority, and my wife’s, and most other middle and upper-middle class parents and families I know both up north and here in the south, and out west. (I’ve lived in all but the mid-west region- though I can’t imagine it is much different there).
I used the term weirdo for a reason. None of this passes the “normal American life” test for me; and as I’ve outlined, even if grant that she has superlative morality and financial means, the choices still don’t reconcile for me. I’m not saying shes a bad person, or whatever. I just think we need more public servants who represent the mean of American lifestyle.

The problem is that if PT loses the election, the country is finished. It is very close, and the Dems will use thousands of fake mail-in ballots in battleground states. This SCOTUS pick can help PT win by manipulating the identity politics of many voters.
You play the hand you’re dealt. You make decisions in the world you live in, not in the world as it should be. You live to fight another day. Pick your old shibboleth.
The candidate need only be arguably in the same league as the best candidate on PT’s shortlist, no more. It’s sad, but it’s true.
This is a difficult counterargument to make, though, because very often sacrificing one’s principles for practical reasons turns out later to have been a mistake. (For example, PT could lose a few votes from conservatives by playing identity politics on this pick. And the pick could turn out to be a closet liberal years later. Etc.) But I don’t think this is one of those times.

Well now, I have no idea who will be President Trump’s nomination for the SC. I also have no idea when and how the vote to confirm in the Senate will go. But I don’t mind making some guesses based on current political winds.
My guess for Senate timing based on the past spinelessness of Senate Republicans and Democrat gas-lighting would be that they will hold contentious Judiciary Committee hearings that are prolonged by grandstanding, speechifying, and procedural objections along with the usual nasty insults and insinuations by Democrats. Anything to draw it out as Miss Lindsey says we have to get this done while allowing it to go on and on.
If we are lucky the Nominee will pass out of committee by a margin of 1 vote. But best bet for the feckless Senators would be to stop it there so the whole Senate would not be exposed by having to actually vote.
If it goes to the floor of the Senate it will drag out beyond the election. Why? Because that is the safest route for the feckless, spineless Senators. They can all have lots of heartfelt speechifying on both sides while waiting to see who wins the election. If PT wins then they’ll vote “yea” because he will have the political power. If Harris/Biden cheat their way in, they will vote “no” or just sit on the nomination.
That is the worst scenario for America and the American People, but the “easiest” way for Senators to claim all credit for “their sides” while taking no firm or actual leadership stand/responsibility–you know, being their usual irresponsible selves.

“Experience” on the Federal Bench, yeah like that “experience” made a difference with most of those already sitting on the bench today from Supreme Court to Local Courts. One is either a jurist per the constitution or not, out of law school. Experience has zero to do with that characteristic.
I’ll take a fresh law school graduate over 6 of the current justices, if that graduate rules by the law and does not plan to create law.
Kagan was never a state or federal judge before her confirmation. So that could thrown back into the Dems face if pursued.

The Supreme Court decides a lot more than abortion cases. As with Gorsuch, all the signs are there that Barrett is a leftist. She’ll vote to invalidate the death penalty in all circumstances and for open borders. Her views appear to mirror those of the current communist Pope, which is not a good sign at all. Terrible choice. Was her husband on board with the Haitian adoption or did she order him to accept it, like Gorsuch’s wife ordered him to renounce his religion and convert to hers? The Constitutional issue I would like to see brought by just one of these candidates is – “at what point after the moment of conception does the Federal government’s responsibility to protect the life of of that citizen start?”

The real reason for the spike in abortions is promiscuity promoted by Feminism as “empowerment”. All you hear about is “woman power” and somehow it is “powerful” for women to sleep around with as many “partners” as possible. This is what results in “unwanted” and “unplanned” pregnancy and the Left wants us to empathize with female promiscuity. They are “if men can do it why can’t women”. This is a bogus argument because two wrongs don’t make a right and it defies anthropology of women being the arbiters of sexual engagement. If you really want to see a decline in abortion then the Cultural Marxist promotion of sexual promiscuity must be addressed.
They never tell you the emotional toll it takes on women, who are convinced by these feminists, that the baby is a clump ob cells. I have many friends who got abortions in the 70s and 80s. When they got married and had children, their thoughts were consumed by the children they aborted. They could now see that they were their real live children from whom they took their life. That rememberence never leaves them unless they are a hard, cold sociopath.
My mother, who passed away almost 30 years ago now, got married at 18 to a man her mom told her to marry for his money. It took little time for my mom to realize she had made terrible decisions in both following her mother’s advice and in marrying someone she did not love.
Her marriage was annulled (or the process started) before she realized she was pregnant, and with no one sane in her life to help her, she listened to the voices of her employers — an older wealthy couple with today’s radical leftist ideologies — and had an illegal backstreet abortion.
I had known about the fact that my mom had been married once before marrying my dad, how that marriage had been a big mistake and how she had ended the life of my oldest sibling from an early age.
And I remember well how my mom sorrowfully cried over the baby she had killed long after her five other children had children of their own.

At this point, am wishing the President had not gone with the “pick a woman” idea.

There are many laws on the books that are unjust and just plain rights theft and crappy. I want a constitutional jurist on the bench to overturn those laws.
Amoral justice? That, SanJac is how we got in this mess to begin with. Our entire system of governance was based on the Biblical statutes. Property rights, sanctity of life, quiet enjoyment, personal (Popular) sovereignty, redress, assembly, family law- it’s all religion based: Christian Religion. Once the Moral Absolutes God established are removed we get what we have today- disaster.

The Catholic Church’s opposition to the death penalty places Catholic judges in a moral and legal bind. While these judges are obliged by oath, professional commitment, and the demands of citizenship to enforce the death penalty, they are also obliged to adhere to their church’s teaching on moral matters. Although the legal system has a solution for this dilemma by allowing the recusal of judges whose convictions keep them from doing their job, Catholic judges will want to sit whenever possible without acting immorally. However, litigants and the general public are entitled to impartial justice, which may be something a judge who is heedful of ecclesiastical pronouncements cannot dispense. Therefore, the authors argue, we need to know whether judges are legally disqualified from hearing cases that their consciences would let them decide. While mere identification of a judge as Catholic is not sufficient reason for recusal under federal law, the authors suggest that the moral impossibility of enforcing capital punishment in such cases as sentencing, enforcing jury recommendations, and affirming are in fact reasons for not participating.

I don’t know about Alito or Thomas, but Scalia was aware that he was defying the Catechism when it came to the death penalty. But he was committed to the Constitution AND he explicitly argued that the recent Church teaching was wrong and out of sync with traditional Church teachings on the issue. Some useful Catholic facts: the stance against the death penalty is new, is NOT dogma, and is NOT infallible papal teaching. Look up Scalia’s essay in First Things (early 00’s), and his exchanges with various theologians in the subsequent issues.
It is obvious the Barrett has neither the same depth of understanding on this issue or the fortitude to say clearly “I think recent popes have been wrong about this.” Oh well. At least she will be much better than RBG.
My real concern is with immigration.
imo the death penalty is a red herring. not enough people are currently executed to matter to the wider system of justice and history globally is running against the death penalty.
the trade off between the rights of individual citizens and the rights of the government, in a world of the wars on drugs and terrorism and this covid lockdown madness, seems crucial and of nearly universal application.
I think the Cuban judge would be a better choice…Cubans are very anti-communist….and she did not go to Harvard or Yale. KInd of tired of Catholic or Jewish Harvard or Yale graduates….they all belong to the same club.

Maybe because Catholic philosophy has roots in the fundamentals of classic thought of which western civilization was based. Not that only Catholics can claim it, but It doesn’t surprise me that the most accomplished Catholic thinkers would rise in American jurisprudence.
There was a big push from the rinos in the Republican Party to get the “religious right” out of their party. Bible reading, believing people, whose relationship is with God and not a church, are not as controllable. Churches can be infiltrated, but the heart that seeks God and His ways, are not.

Being Cuban and anticommuniste aren’t qualifications. Qualifications for higher court are how have they ruled in the past on interpreting the law and the constitution. One could be Cuban AND anticommuniste and have a horrid track record on judicial rulings.

The best option appears to be Diane Sykes of Wisconsin, but I need to do more reading. We can’t take any chances with another Justice Roberts on the court. If Louie Gohmert has nice things to say about a selection, that is enough for me. Her main downside for a lifetime appointment appears to be her age at 63.

I do wish people would pay closer attention to most everything in politics. The term Republican is more often than not widely misunderstood and very often wrongly given the champion lable of Conservatives. Republicans, the political class are not at all conservatives, their greedy nation building retards.

Mark Levin, whatever you might think of him, is an outstanding legal mind and an authority on Constitutional matters. He called Gorsuch the “gold standard” conservative judge; he also said Kavanaugh is a “risky bet.”
He calls Barrett a risky bet with only a very limited record to consider.
Robert Barnes, the conservative lawyer that took on the Covington/Nick Sandman case agrees with you – she (Barrett) hasn’t found a prosecutor she doesn’t side with, a corporation she doesn’t prefer, or a government action she doesn’t approve of. Bad rulings on takings, free speech, freedom of religion, freedom of association, discrimination, and misconduct.
