Keep in mind, the federal court ruling specifically centered around the arbitrary nature of the original mandate, which exceeded the scope of CDC legal authority, compounded by the CDC breaking its own rules for public feedback in the implementation.
The mandate created by Joe Biden did not have legal structure. It was a dictatorial fiat that exceeded the capacity of the executive branch to create.
Congress could easily write a law authorizing mechanisms for the CDC and TSA to use in enforcement of a federal Transportation mask mandate; but they won’t – because the public would never support it. So now, a political DOJ has to wait for a political CDC to determine whether they still have any currency of influence amid the politics of COVID.
I doubt the CDC will attempt to go through the process to legally reinstitute the mask mandate. The political science just doesn’t support it.
However, as with all things leftist, narcissistic and Covidian, the moonbat tribe evaluate their worth through the prism of how much they can force others to endure. So, there’s a possibility the religious leaders within the CDC Church of Big Pharma, may just decide to inflict more social damage.

The CDC has been wrong on everything covid since the beginning. And now President Bidet wants to give them the benefit of a doubt. This administration has declared war on the American people. We need to fight back.
If I have learned one thing over the years, it’s about court rulings and appeals. An appeal must be based on something incorrect in the original ruling or the proceeding.
While the obvious is “Trump appointed judge” that would be a difficult basis for appeal given that no objection to the presiding judge was expressed prior to the case being adjudicated…. as far as I know.
A viable basis for appeal is usually on a false or incorrect ruling on the matter and based on what I read, the ruling is very conclusive and is consistent with similar rulings against Biden’s regulatory overreach. There’s simply no room for re-interpretation though…. they may try.
I think trying to get it reinstated will only make the next election cycle even worse than it is now for Democrats.
My hope in all of this is that the US voter doesn’t soon forget the suffering we’ve all gone through because of Democrat policy. That’s a big hope because the consumer voter out there still has a problem with thinking and remembering. Wish it wasn’t true.

It’s a really bad time too. Summer time is when the airlines and travel destinations make their real money. This is why you see all the happy vids and outward expression from all the airlines. You will likely see all sorts of positive news out of the vacation industry over the next two weeks with people booking trips. You don’t get the incredible sense of joy from reading Sundance’s headline “The Madness is Over—Following TSA Response, Airlines Begin Announcing They Are Dropping Mask Mandates” only to have this Faux-Administration seeking to yank it away one day later. Freedom experienced, felt, or seen isn’t so easily relinquished.
An observation: in the evenings, we go sit out on the deck to observe the sunsets. Over the last 2 years, we’ve only seen three to five jets per day streaming across the evening skies. Yesterday evening after the Florida judge’s ruling, we counted 22 jet trails crisscrossing the skies. Coincidence? Or are people more willing to fly absent mask mandates? I say yes for our family. We previously flew a dozen or more times each year. But with mask and other Covid-related madness mandates in place, we haven’t flown anywhere over the last two years because we refused to be forced into wearing masks against our will. Verdict is still out if we will fly anywhere.
Me thinks it’s way past time to throw sand in the gears. Stand against bully tactics and exercise your God given right for freedom.

I think the White House is stalling just long enough to regenerate the hysteria of the plandemic. Once the courts become hysterical, there will be no problem finding one to overturn this decision. For the good of the nation, of course. There is no hope for a free country to survive a hysterical majority. This nonsense could go on until the next century as long as the majority are hysterically consumed by irrational fear. I wish I knew how to make this fear go away, just for the preservation of my own extended family. But when the herd is on the run, nobody cares what we are running from anymore.
