The U.S. Supreme Court has ruled against the state of New York and Governor Andrew Cuomo in a late night emergency ruling barring the state from reimposing limits on religious gatherings. [full pdf here]
In the 5-4 ruling the newest supreme court justice Amy Coney Barrett sided with the Catholic Diocese of Brooklyn, while justice John Roberts sides with the liberal justices in the minority, but seems to agree on the merits.
“Stemming the spread of COVID–19 is unquestionably a compelling interest, but it is hard to see how the challenged regulations can be regarded as ‘narrowly tailored,’” the court wrote in an unsigned opinion.
“They are far more restrictive than any COVID–related regulations that have previously come before the Court, much tighter than those adopted by many other jurisdictions hard-hit by the pandemic, and far more severe than has been shown to be required to prevent the spread of the virus at the applicants’ services.”

Roberts voting pattern is fascinating to me… in that obviously there is something going on with him behind the scenes. I hope all of us Americans learn the truth about Roberts and his votes. You don’t flip from all constitutional to all un-constitutional over your supreme court career without something or someone causing or forcing that to happen. I can understand a judge that bounces back and forth on a case by case basis (Kavanaugh), but I cannot understand a judge that literally just flips 180 degrees on every case put in front of him.
The former kind of justice you describe is one of principle, with the original intent of the Founders controlling the interpretation and enforcement of the Constitution rather than considerations of “conservatism” or “liberalism.”
The latter type typified by Roberts, Kagan, Sotomayor and Breyer is partisan rather than principled and uses goal-oriented decision making where the result is chosen and then legal support and analysis are twisted to fig the desired outcome.
When a judge has to write more than a few paragraphs to justify their decision you know that it’s convoluted law!

Bush appointees have all been disappointments. Not surprisingly. If we don’t get control of the SCOTUS, and soon, it is going to be the end of the republic. The founders were good, but giving lifetime appointments to corrupt federal judges was a yuge mistake. I know the reason why they did it, but they are still human with all the human frailties that we all have. And if the SCOTUS has to decide this election, I don’t have confidence that it will be decided in the country’s favor.
It doesn’t say anywhere in the constitution they are appointed for life. It says “during times of good behavior”. If we had a legislature that cared about the republic and had any moral code, they could take out these judges that rule outside the constitution, but, unfortunately, we don’t. The Supreme Court has done more damage to our country and our culture than any other institution, but the legislature sits on its thumbs for its own gravy train.

I don’t think it’s overthinking things to consider human nature: when legal books and even 12th grade government texts refer to SCOTUS by the name of the Chief Justice (ie, the Warren Court, the Burger Court, the Roberts Court, etc) it messes with one’s head. The CJ becomes much more concerned with the Court’s perceived place in history and with “his” guidance in the Courts place, both real and imagined, in history.

I think the conservative judges, at least, are starting to educate themselves on the facts surrounding the virus. I don’t think they perceive it as the overwhelming killer they were, at first, lead to believe.
It was that perception, a killer virus, which allowed them to think of ways to subordinate the Constitution to the will of individual governors who, they thought, were on the virus firing line.
The liberal judges still begin their arguments by referring to the the number of dead people presumably murdered by the virus. Roberts seems to be persuaded by that perception. A popular therefore, safe position.
The conservative judges are, also, now looking at the inconsistencies of the rules being applied by governors. It’s apparent, when they see these inconsistencies, they are not going to rule, reflexively, in favor of those inconsistencies on the basis that a supposed killer virus is on the loose.

Judges like Roberts do not really think there are any natural rights. Kagan was asked at her confirmation hearing if she agreed with the Declaration’s statement, that humans “are endowed by their Creator withe certain unalienable rights,” and all she would say was that language appeared in the Declaration.
In natural law, rights come before law. The law recognizes this and is only supposed to limit the rights to the extent agreed to.
In the utilitarian/progressive view, rights are limited amounts of freedom that the government chooses to grant you. The term for this legal school of thought is positive law, not that it’s upbeat or good, but that the rights came into existence when they were posited, or stated, by a government authority.
In natural law, you have the unalienable rights the minute you’re born simply by virtue of being human.
So it’s a question of what prevails in a conflict. In natural law, it’s the right as the default position, and any government restriction is viewed in the most critical way (“strict scrutiny”).
In positive law, the standard for government is much lower (even though Kagan and Roberts might mouth “strict scrutiny:). If the government has what it thinks is a good reason to restrict rights, well, the government gave you the rights in the first place, so it has the authority to scale them back if it sees fit.
Just like a parent can let an adolescent have a certain amount of freedom, but pull it back “for your own good” (which you lack the maturity/education/expertise to discern yourself). So “listen to the experts,” sheeple.

When members of SCOTUS rule in direct contradiction to the Constitution, as in this case and the PA case, they must be impeached.

And this is an honest question – who holds this governor accountable if he ignore the Supreme Court? Who enforces this all? If this governor ignores this ruling, what exactly happens? I know up in North Idaho here, (as an example) the local sheriff refused to enforce the mask mandate just passed by unelectable people on the local health dept. board. This board somehow has granted itself LOTS of power. Good on our sheriff for not enforcing and he said in an article, the Bonner County Sheriff’s Office is working “at maximum capacity on real crime and it cannot enforce the unenforceable mask rules.”
Let’s not get ahead of ourselves. You know, we continue to get surprises from “conservative” justices.
Scalia was a master at shredding the opposing arguments (even RBG’s, even though they were friends) with brilliant logic as well as wit. Alito can puncture the opposing arguments with some sharp arrows now and then, but Gorsuch appears to have the greater talent to take on Scalia’s smart, witty, trollmaster role.
Even though Roberst is CJ, when it comes to voting, he is one of nine. I wonder if he was annoyed that Gorsuch was not sufficiently deferential to the CJ. I sure hope so.
Roberts is the least impressive Justice of all, in my opinion. Roberts was acting childish at the Impeachment hearing.

I like to think that a consensus among the five in this majority is beginning to form. They may all not have the same conservative version of lock-step kind of philoosphy the liberals do, but if there is a core set of principles on the Constitution, whether one calls is textualism, originalism or whatever, that all five adhere to, this bodes well O’Connor, Kennedy and Roberts were all weak flip-floppers, and that made them swing votes.
If these five don’t swing in future cases, that will be the president’s greatest legacy.
It seems that with these writings/opinions from our side, our side feels they are a good solid team of 5. They feel freer to write rather pointed arguments to the other side without fear they may offend set decorum or jeopardize a tenuous working relationship. The 5 seems quite solid which makes me rather confident for the election cases to come.
SCOTUS is in great danger from President elect Jill Biden. Thomas is getting older. One Biden Justice gives them 5:4 again.
Roberts will vote with the Statist left and can be considered lost on important votes.

I applaud the ruling by SCOTUS the decision shows thst there at least five people with power in high places in America who are not bought and paid for instruments of the billionaire oligarchs who have been ruling in the USA since the 1960s. Interestingly the Catholic church service restrictions are technically imposed by bishops who have vigorous supporters of church closures and daconian congregation restrictions. The Bishop of Brooklyn NY is fed up and is pushing back against Cuomo and Agenda 21. Almost all other Catholic bishops in America are like the Pope members of the globohomo mafia and enthusiastic supports of Covid lock down rules.

What does it mean when Gov Cuomo says he will ignore SCOTUS? If NYPD cops under Cuomo orders arrest priest and worshippers in Brooklyn who are in compliance with SCOTUS Bishops of Brooklyn should complain to US Marshalls in Eastern District of NY (Brooklyn) that NYC cops are violating the federal civil rights of American citizens in their federal district. Marshalls should arrest every NYC cop who participates in these raids on religious people. Nuremberg trails gave fair warning to our very overpaid cops that following orders is not a legal excuse from personal criminal prosecution.
I think he’s saying it’s irrelevant because the limits had been changed on these houses of worship by the time the case got to SCOTUS, so it didn’t matter what the Court said.
However, the limits could go back in place if COVID went up dramatically, but I doubt even Cuomo would be stupid enough to single out houses of worship then.
The broader implications are in other states (e.g., Nevada) in which the houses of worship were singled out, and they got a 4-4 split when they went to SCOTUS. The majority in this case pretty much laid out the markers on what at state had to show to single out houses of worship for stricter limits than commercial establishments, and it’s a very high bar for the states.
Cuomo by his statement is saying he is above the law and is the higher authority, not the Supreme Court. He wants to continue to rule by intimidation and fiat.
He’s an arrogant POS People of NY State needs to rise up against him.

Gorsuch also accused Roberts of “a serious rewriting of history” for now insisting that his May opinion did not rely on a century-old Supreme Court precedent that allowed mandatory smallpox vaccinations in Massachusetts.
“We may not shelter in place when the Constitution is under attack. Things never go well when we do,” Gorsuch warned.

I wonder if part of Roberts’ venting is the realization that he is now irrelevant if he stays with the liberals on the Court. He can write dissents, but they have no precedential value.
If he votes with the conservatives, he can assign the opinion (or write it himself), but if he writes something wobbly, the other five may write their own 5-person concurrence. (Example: Roberts wants to reverse for reasons A & B, but the five want to reverse for reasons C & D. C& D are the precedent).
He’s too spineless to be a swing vote like Kennedy, and likes to hide in a 6-3 majority. (In the Obamacare vote, he reportedly tried very hard to get Kennedy to vote with the majority, but Kennedy, who had a libertarian streak, refused to affirm a law requiring people to buy something).
Now he can write venting dissents, while consitutional law moves closer to the Framers’ intent.

I have no question about why these faith leaders have caved so quickly. They’re most feel good preachers who eschew the fire and brimstone of the Bible which they view disdainfully. Many are the false prophets we’ve been warned about. And of course there is the greed and love of money that beholds so many of these faith leaders. They’re terrified of losing their tax exempt status and go along with whatever the government does so they can keep the tax free money rolling in.
