I have an accountant. He worked for Spectors firm in Philly. He comes o my house and collects my tax data to do at his house. I’ve known him for years, always thought he was a conservative. He’s close friends with an attorney I had who was very very conservative. Sadly he’s no longer my attorney, he’s an appellate judge in Jersey where I live.

Well, the article doesn’t say that any delay for any reason favors the President. It just lays out the Constitutional provisions and says that, if when the VP counts the electors’ votes, the result is that neither candidate has 270, then it goes to the House to vote on a one-state-one-vote basis. Which, because there are more R states than D states, presumes Trump would be elected. This assumes Rs will vote for Trump and does not account for the possibility of RINOs deserting.
The article does NOT say that delays for other reasons favor Trump. A phony commission, chaired by untrustworthy snake Cruz, could drag things out for ten days to GIVE THE APPEARANCE of conducting a fair and impartial audit, but then could come back and say “sorry, we looked and there was no fraud” and then VP Pence has no basis for not counting the Biden electors.
This is an elaborate trick to disenfranchise Trump supporters once again. They were hoping to ram the fake election through STAT with the help of the MSM and RINOs like Laura Ingraham and many pols saying Trump should concede.
That didn’t work and now, faced with the prospect of a million angry Patriots descending on Washington for Jan 6, they’re desperately looking for a way to undermine us and push this off for 10 days, then force through a fraudulent election result.

I disagree and believe that this could work. It gives us time to persuade the state legislatures to do their jobs. Even with overwhelming evidence of fraud, legislatures have not decertified results in their states. Momentum is moving in our direction but it is an uphill battle. Every state that is in question has a Republican majority legislature. They have note even been able to call themselves in session believing that they have to wait for a governor or some rule to do it for them. They are under intense pressure from the Uniparty to do nothing.
Based upon my understanding of the Constitution, that is where the authority lies. Not in Congress. Once one state decertifies or recertifies with Trump electors, others will follow. Seven states have dueling electors. If the states do as they should, one of two things happen. Either Trump has enough electors to win or neither candidate has enough which is when the contingent election comes in play.
So I don’t see this as a head fake. I see it as a play for time. I am not sure if a commission is constitutional however or if a vote needs taken how that will go with the Rinos. The ideal scenario is for states to decertify by Wednesday.
Trump won by an UNPRECEDENTED LANDSLIDE, with far more votes than any President in history.
If this plays out “legislatively”, or “judicially”, without that PRIMARY TRUTH not being acknowledged as DEFINITIVE JUDGMENT, …then they have thrown away the bedrock of the nation.

It would surely further expose the massive cheating, IF (and this is a big IF) the audit is done deep enough and with all necessary measures for accuracy (compare signatures, examine paper ballots to identify fraudulent ones like in Georgia, etc.). It’s likely a lot of ballots will be thrown out or found now missing (destroyed by shredders which is illegal). With a new total it could very well swing these states to certify electors for President Trump.

In reviewing this article, it still creates a massive hurdle toward getting these corrupted state’s electors denied. No way a majority of the House votes to invalidate a state’s electors for Sloppy Joe. Apparently Pence cannot, within his own power, throw out a state’s electors.
That leaves the situation back into the hands of the state legislatures, who needed to act before January 6th. The contested states placed an alternate set of electors in place for Trump, yet those states verified for the illegitimate Biden ones. Does this enable Pence to choose the alternate set of electors? How does that play into this scenario? It was PDJT’s team that asked for the alternative slate of electors.
As I understand it, firstly it moves the goal posts, forward at least 10 days (assuming the Cruz motion is adopted).
The hard deadline is Inaugeration day, I guess.
So, 10 days to conduct an audit/investigation, if they look, (seriously) we know what they will find.
They give their report to each States legislatures, and either make it public, or a MAGA legislator leaks it.
Now, there is an OFFICIAL report of the Steal, media can’t suppress, and enormous public pressure on the Legislatures.
They call Special Session, Govenor be damned, or Govenor calls.
They vote to rescind the Biden electors, and affirm Trump ones, or they notify Congress their states election was so tainted they can not certify ANY electors (unlikely, IMHO, but possible).
Constitution clearly puts it on State legislatures, first and formost. Remember they COULD, and at one time some States did “conduct the state election” by having the legislature vote, no citisens voting for POTUS, at all.
This may get around the roadblock of legislatures calling themselves in session.

Conservatives and news mavens are aware of the election fraud, but many US citizens get news from MSM. Those people have been told Trump is trying to overthrow the results of an honest election and all the courts rejected the evidence. Many people still do not know SCOTUS did not rule on the evidence. So this article again raises the potential conflict between the Electoral Count Act and the 12th Amendment. This is essentially what Louie Gohmert was trying to get at as well in his suit and potentially he went about it the wrong way – that I don’t know.
But both these lawyers, one being the brilliant John Yoo, and another impressive attorney – Mario Apuzzo – quoted earlier by a commenter, contend the ECA does not really address the present situation and/or it is unconstitutional.
The ECA purports to amend the 12th Amendment and Mario Apuzzo makes the case an act of Congress cannot amend a Constitutional Amendment.

If I was VP Pence I would say that only electors certified by the State Legislature will be counted, and state we will adjourn to count Jan 19th. Drop the gavel and leave.
This is an ideal solution. A variant would be: since these 6-7 states are in dispute, their competing electors will not be counted until duly certified by their states legislators within 10 days.
and any state that attempts to certify fraudulent electoral votes will be charged accordingly and it’s vote deemed invalid.
Of course two of the guys the President has kept closest to him are small market guys who weren’t senators, didn’t spend that much time in congress, didn’t get rich, have law degrees and were Tea Party members. And they’re both what liberals dread – Evangelical Christians.

So what good does an audit do?

To reject the state’s electors requires a majority vote in both houses of Congress; that’s not happening. It wouldn’t happen in the Senate alone. Does the Vice President, in his capacity as President of the Senate, have the authority to reject any ‘certified’ slates of Electors? The Constitution is silent on this point; the Joint Session of the Congress has no legislative authority; it is simply assembled to count the electoral votes submitted by the States.
The estimable Louis Gohmert of Texas thinks the Vice President does have such authority, but there is no agreement on this point. I think a case can be made that Rep. Gohmert is right, and the VP with the gavel has implicit authority to rule in disputes. So far Mr Pence has said only that objections by House and Senate members can and should be entertained. The Elections Law of 1887 (?) provides for the two bodies to adjourn and consider objections raised in separate sessions, with limited time (just five minutes per member, and two hours per objection). Since the Democrats have the majority in the House, no anti-Democrat objections will pass, so the process will be a wasted exercise for Trump partisans.
The real question is whether the Vice President can consider the competing slates of Electors from seven States, sent by groups of State Legislators but not ‘certified’ by the Legislatures as such. And if he can consider these competing slates, what should he do about them?
I think it unlikely he will summarily reject the ‘certified’ slates in favor of the competing slates: the political consequences would be too great. However, there are two options that the Vice President can take that will at least have the appearance of fair play:
(a) he can reject both slates from the seven States, on grounds that he cannot decide between them, in which case the candidate having the whole majority of the remaining Electors becomes President (likely to be Mr Trump);
(b) postpone the Electoral-vote count, and send the competing slates back to the States with instructions for them to return with a single, agreed-upon slate within, say, 10 days. This is likely to be the safest route politically. It might stiffen the spines of the State Legislatures, and get them to decide for the President. But it could fail, too.
I’m hoping Mr Pence will choose option (a), and I suggest everyone write and urge him to do so, as a Patriot and man of honor.

THIS, I believe, in combination with the ordered 10 day audit (with very specific conditions and requirements), could result in state legislatures certifying Trump electors. The pressure is put back on them, along with a federal order to audit beyond a simple recount of fraudulent ballots (throw those out and correct all errors associated with machine manipulation). Lastly, vast numbers of patriots should protest at state capitals every day to remind their representatives whose in charge.
I THINK the Biden electors votes WERE certified, in Az by the SOS, Govenor and (here I am not absolutely sure) Legislature.
Thats why it is the State legislatures that need to rescind that certification, and certify the Trump electoral ballots.
SoS certifies to Gov. who then certifies to State Legislature, who then certifies to Congress.
But, the only one with relevance is State legislature to Congress.

The constitution compels the President of the Senate to open all the certificates (certified electoral votes) and count them in the presence of the House and Senate. The competing electors are not certified and cannot be counted because each one of them will cause the count to exceed the whole number of Representatives and Senators.
The only thing Pence can do is to not count on January 6 and have the legislatures of PA WI MI GA and AZ withdraw their certifications for Biden and sent new certificates before January 20. There is nothing anyone can do to stop Biden from being inaugurated except for those legislatures. The Congress can debate all they want about the fraud but as long as the certified votes arrived sealed to the VP, they have to be opened and counted.
Yes, ‘certifications’ are the sticking point. I presume that the groups of rebel legislators have ‘certified’ their own ballots, signed and sealed. So then it is up to Mr Pence to decide whether to accept only the ‘official’ ballots, or the ‘unofficial’ ones, or none. I think he could just not count any from those states, but just postponing the final count would be safer, politically. If he gives in and counts the ‘official’ ballots from the seven states, then any challenges will be pro forma and pointless, since no Democrats in the House will change.
BTW, word is the the Turtle is offering a $2,000 amendment to the ‘stimulus’ if all the Republicans will refrain from challenging the vote on the 6th—more a Weasel than a Turtle!

Before being too hard on Pence, recognize that he is like most Christian conservatives in that he has been taught that being Christian means being a law abiding citizen. This was also Jeff Sessions and many other disappointing leaders’ downfall during the Trump administration. In many instances Christian conservatives have replaced God’s with the law if the land. This is a fake morality and partly why we find ourselves in this place in history. IMHO this is why we have people celebrating adherence to process even when the process is directly against the spirit behind that process. Then, when things fall apart as the must when doing nothing is celebrated as upholding process, it can be said, “We did our best.” These people have a seared conscious while maintaining a facade of saintliness. Peter Navarro just said that January 20 is not a deadline for swearing in a new President. Read the 20th Amendment, Paragraph 3, specifically. Jan. 20 is the end of the term for the current Pres and VP only:
1.The terms of the President and Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.
2. The Congress shall assemble at least once in every year, and such meeting shall begin at noon on the 3d day of January, unless they shall by law appoint a different day.
3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.
Pence was a six-term congressman from a super conservative part of Indiana. Prior to that he had a radio show where he referred to himself as Rush Limbaugh on decaf. He challenged Boehner for minority leader and lost. He opposed multiple Bush-era policies such as No Child Left Behind. He was ranked as the most conservative VP candidate in the last 40 years when selected by Trump as his running mate.
If he’s a Bushite, he’s done a really good job of hiding it.

Really getting tired of people bashing the VP over what he is going to do. Nobody knows that and frankly, enough with the “I don’t trust Pence” comments.

The only reason for that statement is that Pence will not open the envelopes and count them on January 6th in order to give the PA WI MI GA and AZ legislators the opportunity to withdraw their certifications. If he intends to in fact count, then he’s pulling a Lindsey Graham by calling for airing of grievances for show then going back to doing nothing. Once Pence opens the votes they all must be counted in front of the House and Senate. The constitution does not give him the option of not counting certified votes.
