Judicial Chess – Texas Judge Strikes Down DOJ Request To Lift Hold On President Obama Executive Action on Immigration Enforcement…

Two judicial rulings yesterday, one in Obama’s favor and one against. However, the ruling released late last night shows a crafty piece of judicial chess.

The first ruling yesterday was a 5th Circuit Court of Appeals decision in Mississippi VS DHS (more here). The 5th circuit ruled against the State of Mississippi, and in favor of the Obama DOJ, by essentially ruling the State failed to prove a burden of harm.

The second aspect inherent within the same 5th CCA ruling disregarded concerns of ICE/DHS retaliation -against border patrol enforcement- by asserting DHS rules forbid the retaliation; ergo the concerns were unfounded.

In the second issue, the ICE agents’ argument that they would receive retribution if they detained an illegal immigrant eligible for DACA, the court sided with ICE and DHS referencing handbooks and rules which forbid the administration from retribution.  (link)

justice_scalesHowever, in the second case, the ruling late last night, Texas vs DHS, under the authority of Judge Andrew Hanen, the expanded Obama Executive Action was blocked from implementation in February.

Judge Hanen issued an emergency injunction stopping the expanded deferment authorization as  outlined in President Obama’s November 2014 executive action.

Since the initial ruling the DOJ was now arguing for a lifting of that injunction, and Judge Hanen was having none of it.

A significant statement from Judge Hanen toward the DOJ attorneys was his admonishment for their prior misrepresentations to the court regarding implementation taking place.  The DOJ had previously stated in court that DHS was not implementing the new “expanded executive action” yet, and any injunction would stop any adverse action.

It was later discovered –by an admission to the court– that DHS had, in actuality, already begun to implement the November “executive action”. Judge Hanen was understandably angered by the misrepresentation. (more…)

Fitting Irony – Maya Angelou USPS Stamp Features Stolen Quote Not Actually Hers….

In an irony befitting only a rabid President Obama supporter, the USPS is releasing a stamp to honor Maya Angelou. The only problem is the quote accompanying the image of Mrs. Angelou is not actually hers – it’s a fraud.

The stamp features the quote: “A bird doesn’t sing because it has an answer, it sings because it has a song.” Apparently the USPS was trying to highlight a 1969 book authored by Angelou titled “I know why the caged bird sings“.

But the actual quote does not belong to Angelou. The quotation on the stamp is from “A Cup of Sun”, a 1967 poetry collection by children’s author Joan Walsh Anglund. When Anglund was contacted by the Washington Post she admitted the quotation was actually from her own writing, and not from Maya Angelou. (more…)

Saved By A Handler – President Obama Begins Attacking Christians During Prayer Breakfast – Stops, Pauses, Rethinks and Pulls Back….

A very interesting exchange during the White House prayer breakfast. [Video @:30] President Obama veers off prepared remarks and begins to malign Christians. Someone in the audience notices and quickly says something catching the President’s attention and interrupting his delivery.

(Transcript via Mediaite) “On Easter, I do reflect on the fact that as a Christian, I am supposed to love,” Obama said. “And I have to say that sometimes when I listen to less-than-loving expressions by Christians, I get concerned.” As the crowd began to murmur, the president backed off, saying, “But that’s a topic for another day.”

“I was about to veer off,” he explained. “I’m pulling it back.”

Obama Administration Wins Immigration Court Battle – Mississippi VS U.S. Dept. of Homeland Security…

ObamaDearLeaderThe Fifth District Court of Appeals upheld the dismissal of a lawsuit against an Obama administration DACA program – delaying deportations of illegal aliens who came to the U.S. as children. This is a different case than the challenge as to whether President Obama’s expanded immigration executive actions can proceed.

In today’s decision the court ruled plaintiffs’, the state of Mississippi and agents from Immigration and Customs Enforcement (ICE), did not provide enough evidence to prove they were harmed by the 2012 Deferred Action for Childhood Arrivals (DACA) program that allows qualifying illegal immigrants to apply for work permits. California Begins Construction of Water Stasi – Ministry for State Water Security Creating Program For Neighbors To Turn-In Other Neighbors….

Dear Citizens of Kalifornia, Comrade Governor Jerry Brown has signed emergency power authority to control water use due to an excessive drought in the state.  Part of that alarming reality was an admission by Governor Brown that citizens would be fined heavily for taking too long a shower.

Many non-California readers responded to the news with questions about how California was going to be able to enforce the length of a shower, or the use of water within the construct of personal activity taking place in the privacy of a citizen’s home.

Today some clarity begins to emerge.

California is currently creating a program for neighbors to turn-in other neighbors who are deemed to be in violation of the State Water use emergency laws.  (more…)

Against the backdrop of the Rolling Stone false UVA rape story – an author at the New Republic argues the problem with conservatives is their desire to find the truth behind events.

This horrible tendency to find the truth diminishes the message needed by a collective narrative; which is ultimately dependent on accepting the story regardless of merit….

New Republic […] The right, on the other hand, tends to understand politics on the individual level, which fits in neatly with a general obsession with the capital-i Individual. Thus, the right tends to pore over the specific details of high-profile cases like those of Trayvon Martin and Michael Brown, concluding that if those particular situations were embattled by complications or mitigating factors, then the phenomena they’re meant to represent must not be real either. Washington State Governor Jay Inslee Flies Communist Flag Over State Capitol – Someone Actually Thought This Was A Good Idea ?

Just U-N-B-E-L-I-E-V-A-B-L-E !!  (HatTip Gateway Pundit)   In “honor” of his meeting with China Ambassador Cui Tiankai, Washington Governor Jay Inslee has posted the Chinese flag between the American flag and the state flag at the capitol building in Olympia.

Hat Tip State Rep. Elizabeth Scott  On Saturday – A small group of people arrived at the capitol in the morning and removed the Communist flag.

They were assisted by an officer from the Washington State Police.

Harry Reid Beaten By His Brother Larry ?…

This is interesting. Against the backdrop of Larry Reid being arrested for being drunk and disorderly -he also hit a cop- an interesting side story comes to the surface about Senator Harry Reid’s previous injuries.

The Daily Mail covers the story of Larry Reid’s arrest. […] Senator Harry Reid’s 73-year-old brother has been arrested and charged with driving drunk and hitting a police officer.

Larry ReidLarry Reid was arrested for DUI about 12:40 p.m. between Boulder City and Searchlight in Nevada.

Mr. Reid was also charged with battery of a police officer, driving across a median, resisting arrest, not wearing a seat belt and possession of a gun while under the influence of alcohol.

A trooper saw Larry Reid’s Lexus SUV in the dirt median with the engine still running, Patrol spokesman Trooper Loy Hixson said.

The Nevada Senator’s office released a statement confirming that Larry Reid is the Democrat’s brother, saying only that it is ‘a private matter.’ (read more)

EARLIER: According to CNN’s Brian Stelter Rolling Stone will be releasing the results of a Columbia Grad School journalism audit tonight. In addition the lying Rolling Stone author of the UVA hit piece, Sabrina Rubin Erdely, is also anticipated to apologize for her false story.

[…] So as questions have swirled over how the botched story made it to print, there has been virtually no explanation from the author of the piece.

But that is expected to change Sunday night, when Columbia University’s graduate school of journalism releases findings from its independent review of Rolling Stone’s debacle.
