(VIA Fox News) – A federal judge tossed criminal charges against two former FBI officials accused of lying to Congress about the Hunter Biden investigation Monday, delivering a blistering rebuke of the prosecution and accusing the Trump administration’s Justice Department of weaponizing the justice system.
U.S. Magistrate Judge Zia Faruqui dismissed the criminal complaint against former FBI officials Nikki Cole Floris and Bradley Benavides from the bench, sharply criticizing the government’s handling of the prosecution.
“What has transpired here cannot be described as anything other than weaponization,” Faruqui said, describing the case as a “rush job” directed by President Donald Trump and FBI Director Kash Patel.

The GOPe controlled Congress could vote on a resolution and finding that these biased judges are not serving with “good Behavior’ and instead have acted with bad behavior, by majority vote.

Magistrates are not life-time appointments. They are appointed to terms under 28USC631:
“(i) Removal of a magistrate judge during the term for which he is appointed shall be only for incompetency, misconduct, neglect of duty, or physical or mental disability, but a magistrate judge’s office shall be terminated if the conference determines that the services performed by his office are no longer needed. Removal shall be by the judges of the district court for the judicial district in which the magistrate judge serves; where there is more than one judge of a district court, removal shall not occur unless a majority of all the judges of such court concur in the order of removal; and when there is a tie vote of the judges of the district court on the question of the removal or retention in office of a magistrate judge, then removal shall be only by a concurrence of a majority of all the judges of the council. In the case of a magistrate judge appointed under the third sentence of subsection (a) of this section, removal shall not occur unless a majority of all the judges of the appointing district courts concur in the order of removal; and where there is a tie vote on the question of the removal or retention in office of a magistrate judge, then removal shall be only by a concurrence of a majority of all the judges of the council or councils. Before any order or removal shall be entered, a full specification of the charges shall be furnished to the magistrate judge, and he shall be accorded by the judge or judges of the removing court, courts, council, or councils an opportunity to be heard on the charges.”
The dismissal does not stop the Justice Department from seeking a grand jury indictment. The ruling is nonetheless a significant setback for the department, which has had trouble getting grand juries in the nation’s capital to indict in politically charged cases.

does not in any way prevent DOJ from moving forward with an indictment. Whether or not this first pass was “a rush job” is the opinion of this obvious defect of a judge. DOJ has to renew it’s effort in this case and use all available means to get the evidence to a grand jury and then file criminal charges on that basis.
It’s worth noting this judge did NOT weight the merits of the evidence. He simply dismissed the case as a matter of “weaponization”, which is a predictable and wrong way to to describe the filing. Anyone who looks at the testimonies under oath and compares to the recently released internal communications can easily see that a crime of perjury was committed before Congress, under oath. A criminal violation.
