DOJ/FBI then moves to investigate and collect evidence (that has been done). Then DOJ decides to bring the case (that has been done).
but there is a twist. Apparently DOJ did not present the evidence to a grand jury. Not necessarily required, but this judge mentions that as a reason for dismissal (and included his own opinion that DOJ has weaponized the case pointing to the timing…midterms ).
it’s nuts, but not the end of this case. DOJ can and probably will form a grand jury, present the evidence and refile on that basis. Whether this same judge is involved in that forthcoming case is yet to be determined. I just don’t know enough about how these kinds of decisions are made, or is another magistrate is assigned to the case when it is presented along with grand jury results.
what will be interesting is what this judge (if he is assigned to that future case) may say when he receives the case again AFTER MIDTERMS. So, it’s going to be interesting how he fumbles for reasons to reject the case going forward to trial, no longer having the excuse that it is a so called blatant political weaponization.
at some point there has to be a judge that will hear the evidence and weigh the merits. Because we all have. next, we will have to predict that this judge will again revisit the issue of intent. Which is crazy when you consider that the evidence (internal communications) shows they were intentionally pretending not to know certain things…lied to Congress. So the intent issue is probably going to have to at least be provable to a grand jury in order to have the case as close to air tight against this corrupt judge..or others like him that are certain to want to protect corruption at the FBI, which is to say, they don’t want to be seen as acting against a former president’s son, and the party he represents…their own party.

It became very apparent why our judicial system is a liberal/activist as it is.
