Actually, it is a calculated risk about picking your poison: If indeed he has a valid pardon, then invoking the Fifth Amendment and refusing to testify about matters that are covered by the pardon (for which he can’t be prosecuted) could, and probably will, result in a Contempt of Congress charge. That is a Federal Misdemeanor, for which he could get a fine of up to $100,000.00, and imprisonment up to 12 months (assuming of course a DC jury convicts him). On the other hand, if he opens his mouth and answers any questions, (and you know the Committee’s staff has all the receipts), then he is walking into a perjury trap for almost each and every question. His pardon can’t protect him from future crimes! Committing perjury before Congress is a Federal Felony, for which he could be imprisoned for up to 5 years and fined up to $250,000.00.

Because Fauci is refusing to answer any questions in today’s hearing, the only way to get to the truth is for Congress to send a “criminal referral” over to the Department of Justice seeking a criminal indictment of Fauci.
Fauci might have been able to avoid that, if he had come forward with the truth today. Instead, this is likely to end up the same way the Menendez trial did, with a criminal trial and conviction.

OPTION ONE:
His lawyers have never heard of Brown v. Walker.
A first-year law student could find it with a search bar and a working pulse, but sure.
Maybe the whole firm has a leak in the think tank.
Maybe they were all out sick the week they covered the Fifth Amendment, which is only, you know, the one their client just invoked over a hundred times.
I do not believe this. Neither do you.
OPTION TWO:
They know exactly what Brown v. Walker says, and they are doing it anyway as a delay tactic — betting that a contempt fight takes years, that courts move like molasses in January, and that an 85-year-old man can run out the clock.
This is cynical.
It is also plausible.
It also, conveniently, requires him to say nothing that could ever be checked against 1,100 pages of his own handwriting.
OPTION THREE — and this is the one that should stop you cold:
THEY DO NOT BELIEVE THE PARDON WILL HOLD.
Because if you actually trusted that piece of paper, you would not need the Fifth.
You would walk in, answer everything, dare them to charge you, and wave the pardon like a hall pass. Innocence is loud.
Confidence is loud. Immunity is REALLY loud.
Silence is what you buy when you are not sure the receipt is good.

Here is why the contempt vote Rand Paul scheduled for August 5 matters more than the hearing did, and why I suspect Fauci’s team is not sleeping well.
A VALID assertion of the Fifth Amendment is a complete defense to a contempt of Congress charge.
You cannot be punished for exercising a right you actually possess.
An INVALID assertion is not a defense at all.
It is simply a refusal to answer a lawful question, which is precisely what the contempt statute exists to punish.
So the contempt proceeding does not just posture.
It puts the question on a docket.
And to defeat it, Fauci’s lawyers will have to stand up in front of a judge and explain, in writing, with citations, WHY their client still faces a realistic risk of criminal prosecution for conduct spanning January 2014 through January 2025.
There are only two ways to write that brief.
They can argue he faces state prosecution, in which case they have to name the state, name the statute, and explain how it survives the limitations period.
Good luck. I have been asking for eighteen months.
Or they can argue the pardon does not reliably protect him — pointing at the Pardon Attorney’s own letter, the open Justice Department review, the fact that no court has ever validated an autopen pardon.
That second brief is the one they will have to write.
And the moment they file it, the argument stops being something Rand Paul says on television and becomes something ANTHONY FAUCI’S OWN COUNSEL ASSERTED IN FEDERAL COURT.
They spent a year and a half calling this a conspiracy theory.
Now the only exit from a contempt charge runs directly through it.
I have watched a lot of people paint themselves into a corner.
I have never watched anyone do it this thoroughly while a hundred cameras rolled.
— THE BOTTOM LINE
Anthony Fauci had exactly one job in that room today, and it was easy: tell the truth.
He is 85 years old. He is retired. He holds a pardon covering eleven years of conduct.
He is not going to prison for anything he did before January 19, 2025.
He could have walked in there, said “yes, I recommended the closures, and here is why I thought it was right at the time, and here is what I got wrong,” and walked out with something resembling a legacy.
Instead he took a document signed by Biden’s Autopen, looked at it, and decided it was not worth leaning on.
That is the story.
That is the whole story.
Everything else is noise.
And it reduces to one sentence that his own lawyers cannot escape, because Woodrow Wilson’s Justice Department could not escape it either:
IF THE PARDON IS GOOD, HE HAD NO PRIVILEGE. IF HE HAD A PRIVILEGE, THE PARDON IS NOT GOOD.

Nothing that may happen to him will surprise me.
The pardon also applies to state prosecution but every GOP state should nevertheless haul him in for questioning under oath. There are plenty of other perps to catch. At the very least a little lawfare will erase his dirty award money and his pension for lawyer fees even if he keeps taking the 5th.
