Like many of you I am profoundly angered by the Supreme Court decision that fractures our nation and conveys citizenship to the children of illegal aliens born in the United States. [PDF HERE] In fact, I was so angered to my core, I went for a long walk before doing any further commenting on the matter.
U.S. Citizenship is now determined by how good at violating our nation’s borders, by conniving, by scheming and by deception to create a qualified child where no adult qualification exists. This is the most detrimental decision by the Supreme Court in generations and will profoundly impact our nation.
There is no longer an apple, it’s all worms.
Today, the Supreme Court on Tuesday struck down President Donald Trump’s executive order seeking to end birthright citizenship – the guarantee of citizenship status to everyone born in the United States.
In a decision authored by Chief Justice John Roberts, five supreme court justices agreed with the challengers saying Trump’s order cannot be reconciled with the 14th Amendment to the Constitution, which confers citizenship on anyone “born … in the United States, and subject to the jurisdiction thereof.”
(6-3) Writing for the majority, Roberts emphasized that the “children born of parents unlawfully or temporarily present in the United States” “satisfy both elements of the Citizenship Clause.” “Under the Constitution,” he concluded, “they are citizens at birth.”
Roberts was joined in the majority by Justice SOTOMAYOR, KAGAN, BARRETT, JACKSON and KAVANAUGH.
Justice THOMAS filed a dissenting opinion with GORSUCH and ALITO.
SCOTUS BLOG – In his dissenting opinion, Justice Samuel Alito called the ruling, “one of the most important decisions in the history of the Court” and “a serious mistake.” “Careful analysis of the text of the Fourteenth Amendment and the process that led to its adoption,” Alito argued, “shows that it does not degrade the concept of United States citizenship in this way. Instead,” he contended, “the Fourteenth Amendment confers citizenship on only those children who, at birth, owe allegiance solely to this country.”
Justice Brett Kavanaugh agreed with the result that the court reached – that the president’s executive order is invalid – but not its reasoning. In his view, Trump’s order “does not violate the Fourteenth Amendment” but does violate a federal law providing that children who are “born in the United States, and subject to the jurisdiction thereof” are U.S. citizens. Congress, Kavanaugh suggested, “could amend” that law “or otherwise enact new legislation establishing exceptions to birthright citizenship for children born to foreign citizens unlawfully or temporarily in the country. But,” he noted, “Congress has not yet done so.”
Justice Clarence Thomas penned a lengthy dissent, which Justice Neil Gorsuch joined. He called the majority’s account “not historically accurate” and said that it “adds to the sad history of the Fourteenth Amendment, which was designed and understood to secure equal rights for the freed blacks but has instead been repurposed for political projects that the Reconstruction Congress did not support.”
Gorsuch also wrote a separate brief dissent, in which he appeared to suggest that Trump’s executive order might violate the Constitution as it applies to the children of undocumented immigrants who intend to live in the United States permanently. “If those parents are not domiciled here,” Gorsuch queried, “then where are they domiciled? And if the answer is nowhere,” he continued, “how can we reconcile that conclusion with this Court’s longstanding recognition that every person is domiciled somewhere?” Because the challengers in this case have argued that Trump’s order is invalid in all circumstances, rather than just some, Gorsuch explained, “these questions may not be properly before us. But their answers are undeniably important to a Nation committed to a view of citizenship open to all children born here to parents who can call this country their home.” (SOURCE)

First they have to grandstand in order to properly fundraise off of it. Then set up vehicles for revenue streams from its absence or presence. Then inside trade to the extent available. Then pass some half baked, unintelligible to the ordinary person legislation written by and for private attorneys that will never be enforced in its exclusionary aspects and will absolutely be to the detriment of US citizens.
Would be a much cheaper and quicker recovery to just hang them all.

The irritating thing is when the 14th was passed, it was understood it did not apply to Indians (indigenous people), or foreign diplomats. But somehow, random people who give birth in Guam are citizens.

I had to read this a few times to make sure I wasn’t seeing things.
So children know where they want to live?
Worse, I think Gorsuch meant that the parents intend to reside in the US permanently, illegal or otherwise.
Where the parents say where they live. Just say whatever, at whatever time, and we handout citizenship like candy if they say the right things.
While the majority established a blanket rule that all children born on U.S. soil (with very traditional exceptions like diplomats) are citizens regardless of their parents’ status, Gorsuch’s suggests a potential future where citizenship depends on the parents’ intent.
Under Gorsuch’s framework, a child born to undocumented parents who plan to live in the U.S. permanently would be a citizen because their parents are “domiciled” here. However, a child born to someone in the country purely temporarily, with no intent to stay, might theoretically be excluded if Congress were to pass a specific law targeting that group.
Gorsuch is pointing out what a disastrous mess is this decision. No logic. Not constitutionally based…. a retarded decision.

If two Americans go overseas be it in the military or otherwise and has a child that child is an American which is the same as a non citizen who gives birth in the U.S.
There is non such thing as birthright citizenship or an anchor baby being an instant American.
UD Embassies and US military bases overseas have always been American soil with American parents while stationed there.

Across the world, millions of women are being recruited to get pregnant and when well into the term be transported to the US to give birth. It would not surprise me if “blue” cities set up special birthing hospitals to greet these newborn but fully fledged Americans.

I am wondering if this decision, that most of us disagree with is also based on a STRICT interpretation of the 14th amendment. After I also took a walk to calm down and thought about this decision, it occurred to me that the SCOTUS is always supposed to review the constitutionality of laws without regard to the intent of the law in the constitution and perhaps in this case, they actually did that. Maybe the solution to this question of abuse of the intent of the amendment should be a modification to the amendment that clarifies what it should have said in the first place had the abuse been taking place at the time. Or as Justice Kavanaugh seems to be indicating in his dissent, modifying the existing federal law governing this or enacting new legislation to provide exceptions to the birthright citizenship for illegals. In either case, this may not be the end of it but it would certainly be a good idea to get this done while we have both houses and/or before POTUS Trump’s term ends.
I agree with you. This was never going to be fixed with an EO. We need legislation passed pronto that addresses this. Instead of going on constant vacations, maybe they could spend time fixing this. I bet if you polled people, this would be an 80/20 issue.

This was a lingering, malingering, legal ambiguity finally finally cleared up. .

Now we can attack this issue head on. Finally.. Good. Onwards. Citizenship is not just a convenience granted by squatting on our sacred soil. Nor a consolution prize awarded emotionally to “hardworking’ law breakers.
Close our borders tight as drum. All entrants must prove a negative pregnancy test, all women and all men. All entrants must post bond and have a financial sponsor with proof of independent health insurance .
Few counties allow birthright citizenship. We can learn from their best practices that keeps this out. Start by listing countries that do allow this, and those who do not allow this. Divert all pregnant non-citizen entrants to these other countries. Let them know this up front.
I think at least part of our job is to show that birth tourism is a legitimate issue that must be addressed.
