When I served I believed I was supporting and defending the American Republic and I would guess that remains the belief of servicemembers today. Little did I know then that the Republic and its Constitution for the united States of America, awarded in 1787, had been in mothballs since 1861.
So what does the country operate under today? The Constitution of the United States of America, the contract awarded to the British Terrirorial United States of Anerica, a British Crown corporation., in 1789. The military’s paymaster is SERCO, another British Crown corporation.

Former has no official ties to the military. They served. Retirees receive retired pay and benefits for life; accordingly they are still subject to the UCMJ and are also subect to recall to active duty.

IIRC, UCMJ rules about this sort of thing only apply if you’re actively receiving a retirement. You can separate before your twenty year retirement mark (without a single shred of benefits) and not be beholden to it.
It was explained to me by a “lifer” in the military that “the oath does not expire until you do”. Retirement is your choice and you can choose not to retire from the military however once a military member, you are always subject to all sections and laws of the UCMJ (Uniform Code of Military Justice).
No, only if you retire from the military. If you just serve out your term of enlistment, you are then on inactive reserves for a period of time, and then totally separated and no longer subject to ucmj

My argument, they ( seditious 6 ) did not refer obeyance specifically to the UCMJ, but, in a mass media presentation, told troops to disregard illegal orders of this President, with no context of ” illegal orders ” ever having been given.
The very way they “produced” the video is a piece of evidence against them as to intent. It was not a serious piece of advice to particular members of the military. It did not lay out that personal opinions or “personal philosophy” as Sec. Hegsmeth reference. They did not caution against treating such decisions without care nor advice as how to identify a lawful order.
Furthermore, they conspired in producing and distributing the video (probably on the taxpayer’s dime).
All of those factors spell “intent to undermine.” And their specific directive that disobedience is a “duty” makes it a call to action, i.e. mutiny.
I don’t believe there is any way that, in front of straight-thinking jurors, there would be any excuse that could yield a “not guilty” vote.
The intent of these six people is clear and the purpose was seditious. “This administration is pitting our uniformed military and intelligence community professionals against American citizens like us. So servicemembers are guaranteed a certain amount of access to their elected representatives. You are allowed to file a complaint with your senator or congressman directly, and they are REQUIRED BY LAW to open an investigation.
This is hardly ever used. Despite whistleblower protections, it’s the equivalent of telling your entire chain of command to shove it and that’s generally not good for your career. However, it is a legally binding thing.
So all these yahoos in Congress saying that young officers are calling them with concerns… where are the reports? Where are the official complaints? Where are the investigations into illegal orders from POTUS?

100%-two of my sons are junior officers-they have never said anything disparaging (with a lot of reasons and opportunities) about their chain of command. It is obviously drilled into them and part of their oath and duty. They are young guys in their mid-twenties. What Kelly (and the others) have done is call that sense fidelity they and others have as something that is up for question . He will obviously defend himself on ambiguities and intent, but I hope an example is made.
This is a real nice piece of news, but curious. I’m wondering about the news of recall to active duty in order to impose military discipline on Kelly. Even a little taste such as the elimination of his pension (and maybe a reduction of his rank to something below O-6) would be nice.
I have not seen any news of the recall of a retiree in order to impose discipline and wonder if it has happened before.
I learned some this afternoon about recalling retirees to active duty, and the recall for reasons other than to impose discipline.
Apparently in 1942, a 79-yo retired officer was recalled by the Navy. His service was in WWI. He had been a part of the USN/USMC efforts in China during his service, was versed in what went on in that AO, and he knew six languages.
Wonder how that worked out between 20-something wonders and that guy. I know no more details.

Constitutionally, The purpose of the recall is not punitive by default but procedural: it restores the individual to military status so that military jurisdiction can be exercised.
Only after a court-martial or administrative hearing would a conviction or disciplinary action be imposed.
Until then, no punishment occurs; the process is investigatory and jurisdictional, ensuring that serious allegations involving former high-ranking military officials are reviewed under the legal framework governing military conduct.
Kelly has denied wrongdoing, asserting his statements were a constitutional duty and dismissing the review as political intimidation
If the review finds sufficient basis, the defense secretary may order the individual recalled to active duty for further proceedings, which could include a court-martial to adjudicate the alleged offense.
The US Manual for Courts-Martial states that the military requirement to obey orders “does not apply to a patently illegal order, such as one that directs the commission of a crime”.
All Democratic and anti-Trump support outcry echo each other; concentrating on certain words PDJT’s used to define sedition and what punishment awaits for the convicted one; and which ones = “punishable by death”. Of course those who defend Kelly conflagrate words, not context. Kelly himself protesting that this puts his family at risk, that he fears for his family members.
He should have known and thought what court-martial by law and what it would bring upon his family members for what he did.
If he is recalled to active service, can he still serve in the Senate?

Nothing will come of the investigation, just like Comey Kelley will skate.

As a former Navy Officer Kelly should be called back to active duty and asked to specify exactly which illegal orders he thinks have been issued, and which illegal orders he thinks might be issued.
Make him specify for the record EXACTLY what his concern is.

I wondered why Kelly is the only one who retired. Were the others kicked out or something?
Someone here explained that you can do your active service, then guard/reserves, which I think is about 6 years total?, and you don’t retire – you are just separated.
It seems odd to me that none of the others made a career out of the military, if no other reason than to get the retirement benefits. I know they get great bennies as Senators/Congressmen, but that wasn’t guaranteed – they had to run for office and win.
