The Supreme Court attempted to split the baby between executive “national security” power and the dynamic use of the “Alien Enemies Act” today with a ruling that temporarily blocks the Trump administration from deporting criminal alien gang members under the UEA until the criminals are afforded some undefined amount of time to appeal their repatriation status. From the Ruling, “To be clear, we decide today only that the detainees are entitled to more notice than was given on April 18, and we grant temporary injunctive relief to preserve our jurisdiction while the question of what notice is due is adjudicated. [See post, at 13 (ALITO, J., dissenting).] We did not on April 19 —and do not now— address the underlying merits of the parties’ claims regarding the legality of removals under the AEA. We recognize the significance of the Government’s national security interests as well as the necessity that such interests be pursued in a manner consistent with the Constitution. In light of the foregoing, lower courts should address AEA cases expeditiously.”
The 7-2 ruling was unsigned. Justices Alito and Thomas dissented. The main opinion issued by the court was labeled “per curiam” — a term meaning that it was issued by the court as a body, rather than any individual justice. However, Justice Brett Kavanaugh wrote a separate opinion concurring in the decision. But Kavanaugh wrote that he’d prefer to have the Supreme Court dig into the legality of Trump’s Alien Enemies Act invocation right away, without waiting for the issue to be hashed out by lower courts.
NEW YORK TIMES – The Trump administration will not be allowed to deport a group of Venezuelan detainees accused of being members of a violent gang under a rarely invoked wartime law while the matter is litigated in the courts, the Supreme Court said on Friday.
The justices sent the case back to a federal appeals court, directing it to examine claims by the migrants that they could not be legally deported under the Alien Enemies Act, the centuries-old wartime law invoked by the Trump administration. The justices said the appeals court should also examine what kind of notice the government be required to provide that would allow migrants the opportunity to challenge their deportations.

The Alien Enemies Act is just one method, a more expedient one, for removing the Venezuelan illegals. But no matter how this struggle against the black robes ultimately ends, their Venezuelan charges are still illegal and can and will be removed, even if it takes a little longer to do so. But what’s a few more months of rape, pillage and mayhem among friends, right?
The bigger issue is the illustration of the total corruption of our institutions. As Justice Alito rightly notes, the court lacks jurisdiction to intervene here. Roberts’ coveted “percolation” has barely begun on the issue and yet the activist court jumps in with 14 corrupt feet to shield a terrorist organization based on the laughable notion that they haven’t been granted enough “notice” that their illegal presence is no longer welcome! The 5th Amendment was ratified in 1791 and was intended to protect AMERICAN CITIZENS (defined as “persons”) from abuse by the government. No where does it afford protection to non-citizens, much less illegal alien invaders. But this pathetic court somehow finds that these invaders have a “right” to conduct their invasion, subject only to the discretion of the court.
This is utter nonsense and a corruption of the obvious meaning of the Fifth Amendment to the Constitution. President Trump should suspend habeas corpus and expel these terrorists immediately – and explain to the country exactly why he is doing it. The Supreme Court was never intended to decide matters like these. These are policy decisions far beyond the scope of judges.
The SCOTUS and the entire system of federal courts must be put in their place, and if they are unable to police themselves (which they clearly cannot), and the Congress will not act (they will never act on this), then the President must set things right.
This supposedly “conservative” court is the most liberal court since the Warren Court era, and their decisions are just as destructive.
The 5th amendment is not in effect in the deportation of non United States citizens. This is an Administrative act of the duly appointed member of the Executive Branch. The non citizens who are within the Territorial boundaries of the United States have no Constitutional Right to remain here. Their continued presence here, or removal from our Territorial boundaries is an Executive decision not a Judicial one. A person who crashes a private party and is subsequently ejected (ie. Deported) outside onto the street has no legal recourse to claim. They had no right to be inside at the party in the first place. If however the uninvited party crasher stabs a person and is arrested, the person has first amendment rights before the Judicial branch. However if found not guilty and released they are still subject to Deportation because the are in the country uninvited. Deportation is not a punishment. Illegal Entry into the United States is a crime and the illegal alien may be arrested, tried, convicted and sentenced to prison. Upon release from prison the illegal alien is still subject to deportation without judicial review. This is covered under the Jurisdiction Section of the Immigration and Naturalization Act.
One small correction, we do not know the vote tally as the order was not signed. Only two justices Publicly Dissented. It may well have been 5-4. When Newsom outlawed singing during COVID a loss on the temp injunction turned into a big win for conservatives just a month later after arguments were heard. I agree, stall and punt, but when people see Alito and Thomas write public opinions on per curiam decisions, everyone jumps to thinking it was 7-2 and future victory is a lost cause, when we may be just 1 vote away. Continue deportations, ignore SCOTUS/lower courts’ rulings under Article II Executive branch separation of powers authority. I don’t know why the Alien Enemies Act was invoked in the first place? The Immigration and Naturalization Act clearly states that dealing with illegal aliens come under the Executive Branch. Only if an authorized administrator brings an illegal alien before a federal judge does the judge have jurisdiction. The illegal alien has no legal standing and can’t request a hearing and only an authorized administrator brings a case before a Judge and only then do the courts have jurisdiction. A poor analogy would be a disruptive person crashing a party and the bouncer has administrative power to eject (ie. deport) the party crasser or arrest them and bring them before a judge. The administrator is not charging an illegal alien with a crime just ejecting them from where they’re not wanted. And the ejected party crashing person can’t go to a judge and complain.
Every time there is a clash with the executive the court gives the executive a 40% win and themselves 60%.
