The Supreme Court attempted to split the baby between executive “national security” power and the dynamic use of the “Alien Enemies Act” today with a ruling that temporarily blocks the Trump administration from deporting criminal alien gang members under the UEA until the criminals are afforded some undefined amount of time to appeal their repatriation status. From the Ruling, “To be clear, we decide today only that the detainees are entitled to more notice than was given on April 18, and we grant temporary injunctive relief to preserve our jurisdiction while the question of what notice is due is adjudicated. [See post, at 13 (ALITO, J., dissenting).] We did not on April 19 —and do not now— address the underlying merits of the parties’ claims regarding the legality of removals under the AEA. We recognize the significance of the Government’s national security interests as well as the necessity that such interests be pursued in a manner consistent with the Constitution. In light of the foregoing, lower courts should address AEA cases expeditiously.”
The 7-2 ruling was unsigned. Justices Alito and Thomas dissented. The main opinion issued by the court was labeled “per curiam” — a term meaning that it was issued by the court as a body, rather than any individual justice. However, Justice Brett Kavanaugh wrote a separate opinion concurring in the decision. But Kavanaugh wrote that he’d prefer to have the Supreme Court dig into the legality of Trump’s Alien Enemies Act invocation right away, without waiting for the issue to be hashed out by lower courts.
NEW YORK TIMES – The Trump administration will not be allowed to deport a group of Venezuelan detainees accused of being members of a violent gang under a rarely invoked wartime law while the matter is litigated in the courts, the Supreme Court said on Friday.
The justices sent the case back to a federal appeals court, directing it to examine claims by the migrants that they could not be legally deported under the Alien Enemies Act, the centuries-old wartime law invoked by the Trump administration. The justices said the appeals court should also examine what kind of notice the government be required to provide that would allow migrants the opportunity to challenge their deportations.
The court said its order would remain in place until the U.S. Court of Appeals for the Fifth Circuit ruled and the Supreme Court considered any appeal from that ruling. Justice Samuel A. Alito Jr. wrote a dissent. He was joined by Justice Clarence Thomas. (more)

Within the dissent Alito documents the timeline of the case and outlines why the Supreme Court intervention is unwarranted. From the Alito opinion, Chief Justice John Roberts dragged the high court into the case without any reasonable justification for interceding.

Immigration and Nationality Act
This strips the Article III courts’ jurisdiction over immigration cases. This was passed in 1952, and has been amended several times. (Authority: Article III, Section II, Clause 2) To ask the Supreme Article III court to rule that it is itself in violation of the Act is a pipe dream as they have been usurping the powers of the other two branches since Marbury vs. Madison (1803). The solution is to impeach each judge in violation. The President is required by his oath to defy and ignore such unconstitutional orders.
On September 30, 1996, President Bill Clinton signed the “ILLEGAL IMMIGRATION REFORM AND IMMIGRANT RESPONSIBILITY ACT OF 1996”
Under Sec 302, it states that illegal aliens can be “removed from the United States without further hearing or review”

Clinton and all those anti American presidents thereafter expelled illegals in huge numbers without let or hindrance, and no one court intervened.
So why, I ask myself often, is President Trump trying to enforce the law by this circuitous route.
I freely admit that I am completely flummoxed.
That Act also reads as follows wrt the “due process” period”:
“…upon the alien’s request for prompt review by an immigration judge of a determination under subclause (I) that the alien does not have a credible fear of persecution. Such review shall include an opportunity for the alien to be heard and questioned by the immigration judge, either in person or by telephonic or video connection. Review shall be concluded as expeditiously as possible, to the maximum extent practicable within 24 hours, but in no case later than 7 days after the date of the determination under subclause (I).”
So if an illegal alien’s request for asylum is appealed to an immigration judge, that alien is allowed no more than 7 days for due process”.
Thus, since the SCOTUS has remanded the case back to the 5th Circuit Appeals court for a time period for the illegals in that case to be given due process greater than 24 hours, that court should respond that any illegal being deported under the Alien Enemies Act should be given no more than those 7 days for due process, especially since they have been designated as terrorists now.
The review can happen on the bus ride to the airport. Capture, load them on a bus, ship them out.

What is amazing is that, whether the outlet is left or right, they all agree that the Supreme Court somehow has the right to decide military policy. It does not. It can only enforce its rulings if the other branches accept it. They did so with the unconstitutional Roe v. Wade decision, legalizing abortion on demand, and Obergefell v. Hodges, legalizing “gay marriage” nationally.
Only the Roe decision was subsequently overturned by the Court itself. The Roe decision led to 60 million dead babies and there is still no legalized and recognized right to life on the federal level. We are living under a Supreme Court dictatorship.
Regarding the gay marriage decision, Justice Antonin Scalia’s dissent in the case called the ruling a judicial “Putsch,” an attempt to overthrow a form of government — ours. His dissent, joined by Justice Clarence Thomas, was written “to call attention to this Court’s threat to American democracy.” The threat continues.
Scalia understood the power and meaning of words and he chose the word “putsch” for a specific purpose. One definition of the term means “a secretly plotted and suddenly executed attempt to overthrow a government…” Another definition is “a plotted revolt or attempt to overthrow a government, especially one that depends upon suddenness and speed.”
