When individuals enter our country without proper vetting per the immigration system; we have no way of knowing if they are admissible or inadmissible.
We cannot allow open borders advocates to use the term undocumented immigrant. It suggests that the issue is merely a paperwork matter. That is a term best used for an individual with an expired visa who qualifies for an extension, but has not received the necessary documents.
Those who simply crossed over the border without attesting to their admissibility; pose a threat to our country and must leave or be expelled.
Immigrant rights (yes they exist) do not apply to individuals who have not proven their admissibility.
It’s really not that complicated.

Exactly -the term “undocumented” implies that they are just missing their legal “documents” to stay. They aren’t immigrants either.
The problem is there are NO “documents” they can get to stay here as a resident or citizen of the US. They are here “illegally”- against the laws of our Nation-the only documents they should be receiving is a citation for breaking the law and removal/deportation papers.
Any law enforcement officer, Border patrol, Sheriff should be able to issue them a citation. It’s not rocket surgery to determine if someone is here illegally.
Then give them to ICE to get them out.
They can go back to where they came from and get their due process from their home if they want to fight the citation/deportation.
Thats what happens here if you get a speeding ticket or citation in another state-you go home and fight it you get your due process from there.

Imagine that you “admit” someone onto your property in such a manner that you become vulnerable to their presence. Why would you do that unless you were convinced they did not pose a threat (reasonable person standard)? Admissibility guidelines in the law are very clear that certain individuals with particular disease states, criminal records, etc. are not admissable – EVEN IF THEY BELONG TO A GROUP THAT HAS BEEN IDENTIFIED FOR ASYLUM STATUS.
The whole purpose of admissibility guidelines is to ensure that admited individuals do not pose a threat as either a carrier of disease or criminal threat (among other threats).
The problem with the Biden/Mayorkas border is that a large number of individuals entered this country without admissibility clearance. That being the case – due process does not apply. Due process would have applied beginning at the moment an individual submitted to US law to establish admissibility.
This is why Mayorkas was impeached and is guilty of treason – he allowed, no facilitated, mass entry without admissibility checks.
Back to the beginning illustration. Imagine that you had a guard at the boundry of your property who was responsible for clearing individuals for entry and denying entry to those who pose a threat. But imagine someone who posed a threat got through – and now your daughter is dead.
This is exactly the scenario that we are dealing with.
What part of they are already a criminal by being here do you fail to comprehend? Yes they DO NOT deserve the same protections as a citizen. As for the criminal gangs they’re pirates and probably should be shot on sight like mad dogs just going by their tattoos.

It’s irrelevant; the Executive, not the Legislature, sets foreign policy. If Congress approves of paying for it, all of them are guilty under the Logan Act. Only one entity gets to set foreign policy, and that one is not Congress. Any action outside of that policy without permission of the Executive is a Logan Act violation.

Here is my question based on these facts (14-15), why is it the job of the USA to determine where he should be deported to if not El Salvador? We did not bring him here illegally. Even for illegal aliens, since 1953, Shaughnessy v. United States ex rel. Mezei, 345 U.S. 206, 212 (1953); Mathews v. Diaz, 426 U.S. 67, 77 (1976) (There are literally millions of aliens within the jurisdiction of the United States. The Fifth Amendment, as well as the Fourteenth Amendment, protects every one of these persons from deprivation of life, liberty, or property without due process of law.); Plyler v. Doe, 457 U.S. 202, 215 (1982) (holding that unlawfully present aliens were entitled to both due process and equal protection under the Fourteenth Amendment).
This is not legally controversial. The real issue is the scope of what constitutes Due Process under law respecting illegal aliens. That varies depending on the circumstances and, generally, there is significant law developed within the immigration context administered through the DOJ. Different and loosened rules (Rules of Evidence, administrative rules and regulations) apply in the immigration courts. Generally, its not that difficult to exclude someone who has arrived illegally. Hopefully, SCOTUS will 1. affirm the power of the President to utilize the Alien Enemies Act respecting Venezuelans and 2. narrowly limit the circumstances of administrative and legal relief (on Habeas filings) from the SOD and/or AG’s discretionary judgment so that those cases can be quickly disposed of, perhaps on a mass basis for the vast majority. But we’ll see.
I think the administration wins on 1. and mostly on 2. But note: There are bigger alien fish to fry than the Venezuelans. I personally believe the administration should have declared Mexico a hostile state under the AEA based on its permitting basically all the illegal aliens to enter though its borders to the US and, indeed encouraged it both directly by aiding foreign NGOs to ferry the illegals through to the southern border and indirectly by failing to act against the cartels’ criminal operations. That would open the doors to a much broader group to illegal aliens to deport under the AEA.
