The DOJ is arguing that lower court judge James Boasberg is unconstitutionally intruded on the president’s national security powers by barring Trump from using the two-century-old Alien Enemies Act to swiftly deport Venezuelans the administration says are members of Tren de Aragua.
“Only this Court can stop rule-by-TRO from further upending the separation of powers—the sooner, the better. Here, the district court’s orders have rebuffed the President’s judgments as to how to protect the Nation against foreign terrorist organizations and risk debilitating effects for delicate foreign negotiations.
More broadly, rule-by-TRO has become so commonplace among district courts that the Executive Branch’s basic functions are in peril. In the two months since Inauguration Day, district courts have issued more than 40 injunctions or TROs against the Executive Branch.
Whereas ‘district courts issued 14 universal injunctions against the federal government through the first three years of President Biden’s term,’ they issued ’15 universal injunctions (or temporary restraining orders) against the current Administration in February 2025 alone.'”
This puts the issue squarely in the hands of the Supreme Court.

If or when this question of nationwide injunctions coming from single federal district judges ever does receive its fair day in the Supreme Court, I intend to watch for what Bill Barr does.
Bill Barr’s personal burr under the saddle is judicial overreach by district judges through nationwide injunctions. He was not shy about discussing this phenomenon in recorded speeches while he was AG. Apparently, his loathing of this bad maneuver has only grown.
Bill Barr is as establishment as it gets. He is a persuasive speaker and writer. If Bill Barr files an amicus brief in support of upholding constitutional order, he could provide the reputational muscle to end this abuse.
Otherwise, I would expect a 4-5 ruling. Justices voting in favor of the constitution could be Alito, Thomas, Gorsuch, and Kagan. It would not be unimaginable for Kagan to write her own concurrence to get on record that she was joining the ruling in a nuanced way.
Sotomayor would be a kneejerk “No”, Ketanje Brown Jackson probably would be a “No”, ACB would try to hang with the girls, but would follow Roberts through the flames of hell. IMO, it depends on Roberts. ACB and Roberts both appear to like being liked.

They can’t let activist judges scuttle the judicial branch over ridiculous overreach like the Tren de Aragua case, USAID, voluntary retirement, and all of the other frivolous challenges. Unfortunately, by design, John Roberts as Chief Justice is assigned oversight of the DC Circuit. I believe this motion will do directly to him to decide on the stay and subsequent hearings. He can wipe it away in a few seconds. Far as I know it doesn’t go to the full court unless he validates the stay.
This motion is the President calling Roberts’ “the appellate process is the appropriate remedy” bluff defending Biasberg last week. “OK, if the appellate process is the correct method, here is our appeal,” basically.
As I’ve been pointing out, Roberts has to be careful. He is very much on the wrong side of public opinion. He risks Congress getting involved and the solutions there can be quite dramatic if Congress gets motivated. Hearings alone – subpoena of judges – could destroy the legitimacy of the courts entirely because of their ideological bent.
That’s really what is at stake here: the legitimacy of the courts. The MINUTE people realize that the courts exist specifically to deny republican government, the courts lose legitimacy. That’s what happened in El Salvador and it’s why Bukele worked with the legislature to gut the courts. The corrupt courts were blocking needed reforms. Since eliminating court resistance, reforms have been enacted and Bukele is massively popular and crime as plummeted.
That’s the risk Roberts faces. We The People waking up to the fact that the Courts are designed to allow criminal murderers to enter and stay in the United States…to allow bureaucrats to steal money…to make government employees completely immune from accountability…you name it. People are starting to wake up to that, 2024’s election results prove it. The Courts are in real danger.

They have allowed obviously fraudulent partisan weaponization by employees of the government against their political opponents. Having lost the battle to imprison their enemies, the courts are now waging ideological warfare against the People through a grotesque perversion of the legal system and massive overreach of the Courts’ LIMITED powers. Our Government is LIMITED. If the Courts are not LIMITED, then they are illegitimate, and can be ignored or removed by the People acting through their elected Representatives, of which I am one.”
If I could have added one thing to the legal brief submitted by the President, it would have been to say this, “The legal maneuverings of the judges are evidence that the goal is to thwart Executive Action, not ensure just treatment of these terrorist aliens. Any maneuvering necessary to achieve this end is permitted, in fact encouraged. If the law can be twisted to ensure ANY desired outcome by a single judge, then the Courts can act without limits making them despotic. This is seen in this instance when the district judge, when confronted with the legal problem that habeas had to be brought in Texas (denying him jurisdiction) immediately gave them the opportunity to reject habeas and pursue a course that would allow the judge to take the action desired – a TRO. The judge did this specifically to evade restrictions on his LIMITED powers to grant himself UNLIMITED authority. All of his statements and actions from that time forth illustrate the despotic intent behind his rulings. There is no doubt in my mind that the judge would shift to a new tactic should his attempt to use APA to evade AEA be denied. Thus is the mind of the despot.“

We’ll. Congress has to start sending subpoenas to the judges. The purpose? To inform legislation being contemplated by Congress to reduce the size, scope, and jurisdiction of the inferior courts.
If the judges try to quash the subpoena and SCOTUS upholds it, Congress has free rein to dismantle the corrupt and illegitimate court system.
Despotism ALWAYS requires control of the courts by ideologues.

We The People have not seen the courts as ‘legitimate’ for decades now- this is what has played a large role in creating the rise of Donald Trump.

We’ve voted for Trump three times and won all three and yet he’s not been allowed to fully carry out the agenda we’ve repeatedly voted for.

In his first election we saw it again and again wiping out Conservative Inc media. House members like Paul Ryan decloaked. Many Senators officially decloaked like Romney. Bureaucrats announced themselves superior to EVERYONE and thus far have been held accountable by no one but Trump.
John Roberts decloaked years ago with Obamacare…his coming out party. But other justices have revealed themselves to be puppets of the State blessing judicial and bureaucratic power grabs on all fronts. Many other judges soiled their benches pursuing fraudulent cases meant to bankrupt and imprison Trump.
The courts have no inherent power. They can’t levy taxes, raise armies, conduct policing, or do anything other than write rulings. When the paper loses its legitimacy, the courts go with it.

I have not pretended that Congress works for the people since way before Bill Clinton’s time.
They actually do work for the parties. They actually do not work for the people.
I agree they should work for the people but they do not, and I will not pretend they do.
We live life the way it is–not the way we wish it was.
My old Congressman, used to set up meetings in rotating areas of his district, regularly. I knew his family.
Now a Senate or House seat is like hitting a lottery jackpot. They go to Congress not to serve the people or our Republic, but to enrich themselves and their funders/friends, and some are ideologues who want to destroy our country.
It appears that Judges do not work for the people either. Fortunately we have a President who does work for the people but unlike Congress and Judges he cannot work for us for his Lifetime.

This is one of several upcoming bellwether decisions that PDJT wants and needs the support of the SCOTUS in order to implement his, and the majority of the American public’s, agenda.
The SCOTUS is now the gatekeeper for the future of our country.
I wish I could be optimistic about the rulings to come, but I am not.
I anticipate that within six months we will know whether or not America will become great again, or be mired in the muck of malevolent, leftist obstructionism.

But the SCOTUS also cannot rule the Executive of the Executive Branch. They are equals with checks and balances. The Courts are limited to ruling on the law, not writing it or even imposing it’s own feelings. Before any TRO there should be a finding that there is a law involved and that particular court has the right to enforce said law. Then that court has to determine that the party bringing the suit has the right to bring said suit against the defendant. The law is being followed by Trump, and the courts are not following the law.
The law is what we say it is (e.g., “Roe”) and you will follow it. 50 years later, we says it’s different (“Dobbs”). SCOTUS said separate but equal was fine. They make law all the time.
Lawyers are businesspeople too. I interact with them all the time in professional life. They are one of the last professions to be able to bill by the hours (coders too?).
Lawyers, no matter their political persuasion, want to protect the “practice of law” as it lines their own pockets and those of their friends. That is in part why the lawyers who become judges don’t ever think about the concept of time or efficiency. The more time something takes, the more appeals something requires, the more motions that need file all line the pockets of….lawyers. It’s not in their DNA, and if it were, they ignore it to benefit themselves.
