The DOJ is arguing that lower court judge James Boasberg is unconstitutionally intruded on the president’s national security powers by barring Trump from using the two-century-old Alien Enemies Act to swiftly deport Venezuelans the administration says are members of Tren de Aragua.
“Only this Court can stop rule-by-TRO from further upending the separation of powers—the sooner, the better. Here, the district court’s orders have rebuffed the President’s judgments as to how to protect the Nation against foreign terrorist organizations and risk debilitating effects for delicate foreign negotiations.
More broadly, rule-by-TRO has become so commonplace among district courts that the Executive Branch’s basic functions are in peril. In the two months since Inauguration Day, district courts have issued more than 40 injunctions or TROs against the Executive Branch.
Whereas ‘district courts issued 14 universal injunctions against the federal government through the first three years of President Biden’s term,’ they issued ’15 universal injunctions (or temporary restraining orders) against the current Administration in February 2025 alone.'”
This puts the issue squarely in the hands of the Supreme Court.

I’m starting from zero. John Roberts has yet to earn any respect from me, and I doubt he ever will.

The other important point he continues to make is that there are a great number of judges who are not native born Americans and that impacts their rationalization and interpretation of our Constitution and their duties in the Judiciary. I do agree that USA Attorneys/Judges should be eligible for a judgeship only IF they are native born American citizens. (Foolish me, I always assumed they were native born, until the last few years.)
And they should not be immune from prosecutions, neither should Congress critters.

If Roberts and Barrett both vote with the far-left three, then it will be up to Congress to fix it. They created the lower courts and can fix this through legislation and there is nothing the SC can do about it. But will Congress? There are a good many Republicans in Congress who try to appear to the base as if they support Trump, but really support the deep state/Uniparty much more, and they will find some excuse not to rein in the lower courts. It will be they don’t like the wording, or the legislation goes “too far”, or something, anything. Between Roberts/Barrett and these kind of Republicans in Congress, I do not hold much hope this gets corrected.

We have a county in NH that actually did secede from the Union for a period of time, so this is certainly not new thinking in NH.

I have no faith in Justice Roberts and very little faith in the Judicial Branch overall.
It’s quite clear district judges as the judiciary itself is barred from most executive decisions and questioning them. Much more than settled law. Roberts will not come down on side of the constitution. Time to defund courts, air compromised people and their failures to recuse. And likely time for them to be investigated and barred from acting as so-called judges. This especially includes foreign born and dual citizen judges too.
Levin reviewed this aspect a few days ago…it is very clear the overreach by these district judges is unlawful.
I would also suggest Pam Bondi empanel out of DC grand juries for these rogue judges whom have refused to recuse themselves and is clear and direct conflicts. If the GJ indicts they violated the law the judges should be charged federally and any RICO that they may be involved with. This should immediately prevent them from any cases or judge functions.. And they stand trial for this. Any refers to tribunals or the senate depending.
If the Supreme Court punts, the administration should just ignore all the orders going forward. Let’s see what enforcement mechanisms the lower courts try to use against a sitting President.

The correct response here is that this law is on the books and gives the President the right and ability to act exactly as he is. If the judges don’t like it…their proper response would be to tell Congress to change the law. It’s that simple. Congress consistently fails to do its job and just expects the other two branches to do it for them…then we get into this position.
I think that’s the way this will go down.
The Supreme Court will rule in President Trump’s (The Executive Branch’s) favor, and the accompanying opinion will kick the can over to Congress making your point it’s up to them to change the laws.
I think the Supreme Court did something similar on another case (probably happens a lot).
Set up a legislative battle over immigration laws.
Should be a slam dunk but, alas, we’ve been dunked too many times by Roberts and/or Barrett. The constitution means little in their voting.
Actually, the executive branch does not have to obey orders given it be the judicial branch. And the legislative branch also has the power (and the duty) to bring the criminals in the judicial branch to account. So it is not correct to say that “only” the Supreme Court can fix this.

We, as a nation, have fallen victim to the “belief” that the Supreme Court has authority over the other branches of government. This too was a ruse put over on the people. These branches are EQUAL branches of government. Their tyrannical rulings over the Executive Branch are just as valid as the Executive Branch launching an armored division against the S.C.
I wonder if we can transfer half the judges in this country to live in hotel rooms for a year to get rid of the backlog of illegal alien cases. Then, the other half can use the same hotel rooms to wrap it up.

I have hope that SC see this since they looked at it before.
I’ve seen the other side’s arguments, via Glenn Greenwald and Matt Taibbi. They are claiming that at least two of the Venezuelans deported had nothing to do with TdA, one was a NYC gay hairdresser and I forget the other one. They say this is why Due Process is important. They also say the Constitution does not say only citizens get Due Process, it says person. Also, saying that this is different than just deporting illegal aliens, they were deported to a foreign prison. If there are two innocents being held that were mistakenly taken to prison rather than just deported, this will not look good. They will insist on Due Process for any further deportations of criminals.
Carelessness in the execution of the law may bite the administration in the rear end.
The fact is they were still here in the US illegally and subject to deportation. Mistakes will be made. People have been imprisoned and even executed by mistake. But we don’t ignore our laws based on those mistakes. When mistakes are made they can be rectified in most cases. This is no reason to invalidate the enforcement of the Alien Enemies Act.
I don’t disagree with a word you wrote, but if SCOTUS is looking to screw over the administration, deporting gay hairdressers may have given them the excuse to do so.
I look forward to the public outrage ensuing if Roberts bases his decision on a mistake made by deporting a gay illegal hairdresser. He will have just destroyed the legitimacy of the SCOTUS in the eyes of the public, something he is so concerned about.

There was no concern for due process when millions were let in – illegally. Now these activists want to hide behind the letter of law and claim they all need hearings before bent immigration officials before being deported. The system is broken because these partisan activist judges let the system be broken. If there had been an orderly process coming in, there could be one going out. As it is, the people who waged war on the existing population, used their money and office to create a nation without borders are responsible if any of the people they helped traffic into this country fall through the cracks on the way out.

They FINALLY specifically made a point of directly challenging the district courts’ ability to rule outside of their district jurisdictions and it’s amazing this isn’t big news. Thanks to the foolish appointments of the NOT conservative Roberts and Barrett which people who investigated them warned about, the SCOTUS’ last opportunity to rule correctly on that was deemed to be “stunning” by the actually conservative dissenters on the court because Roberts and Barrett voted with the left and didn’t simply rule that the district court was out of its realm of control nationally. We’ll see what happens this time.

2027: the cases finally are decided in Trump’s favor but it’s too late because his administration has largely failed and the Dems control the House.

That’s called “preserving the institutions” and it’s “conservative” to do so.
I sort of HOPE that one the 4 Justices who are conservative speak up and tell us what is happening behind the scenes.
Maybe give interviews telling us how the court is ruled now, and maybe “how to fix it”.
