The DOJ is arguing that lower court judge James Boasberg is unconstitutionally intruded on the president’s national security powers by barring Trump from using the two-century-old Alien Enemies Act to swiftly deport Venezuelans the administration says are members of Tren de Aragua.
“Only this Court can stop rule-by-TRO from further upending the separation of powers—the sooner, the better. Here, the district court’s orders have rebuffed the President’s judgments as to how to protect the Nation against foreign terrorist organizations and risk debilitating effects for delicate foreign negotiations.
More broadly, rule-by-TRO has become so commonplace among district courts that the Executive Branch’s basic functions are in peril. In the two months since Inauguration Day, district courts have issued more than 40 injunctions or TROs against the Executive Branch.
Whereas ‘district courts issued 14 universal injunctions against the federal government through the first three years of President Biden’s term,’ they issued ’15 universal injunctions (or temporary restraining orders) against the current Administration in February 2025 alone.'”
This puts the issue squarely in the hands of the Supreme Court.

SCOTUS is working hard at making themselves (and all other courts) irrelevant.
Either there is a Rule of Law, governed by the U.S. Constitution or there is NOTHING guiding the judiciary other than how they “feel” on a given day.

Suspending Habeas Corpus is a prerogative allowed by the Constitution during a rebellion or invasion. Article 1, Section 9, clause 2. Lincoln enacted it on his own, then had Congress invoke the clause into law.

President Trump suspects the Roberts court to be compromised. Imo, Trump has decided to press the issue and force the Supremes to expose themselves; then he can make his next move, what ever that may be. Right now, we have a vacuum of authority, which cannot support a representative democracy.
To clarify, I define the Roberts court “compromised” because they appear to have abandoned the concept that their constitutional authority is to judge an issue to be constitutional or non constitutional and explain their decisions to the American people. Political, emotional courts were strongly avoided by the authors of our constitution and founders of our country.

I agree about Roberts, but he has a tough choice. If he goes along with the uniparty and rules against the President on the Alien Enemies Act, the President would have public support in defying the court. That will empower the executive branch and take power from the judiciary, and Roberts does not want to see that happen. People might catch on that the Constitution does not give the judiciary any authority over the Executive Branch’s actions-in Marbury v. Madison, the Supreme Court simply declared that it had that power.
For the most part, the Supreme Court hasn’t wanted to do anything that could lead to the Executive Branch pushing back and ultimately limit Marbury v. Madison. Roberts does not want to go down in history as being the Chief Justice of the Court when that major event happened.
This is good thing. This will put a lot of attention and Roberts and Barrett, hopefully internet researchers will dig, dig, dig to find ways to expose these 2 Justices.

Yet, you now baldly declare that the President cannot exercise the powers explicitly granted to him by Congress, unless you on a prisoner-by-prisoner case “approve.” This is precisely opposite from what the Constitution contemplated – and, what Congress also long ago contemplated, when creating the AEA.
Congress authorized the President to determine, by proclamation, that certain persons were “Alien Enemies” and subject to immediate removal from the country. The text of the law could not be more clear.
Instead, the Court system wants to use AEA and the Administrative Procedures Act(!!) to place itself squarely into the determination which the AEA places exclusively into the hands of the President. In this way, by extension, and with the possible exception of purely military matters, the President would have no power at all, except that 400+ non-elected judges gave consent.
Foreign nations would cease to negotiate with the USA, knowing that they would face 400+ “diplomats,” any one of which could and would prevent any decision from being made.
That’s not what our Founders created.

Why didn’t they include that Boasberg has no authority in this case since none of the 5 individuals doing the suing were located in tne District overseen by Boasberg?

Perhaps it is time to allow the evidence surrounding the adoption of his Irish children to be made public knowledge.
