The first case FDA vs R.J. Reynolds Vapor Co.; the question before the court is “Whether a manufacturer may file a petition for review in a circuit (other than the D.C. circuit) where it neither resides nor has the principal place of business, if the petition is joined by a seller of the manufacturer’s products that is located within that circuit.”
The second case: McLaughlin Chiropractic Assoc. vs McKesson Corp. The question before the court is “Whether the Hobbs Act required the district court in this case to accept the FCC’s legal interpretation of the Telephone Consumer Protection Act.”

Tom Fitton (Judicial Watch) just said Trump’s DOJ inherited the Sgt. Ashli Babbitt wrongful death suit from the Biden DOJ. You may recall Judicial Watch is suing on behalf of Ashli’s husband for $30m. Fitton stated the Trump DOJ should settle this case with terms favorable for Ashli’s Babbitt’s family.

Agreed! Judicial Watch should be digging for enough info to support a 42 USC 1983 civil suit against the freshly pardoned shooter.
Discovery can be done by testing Captain Michael Byrd’s pre-emptive pardon. The family likely needs closure and additional legal expenses. However, it’s the family’s call not ours.

I saw somewhere someone posted that a pardon is not any good unless you publicly accept it. If not then the pardon was never used. So do they wait until someone goes to try them and then they say they have a pardon?

Trump allows federal death penalty
US President Donald Trump has voided a moratorium on federal executions imposed by his predecessor, Joe Biden, in 2021. Trump specifically instructed his acting Attorney General James McHenry to seek federal jurisdiction and capital punishment for those found guilty of murdering a law-enforcement officer as well as illegal immigrants convicted of a capital crime.
During the Republican’s first term in office, his administration conducted 13 federal executions – more than under any president in modern history. While on the campaign trail, Trump repeatedly advocated the death penalty for drug dealers.
In the order, the US president mandated that the attorney general “pursue the death penalty for all crimes of a severity demanding its use.” The federal government will also “ensure that each state that allows capital punishment has a sufficient supply of drugs needed to carry out lethal injection.” On top of that, the Trump administration will seek the “overruling of Supreme Court precedents that limit the authority of State and Federal governments to impose capital punishment.”
He also lambasted the Democrat for commuting late last month the “sentences of 37 of the 40 most vile and sadistic rapists, child molesters, and murderers on Federal death row” to life in prison without the possibility of parole.
Trump instructed the attorney general to ensure that the pardoned convicts are “imprisoned in conditions consistent with the monstrosity of their crimes” as well as to evaluate whether these individuals can be charged with state capital crimes.👍🇺🇸

Can Trump Fix Our Broken Foreign Policy

By the time most of you read this column, we will have a new US President. Donald J. Trump will be inaugurated for his second term today at 11:30 AM, Eastern time, and many Americans are hopeful that the disastrous foreign policy of the past four years under Biden will be improved. There is good news and bad news.
First the good news. It is no surprise that Trump’s appointees to foreign policy and national security positions are to the person very hawkish on China. However Trump, as he often does, has defied conventional wisdom on what his China policy might be by not only inviting Chinese leader Xi Jinping to attend the inauguration, but actually picking up the telephone and having a conversation with his Chinese counterpart.
According to a read-out of the call, the two discussed “trade, fentanyl, TikTok, and other subjects” and agreed to remain in regular contact. Winston Churchill is often (inaccurately) credited with the phrase “jaw-jaw is better than war-war,” but nonetheless it is an accurate statement. It is much better to engage even with “adversaries” than to refuse contact and add more sanctions. Those who prefer sanctions over communications are the true isolationists.
On TikTok, the popular application has credited Trump with preventing the Congressional ban from taking effect. If true, it is another good Trump move in favor of our Constitutional free speech guarantees.
Likewise with Russia, media reports suggest that holding a conversation with Russian President Vladimir Putin will be among the first things Trump does as President. That is great news for all of humanity, as Biden’s dangerous proxy war in Ukraine and refusal to communicate with the Russian president has brought us to the very edge of a once-unimaginable nuclear exchange. When the end of life on earth is at stake, it is reckless to ignore the possibility of de-escalation.
In the Middle East, incoming President Trump is being credited with securing a ceasefire in Gaza, an achievement the Biden Administration seemed incapable of or uninterested in seriously attempting for the past year. Does Trump deserve all the credit? We don’t know. But we do know that thousands have been needlessly slaughtered while Biden dithered and sent more weapons. The wholesale destruction of Gaza with US bombs and financial support will be Biden’s enduring legacy and a stain on everyone involved.
The bad news is that because of President Trump’s decision to appoint the most hawkish advisors, he will be surrounded by individuals who will constantly encourage him to confront rather than disengage. For example, his special envoy on the Ukraine war has recently boxed Trump in on Iran by declaring a return to the failed “maximum pressure” campaign of his first Administration. The policy failed to achieve the desired results when first implemented and it will fail again if adopted again. Why? Iran has developed far more extensive trade ties outside the influence of the US government, for example among the BRICS countries. It is not possible to isolate Iran as it has been in the past. As with China and others, with Iran it would be far better to jaw-jaw than to war-war. Let’s hope President Trump understands that.
We will no doubt see some disappointments in incoming President Trump’s foreign policy, but there are solid reasons to be cautiously optimistic. Particularly when measured against his predecessor.

Interesting comments today by Judicial Watch’s Tom Fitton. He noted that the Biden’s last minute pardons are unprecedented and due to the 11th hour timing must be carried out by the Trump DOJ. However, several areas are especially murky. For example, pardoning J6 Committee “staff” is especially ambiguous as several powerful players were not specifically named. In addition, does it prevent Gen. Milley from being recalled to active duty and then face a court martial?
As noted earlier, Fitton questioned whether the Trump DOJ wants to defend the shooting of Ashli Babbit or settle on terms favorable to Ashli Babbitt’s family?

IMO, American history would argue differently. For example, would America have gotten to the Moon by July 1969 without the help of German rocket scientists? Moss Landing:

NBC quotes Monterey County District 2 Supervisor Glenn Church calling this “a worst case scenario of a disaster” that nobody predicted. Church continues:
“This is really a lot more than just a fire, it’s really a wake up call for this industry, and if we’re going to be moving ahead with sustainable energy we need to have safe battery systems in place,” Church said.
Church is further quoted as stating that this is the fourth fire at this facility going back to 2019. Besides the current one and the one in 2022 reported in the LA Times story linked above, there were additional fires at Moss Landing in
2019 and 2021.
There was a mandatory evacuation of an area of 7600 acres surrounding the facility. 7600 acres is about 12 square miles. Approximately 1500 residents living in that area were evacuated, according to NBC.

Fire detection failure:
The destroyed building was one of two Moss Landing battery facilities owned by the Texas-based company Vistra Energy. Its facilities previously experienced less serious incidents that involved overheating batteries and malfunctions in the fire suppression system. But the facility that went up in flames this week has a water-based suppression system and it is unclear why it failed, said Vistra Energy officials during the press conference. They are still investigating the root cause of the fire.
