Glenn Greenwald follows the internal workings of the intelligence community apparatus in Washington DC very closely.
In this segment Greenwald accurately puts the changed position of Tulsi Gabbard into context and then outlines why he remains optimistic about her intent at ODNI while reluctantly accepting her likelihood to retain the acceptable baseline of the IC toward FISA-702.
The best-case scenario is that Tulsi Gabbard will retain 702 as a tool yet remove or stop how it is being unlawfully used. Unfortunately, as Director of National Intelligence Gabbard will not have control over the day-to-day use of FISA-702, that job will fall on the shoulders of Pam Bondi.
The DOJ-National Security Division is the place where FISA authorities are deployed. However, the use of the NSA database to conduct unlawful searches of American citizen metadata is the issue where Tulsi Gabbard could gain ammunition to change who has access.
Personally, given the change in position, the fallback position is to hope DNI Tulsi Gabbard moves to curtail the number of people with access to the database and provide demonstrable accountability for any unlawful use of it.
Regarding the actual USE of §702, I don’t pretend to know the fine distinctions being drawn between what the DNI can actually control and what lies beyond her reach and rests within the DoJ’s control via its NSD.
(I’m interpreting that it’s the difference between who can simply obtain raw information housed in the NSA database (under ODNI control; contractors, e.g., vs. who can construct raw information into a FISA application and argue it to the FISA court to secure a warrant and execute it–DoJ)
However accurate or inaccurate that interpretaion is , however, may not matter to Tulsi Gabbard’s alleged (and maligned) “flip” in position on the contoversial position.
In practical terms, isn’t she simply abandoning the philosophical/rhetorical opposion to §702 that she held as a congresswoman and receding to the limited, but real, database use control she would have as DNI?
Under that reading, she could rightly be seen as “flipping” like a fox: abandoning for the hardliners’ satisfaction only a position that would not actually translate to authority she would hold as DNI, while accruing the actual authority to inhibit database abuses she would attain if, and only if, confirmed.
Pretty sure Tulsi knows that the best way to root out your enemy is to be amongst them, by placating enemies is in no way giving in, the fat lady isnt singing yet

Having come within millimeters of having his head blown off Trump is a changed man. Maybe he sees a bigger picture now. Can DNI Gabbard order disclosure of the 2012 Memorandum of Understanding between the FBI and the subcontractors whose FISA access abuse prompted Admiral Rogers audit? Can we finally find out who those subcontractors were and whether they were illegally conducting electronic surveillance on then Candidate Trump, his campaign, his family, and his businesses? Even just telling us the latter would go a long way to shining some long overdue sunlight, even if we never find out who the subcontractors were. I also would like to know if Sussman’s firm still has NSA database access in its offices? Would not hurt to bring Admiral Rogers to take over database access.

If Tulsi is able to keep FISA 702 searches from linking into the NSA database and limiting the users, 702 will be much less useful for the IC.
Once 702 is no longer a useful tool there will be no more reason for the IC to push so hard to keep it.
Then and only then can FISA 702 be repealed. But at that point it might have become a moot issue anyway.
The IC will no doubt come up with a new substitute by another name and probably even more hidden and hard to revoke.
The NSA director can shut down the ‘about’ queries; or, as others propose, change the access rules.
There are few technical issues in terms of control. This is about power and leadership.

There has never been effective oversight of the NSA’s bulk collections programs, or indeed, intelligence agencies in general. There’s been a lot of noise made about this vaunted oversight in defense of programs revealed by leaked documents, but this is nothing more than a talking point.
At The Big Picture, a clip of Sen. John D. Rockefeller (then Chairman of the Senate Select Committee on Intelligence) discussing how oversight actually works has been posted. It’s from an interview given in 2007, about the time the FISA Amendments Act was being put together to replace the expiring Protect America Act. The amendments act, among other things, extended the length of warrantless surveillance and gave telecoms retroactive immunity for their participation in the NSA’s bulk collections.
Here’s Sen. John D. Rockefeller explaining why, even back in 2007, intelligence agency oversight was a joke.
DAVIS: Reports quote administration officials as saying this is going on and it’s being done in a way to avoid oversight of the Intelligence Committee. Is there any way—
ROCKEFELLER: They’ll go to any lengths to do that, as we’ve seen in the last two days [during hearings on FISA].
DAVIS: Is there anything you could do in your position as Chairman of the Intelligence Committee to find answers about this, if it is in fact going on?
