Joe Biden was asked yesterday if he would pardon anyone else. He couched his response, “it depends on some of the language and expectations that Trump broadcasts in the last couple days here as to what he’s going to do,” Biden told reporters at the White House. “There’s still consideration of some folks, but no decision.”
Now, think carefully about that response to the question. Biden handing out more pardons depends on what Donald Trump says he is going to do.
What exactly is the negotiating factor here? If Trump says he will hold people accountable for the weaponization of government, then Biden will preemptively pardon them. However, if President Trump does not say they will be held accountable, then no preemptive action is needed.
No where in that type of thought process is the weaponized targeting and behavior a factor, only whether they will be held accountable for it. Put another way, the activity is admitted as corrupt, the decision now rests on whether they can avoid accountability for their corruption.
There will be more pardons. It doesn’t matter what President Trump says or does not say. Psychologically, they are admitting to the wrongdoing. The issue is now about how to avoid the consequences. There will be more pardons; they are simply negotiating who gets them.

The whole concept of a preemptive pardon is preposterous and must not be permitted to stand. It is a prescription for an administration that does what it wants with impunity, knowing that it/they can never be accountable. I’m no legal scholar, but how can someone be pardoned for a crime for which they have not been found guilty? What is even the legal theory for that?
Doesn’t this concept effectively extend presidential immunity from prosecution to everyone employed by or involved with the president? And if presidential immunity is now getting defined legally, wouldn’t the effective extent of that immunity to others in the administration beg to be defined as well?

I don’t know who’s Biden’s WH counsel, but I also believe he has to sign off on pardons. I’m sure that guy’s a crook, whoever he is, but he’s got a job ahead of him here. Biden will sign whatever, but this guy could become a lightning rod soon. Every word he types becomes a landmine.
I’m also wondering if the pardoned kill their futures, if they appear on a pardon list. Gov’t can’t hire them… ever.

Don’t forget pardons are for past acts. They won’t be able to help themselves and be open to prosecution when they continue their bad acts in the future.
Pardons also do not disallow prior actions to support continuance of a crime either. It simply limits a charge unspecified that may occur within a specified time range. Prosecutors can absolutely stretch back to actions conduct within that range under the pardon as a means to demonstrate fact patterns for evidence.
Joe malarkey is being controlled by corrupt but pretty smart people. But they aren’t brilliant.

Blanketing a class of people can’t be constitutional? Have to identify the person by name at least. And if there is no criminal case against them seems odd you can pardon them from something speculative in the future.
Carter pardoned the Vietnam War draft dodgers. Don’t recall if he listed them or not, but they were an identifiable group from draft records.
