New York state just mailed out millions of mail in ballots even though not requested
All New Yorkers will be allowed to vote by mail in the upcoming elections.
Chief Judge: I presume it is constitutional? “presumption of constitutionality”
In a 6-1 ruling Tuesday, New York state’s Court of Appeals upheld the voter expansion law approved by the Legislature in 2023 that allows any registered voter to cast a ballot by mail.
State Republicans, led by Congresswoman Elise Stefanik, had argued the law was unconstitutional. In 2021, voters rejected a similar proposed amendment to the state constitution.
Chief Judge Rowan Wilson said, however, there’s no clear understanding that requires in-person voting, writing in part that the Republican’s argument is “insufficient to overcome the strong presumption of constitutionality.”

A nervous knot is forming in the pit of my stomach. Listen, I’m not trying to be non-compassionate about what is happening in Western Carolina and now Florida, but the reality is the election is coming up ready or not. I read a tweet from Paul Sperry that the Trump campaign is worried about the counties affected and their ability to vote. There is never a good time for a natural disaster, but this sounds like the worst timing. What concessions will be made to help these people vote?
