If not bad enough, the jury instructions assert that a crime has been committed but leave it to jurors to determine what the crime is, all the while ignoring perjury and admission of felony, Cohen is referred to as “Accomplice”. No federal statute provided as basis for charges with no clarification of “beyond a reasonable doubt” with no instructions covering legal principles and standards that the jurors must apply in reaching their verdict. Deliberate refusal allowing election law expert to testify. Now we understand why the two attorneys were selected as jurors – wonder what DOJ department they came from…

No such thing as a hung jury the way this judge has set the rules. The only way to get a hung jury is 9 votes for acquittal on each of the counts. He completely removed the possibility of a hung jury in his court
This “judge” had better hope that his backers have already and verifiably transferred the money. Because otherwise his entire career as a credible “Judge” is of course entirely finished. His only hope now is that “Future Historians” will somehow forgive or forget him, which I doubt.
“Future Historians” will be entirely unable to contrast this Judge’s actions against the prevailing judicial norms of the time, which of course are public record. It will be impossible, therefore, to excuse this person’s behavior. Historians may therefore write many books about him.
Or, will they instead write about this Jury?

It requires 4 of 4 guilty votes from each of the 3 groups Merchan broke the jury into. That means if there is just 1 vote for not guilty in any group that group fails. And an overall guilty verdict requires all 3 groups to be unanimous for that alleged crime. It’s quite possible at least one of these 3 groups will find not guilty. Trump needs the group on the falsified documents charge (the most serious charge) to be not guilty. That would likely take jail time off the table.
Did I hear wrong? Thought I heard on the talk radio shows that the judge’s instructions were illegal and that he told the jury that one person could NOT hang them up, that for each charge, if even one jurist said “guilty,” that would be enough — the opposite of what the law says.

A lawyer in the jury room is likely to dominate the deliberations, and if there are two, and they are both on the same side, they can almost dictate the verdict. It’s very suspicious that even one lawyer is on the jury, and if there are two…

The central issue here is whether or not Trump is guilty of election interference fraud based on the way he financed a non-disclosure arrangement with Stormy Daniels more than a decade ago.

On page 31 it has instructions about the FECA (Federal Elections Campaign Act) law. You know: the exact law that the judge who wrote these instructions said wasn’t witness worthy and told the defense they couldn’t bring it up. IIRC the guy didn’t even testify. But the judge? Oh yeah, no problem, he can talk about it.
This judge is acting as a Prosecution witness, and has been doing so this entire trial. Now he using his jury instruction as further testimony. Unreal.
Spot on. That was my read as well. He first says he can’t relay matters of fact from the testimony, then turns around and does exactly that in several places.

Merchan cites Federal Election Law (with no US Code #) and intermingles it with NY election interference law…and PRESIDENT TRUMP was already in office.

Less about removing him off the Federal ballots then about booting him off the so-called Republican ticket. There is no explicit criminal conviction prohibition for the Office of the President of the United States in Article II. Not so much for ‘private clubs’ with their own rules.
The RNC and the State level party members by extension have a great deal of influence on that. Consider that the Electors of each State are typically appointed by their respective parties and are the ones who elect the President of the United States and not the popular vote of the people directly.
Thinking the plot is to deny the ‘Republican’ endorsement at a late hour to Donald Trump upon a (unlawful) conviction. Then the RNC is going to wring their hands ruminate and make some comments about not being able to endorse a felon, then try to pull a fast one with one of their preapproved candidates. Insert meatball/Haley/Vivek/etc here.
Keep in mind the National Popular Vote Compact efforts. It would moot a number of these schemes involving electors by shifting it all straight to simpler voter fraud plots as many other offices are already selected with.
An additional line of thought to add here.
It might be worth becoming familiar with faithless elector laws as applicable to your State of residence.
I fear the following:
If President Trump is found guilty and he goes on to win the presidency, look for him to be immediately impeached. Guilty of “High Crimes and Misdemeanors.”

Your username reminded me of another ‘degree’ in the recent past, in the Kenosha area of your state. The jury deliberated and found the accused not guilty, and of much more serious charges at the start of adulthood for the accused. That trial certainly made the careers of some Youtube lawyers, among others.

I scrolled down to the bottom of the comments above because almost every fiber in my being is in a state of stretch beyond comprehension that this “trial” ever occurred. What I found interesting is the judge said that the underlying crime that was concealed by “falsifying records” were violations of New York State election laws (which make reference to federal laws). I had been following Fox coverage for months and repeatedly their “experts” had said that New York has no jurisdiction over federal election laws. It turns out New York State has its own election laws.

Like Biden and Merchan, it seems Democrats can do/get anything they want and there is no way Republicans can oppose/stop them from acting like Putin in Russia, our constitutional republic is no better than any other communist/banana republic country, there’s no mechanism(s) to stop the left, the deep state is too big and ingrained into their government positions for any administration to affect change, most will just lay low until 2028.
The Dems will get their millions of new voters they want, I seriously doubt that there will be mass deportations, our judicial branch, half-full of Merchan types, will be blocking any deportations and the RINO’s aren’t going to fund any either. Not counting our liberal leftist Sanctuary cities and States, I live in FL and they’re busy building apartments to house all of its freeloader ‘newcomers’, not getting ready to deport them, ten years from now they’ll be our latest ghetto enclaves.
These judges who allow these political prosecutions of Trump to go on should be impeached, disbarred, and then tried for abuse of power. Same for the DA’s, prosecutors and attorneys doing the “prosecuting.” It’s no wonder the Left is so afraid of Trump winning again. If they are ever held accountable for their crimes, they’re all going to prison.
There was a similar tactic used to get rid of an effective Republican Member of the House in 2005. Tom Delay known as the Hammer. The Democrats charged him with Finance Violations, forced him out of the House, tried him, convicted him and I even believe he was sent to prison. As somebody used to say “now for the rest of the story. The case was reviewed by the court of appeals and they agreed that Tom DeLay had done exactly what the Democrats said BUT what Tom De Lay did was not a crime and dismissed the case.
The Uniparty is getting desperate that Lawfare won’t be able to knock out Trump. They can’t beat him in November, they’ve missed their chance to replace Biden, so they are screwed and they know it. Their desperate hope is that a bogus guilty verdict changes voters’ minds. I doubt it.
But Trump’s security better step it up. Desperation is a powerful drug.
It’s actually 34 counts of “falsifying business records”. For each count, the motivation behind each “falsification” could be to skirt tax law, affect election outcome, or a secondary business records reason. That would be what converts what is normally a misdemeanor to a “felony”.
So, unless the prosecution tied each of the 34 counts to a specific motivation, those counts should be “not guilty”. The fact that the judge has basically said that if the jury thinks that the motivation for any count is ANY one of the three motivations, without solid evidence presented to support a specific one, is a sham and what will result in a reversal on appeal.
This lawfare was about throwing up as much legal smoke as possible to confuse the jury and get them to argue and coerce each other on at least 102 permutations of these 34 counts (34 x 3)… with the hope of getting them to agree on a guilty verdict on at least one of these “felonies”.
This judge must KNOW any guilty verdict will be overturned on appeal.
He’s in a box of his own making.
Flabbergasted, hearing those “jury instructions” — and — did I miss the part where he told them about “reasonable doubt”? That if you have even a bit of that, it must be “not guilty” of all charges?
