That is precisely the Lawfare strategy used in this case and trial. President Trump was forced into a no-win situation not by reason of any guilt but by reason of a deliberately corrupted process that was designed to entrap him despite his innocence.
This is an american version of “Attainder by Process” everything our system was designed to prevent (or more accurately: “Outside the True Process Attainder by Process”), “attainder” = “declared attainted” and thus nullifying a person’s civil rights like when they’ve been found guilty legally through “judicial attainder” – but in “process attainder” the nullification of civil rights is inescapably much more severe because it’s been an illegal vindictive process aimed at a target. This perversion of the Judicial System was specifically prohibited in the United States and is now uniformly abolished throughout the world (left to rot in the Dark Ages).
It utilizes the official proceedings to produce the image of criminality. It is used to utterly destroy someone’s reputation so that their own mother would hate them. It works on many levels, not the least of which is to intimidate the civil-society it’s operating in.
This is well known legal history, and they know what they’re doing (Intent).

If he had stopped at “I didn’t do it”, it would have been much harder to rule against him for defamation. You can say you disagree with a verdict. You can say you will appeal. You can’t say stuff like the person who sued you is insane or a drug addict unless you can prove it. Technically he can’t even publicly call Carroll a liar after losing the previous suit.
But this suit wasn’t about his innocense or guilt in the sexual assault. That’s what the PREVIOUS suit was about. THIS suit was about whether his repeated posts and comments AFTER the first suit were defamatory and damaging to her reputation and/or livelihood. If PDJT had just appealed and kept his mouth shut, Carroll could not have won this judgment.
And if he keeps on doing it, she can sue him AND WIN AGAIN.
Then he should have counter-sued; no one can say her LIES -yes I said it – were not defamatory of President Trump.
And he said these things publicly precisely because he was barred by the clearly biased judge from presenting an effective defense at the first trial.
He never said she was insane or a drug addict, only that she was lying and not his type. The first verdict stated he was not liable for rape but liable for sexual abuse based on a low evidentiary standard. He had a 1st amendment right to continue to proclaim his innocence especially when it was true and people kept bringing up this ridiculous claim. Saying someone is not your type is not defamation, pointing out their very obvious lunacy based on their own social media posts is not a problem. You also fail to mention the bias of the judge and how one sided this case was.

How on earth can a judge do this, and more importantly, get away with it!

I worked in both trial and appellate courts, for judges. Some trial court judges tried to be very careful in their rulings, because they did not want to get reversed on appeal. Others took advantage of the fact appellate courts would eventually clean up their mess, and let their partisan freak flags fly for their own short-lived immediate gratification. The latter are not highly regarded by anyone with integrity. But they are shopped for by Lawfare scum.
Judges at every level are allowed to limit the scope of admissable evidence. That’s absolutely ordinary. If you’ve never been in court, haven’t you ever seen a “Law & Order” type show? Judges disallow stuff in every case, sometimes including evidence prosecutors/plaintiffs dearly wish to be able to present. Good lawyers have to pivot, using what IS admissable.
This is an example of why I don’t believe he had a competent defense. Ms. Habba didn’t even understand what THIS suit was about, and that Trump wasn’t going to get a “do over” of any issue settled in the PREVIOUS suit.
You weren’t following the case. It’s patently obvious. Habba did understand what was going on. Look at the court reporting from inner city press and others. This was limiting someone’s free speech in their own defense. Jean Carroll did see a law and order type show seeing as she based her entire claim on an episode of it.
