When Texas petitioned to become part of the United States its State Constitution retained much of the Lone Star Republic National Constitution. Much of it is far different than the other states. I believe this may be one of those differences.

The 9th and 10th Amendment already address the sovereignty issue. All States keep there rights except for the few outlined in Article 1, Section 8 which the States cede to the united States’ congress. Texas isn’t special in that regard. (This includes the right to succeed from the Constitutional pact as well, according to all State ratifying conventions.)

I think that was settled in 1865. The original treaty under which the Republic of Texas joined the Union in 1845 included that provision, as well as the right to create up to four additional states from within the borders of the Republic of Texas, but I don’t think anyone seriously believes that Texas could do either of those things after 1865.

The powers granted to the States to act independently for the good of the People in that State was central to the Republic. Greater Freedom if you have States with different laws. Find one which suits you. The Anti-Federalist had many arguments about limitations on the Federal Judiciary, but were shot down on many of the protections they wanted to keep control of the government by the People.
I think the other side is not beyond applying the kind of pressure that might shorten a life term. And in our current lawless environment, justices are unfortunately reasonable to be afraid. Perhaps afraid for their families also.

As an example of what I have learned; when someone Replied to my original comment about the percentage of lawmakers who claimed that slavery was “their” main reason for the conflict; on today’s The Victor Davis Hanson Podcast, Doctor Hanson stated that “97% of all Southern citizens did not own slaves.”. That is one of the reasons I have a hard time believing that Southerners fought “For” slavery. Instead; I believe that my ancestors were fighting for “The United States Constitution”, for “States Rights”. My people were poor farmers who just wanted to be left alone. That is why we didn’t capture Washington DC when our army got so close that the citizens could clearly see us.

To those of you who are hoping for a civil war, you should be careful for which you ask for.
Who said anything about a civil war? A state doing what it legally can, as outlined in the Constitution does not a civil war make.

The answer to illegal actions by the federal government and violations of the Constitution by the same is not to bend over and take it. There are ample ways to LEGALLY fight back – including what Texas is currently doing.

At the close of WWII, there were less than 50 nations. Now there are almost 200.
Most of them managed to separate without violence. States within the United States could doso as well. It would not necessarily lead to violence. There are some in many States would would LIKE to see Texas leave the union, just like there are those who would like to see California leave the union.
The South thought the same thing. They too thought they could secede without violence. Boy, were they mistaken.
That was an entirely different time, with an entirely different set of circumstances.
The southern States were trying to defend the institution of slavery. Very few people in the south actually owned slaves, many thought that slavery was abhorrent, and they were not all that enthused about risking their lives for it. A lot of them ran and hid in “The Big Thicket” in east Texas throughout the civil war.
Also, the first Civil War was started when South Carolina Militia artillery fired from shore on the Union garrison. That was an act of war.
Now, The Regime is trying to enslave ALL of us.
No, the southern states were defending against the Morrill Tariff that was signed into law on March 2, 1861.
South Carolina was invaded on December 25, 1860 when Major Anderson took all the fishing boats on Sullivan’s Island to transport his troops from Fort Moultrie to Fort Sumter that was owned by South Carolina. That’s an act of war.

And yet, the US Supreme Court ruled against Texas protecting themselves and in favor of Biden’s dismantling.
Governor Abbott should have at least mentioned that part in his letter as well. Im not sure Abbott has that authority, but I think that county constitutional sheriffs sure will.
All men from 18 to 45 (with a few exceptions, such as clergy, peace officers, and those currently on active duty) are members of the militia, able to be called up by the Governor when needed.
Remember that he can’t just willy, nilly federalize the NG. There are only a handful of reasons the NG can be federalized, it requires the use of an EO with specifics, and notification to Congress.
Then it becomes a legal battle in and of itself (Texas could refuse on the grounds that Brandon’s reason is made up).
If you remember there was a time not that long ago whereby a similar request was refused and the DoD went so far as to try to deny funding for the guard unit involved. There is currently a court case over the event and some legal scholars have written that they think it will end up with a decision that will severely curtail such actions in the future.

(1)the United States, or any of the Commonwealths or possessions, is invaded or is in danger of invasion by a foreign nation;
(2)there is a rebellion or danger of a rebellion against the authority of the Government of the United States; or

the President may call into Federal service members and units of the National Guard of any State in such numbers as he considers necessary to repel the invasion, suppress the rebellion, or execute those laws. Orders for these purposes shall be issued through the governors of the States or, in the case of the District of Columbia, through the commanding general of the National Guard of the District of Columbia.
The irony: the primary legal reason a President can federalize state NGs is to repel invasions.

Everyone: TX asked for an injunction to prevent the feds from removing barriers; appellate court granted it and the Supreme Court overturned it, pending resolution of the case.

I think that they have been swayed by argument in briefs in this and other cases, as well as media propaganda to the effect that “migrants” have drowned, that children have died, that Border Patrol has been prevented from responding to emergency situations of distress. Etc. etc. etc. Imagine a scenario. And never mind that this is not the fault of Texas or any border state. The saw “if it saves just one child”…

I’m commenting on both Barrett’s and Kavanaugh’s seemingly inexplicable recent wussy decision-making (albeit Kavanaugh in this case went the right way). Roberts indeed may be compromised, although we have only rumors.
I hear a lot from new clients seeking appeals who, failing to understand the reasoning of the opposite side or a judge, frequently default to evidence-free complaints about “corruption” (or “abuse” or “evil” and similar.)
Unless the opposing side’s thinking, or ignorance, is ruled out, defaulting to fact-free suspicions of “corruption” is not going to help fashion an argument that is persuasive. It’s defeatist; and it’s not infrequently just wrong.
Whether you’re in a negotiation or a court case, it’s important to try to figure out what reasoning that is moving the other side. If you don’t, you just lose.

And to your point outhouse, figuring out their way of thinking provides the best avenue to deflect and counter the, more than likely, emotional arguments that will be presented in the defense of that thinking.
Or simply stated: the facts don’t care about your feelings.

I practiced at a very high level for many decades. Many judges are politically biased.
Sometimes, the other side is just unreasonable, by design. It is their core strategy.

I think Governor Abbott is controlled op. Too little,
too late. He could have done this a lot sooner. I’d guess he’s up for reelection? And so many have already crossed our border that there’s likely no chance of stopping what’s coming. I pray Trump wins again and begins deportations immediately. I pay we don’t have another October 7th, this time on US soil.

I tend to use the words ‘invasion‘ and ‘revolution against the Communists‘ myself. However, a politician or diplomat might not. Our missions are different.

Just wondering what the political fallout for Biden might be? Oklahoma has already joined Texas. immigration has now become the number one issue for voters.
His latest public statements are that the border is “”not closed” needs fixing but he needs money, and is ready to cut a deal. But his actions are just the opposite. He can blame Republicans but the accusation won’t stick. Another Biden disaster.

He’s been governor since 2015 and the next election is in 2026. He’ll set a record if he runs and is elected again.
We’re now four years post-Covid and getting close to that with Brandon. Time flies. Your posit of re-election could have traction as a long-term strategy. 2026 will be here before we know it; personally I’ll be glad if I’m alive to see it.
