Governor Greg Abbott today issued a statement on Texas’ constitutional right to defend and protect itself as President Joe Biden continues to attack Texas and refuse to perform his duties to secure the border.
“The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now,” reads the statement. “President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. I dunno…. I remember Desantis defying the Feds. Standing up, in their face. A lot of us, me included, were thinking “You go Ron!” Then the strings became visible. Gov. Grabbit has yet to be tested. I have my hopes – and my doubts.

Abbott is trying to follow the laws the best he can while still doing everything he can. States cannot deport, even under the invasion clause; only feds can deport. But he has been arresting and jailing anyone that breaks state laws, such as trespassing, B&E, assault, damaging property, drugs, trafficking, etc. So long as he tries to stay within the law (and not become like the feds), that’s pretty much all he can do. Unless and until he’s willing to kick the feds out of Texas and secede, he’s doing the best he can in a bad situation that never should have happened in the first place. Thumbing his nose at the SCOTUS ruling and continuing to install more razor wire while refusing BP agent access is a start. It just isn’t enough.
As PC says, it is an excellent start. We’ve been wanting someone to take a stand and finally, someone is. Sure, we have to wait and see what comes out of it, but I’ve written and thanked him for the action he’s taken so far. Also, there are…how many? 15-20? States that have come out in support saying they will also supply whatever is needed in support.
I hope we don’t immediately decide “it’s not enough,” or “he’s proven already that he can’t be trusted”…because we need to grab onto any sign of advancement, anything that shows someone (besides our president-in-exile) is listening to us — and then give them all the emotional and political support that we can, in order to encourage even more action in that direction.
I know we’re all cynical and for damn good reason. But this is a bold start, for “our side” to ignore an injust/unconstitutional SCOTUS decision, as their side has been doing at least since the BO Gulf oil drilling decision (when SCOTUS ordered him to resume drilling after the spill, and he only allowed it for Brazil and Mexico, not for us. I remember being amazed he would just ignore their decision, but it turned out to be just the first of many.)
Let’s hope we can do everything possible to encourage, not discourage, this kind of action.
Perhaps you don’t have to deport. Perhaps you can detain under such conditions that they self-deport and refuse to hand them over to the Feds. That way the only option that they have is self deporting or permanent incarceration. A life sentence eliminated by self-deportation. When you’re liberty and freedom are on the line there is no act unworthy to be taken. This is a war and we better start acting like it.
As a MAGA native Texan living in Texas, Governor Abbott drives me crazy. I know that at heart he is a Bush politician of the highest order. But then he stays out of the way of the anti-abortion issue, which he could have screwed up, starts delivering illegals to sanctuary cities, which is a double-edged sword, and adds more razor wire in spite of SCOTUS. PC says it just isn’t enough and I agree. The next step is for him to keep the pressure up, take advantage of the support of the other governors who have expressed support, and keep doing what he’s doing. Biden can and probably will nationalized the Texas National Guard but we have enough Texas patriots in the Guard who I trust will call in sick if that happens.
And turn loose his dog of war – Attorney General Paxton. Paxton and his staff alone can keep a LOT of pressure on our mutual enemy, the federal government.

Rather than spectate and post opinions, contact your local State Rep, State Senator, Speaker and Governor to express your support for Gov Abbott’s bold defense of his citizens and encourage your state leadership to do the same. People need to stand up and remind the politicians of their oath of office and the reason for their position. I did so citing Gov Abbott’s justification and authority under US Constitution Article I, § 10, Clause 3. I requested my leadership to publicly support the State of Texas and Gov Abbott reminding them every state is a border state.

The Morrill Tariff was enacted in 1861 after the southern states declared themselves seceded. It passed because southern Senators resigned. The tariff in effect prior was the 1847 Walker tariff which largely gave the southern states what they wanted. So no, tariffs were not a “cause”. Now yes, back in the 1830s it was a big issue.

There is no provision in the Constitution for general elections, only the Electoral College.
Each state decides how to choose its electors. In Nebraska, I think it used to be that a particular slate of electors was tied to each candidate, and a candidate got electors proportionate to the vote in each district. I could be wrong here, or that may have changed.
Yes, Nebraska elects two electors at-large and three by congressional districts. Note also there’s nothing in the Constitution about congressional “districts”, only the allocation of number of congressmen and requirement they they be elected by the same electorate given the right to vote in state legislature elections. Of course USSC decisions like “one man one vote” have effectively amended the constitution.
Here in Hawaii when we became a state in 1959, initially we had two congressmen, both at-large.

Arresting any federal agent who attempts to destroy the integrity of the wire is the correct step to take since it is against Texas state law and is destroying state property. While I’m no fan of Governor Abbott, shipping illegals all over the country until they can be shipped back to Mexico serves two purposes. First, it helps share the pain. The US Constitution requires Congress to “repel invasions.” And this certainly is one. It is also a gross violation of existing immigration law passed by Congress. The President is required to “Take Care.” But at the Federal level the opposite is happening.
Texas is entirely and Constitutionally correct and justified. And for Biden it is just yet another “impeachable offense.”
Abbott can’t ignore the Supreme Court because Texas wasn’t ordered to do anything. SCOTUS vacated an order against the Department of Homeland Security [sic] that stopped the Feds from cutting down razor fencing along the border. Nothing says that Texas can’t erect the fencing.

Nothing in Federal Law states that individual States have the duty to commit suicide via illegal invasion. There are only a couple of ways out of the border area into the interior of the country. Texas can put up inspection points for all trucks and cars moving north on the highways. This will put impossible to ignore pressure on Mexico which uses those highways from Mexico to the United States for their major commercial exports. The US put in a stop and search operation called Operation Intercept in 1969. Although some claim it was a total failure, the idea is still viable if the State of Texas (and the many allies it has from other States) choose to stand firm.

If the US tries to stop, arrest any agents of the US as enemies of the State.
