It is slightly unfair to say this is a Biden issue, because the minefield of verifying employment eligibility has been a weaponized DOJ process since Eric Holder entered the picture as Attorney General. Both wings of the UniParty support the intentional conflict in employment law. The civil rights division of the DOJ now uses a Lawfare concept called “disparate impact” to target any employer who would require employment eligibility verification as a contingency for a job.
Essentially, if you have a work eligibility screening process that disproportionally hits any protected category of person (ie. race, color, national origin, etc.), then the practice creates a “disparate impact” and is therefore unlawful. Example: 100 people apply for a job; 50 of them are Latino. All of the applicants must provide work eligibility documents to process their I-9 form. If more than half the denied applicants are Latino, the demand for the documents creates a disparate impact and is therefore illegal.

Not a lot of people understand the issue of “disparate impact” and the exact reason why the DOJ and Dept of Labor created the novel legal theory. The DC system, Republicans and Democrats, support illegal aliens holding jobs in the USA – Democrats for ideological reasons, Republicans for their corporate owners.

It’s actually offset/indented within the code, probably so employers don’t miss it.
Eliminate this loophole that allows businesses to hire illegals with no real consequences when caught doing so and you would thereby eliminate much of the incentive for illegal immigration – employment.
Guess who is specifically designated to be the SOLE authority responsible and enabled to eliminate it. The POTUS.
With this loophole present, you can hire some very tanned, Latino-looking guys in their mid-20s who can’t speak a word of English standing outside Home Depot who each have “a document or combination of documents that reasonably appears on its face to be genuine“ like something that says they were all born in Minnesota, Wisconsin, North Dakota, etc., and YOU the employer are good to go and any effort on your part to get proof of the validity of those documents is not required and perhaps even ILLEGAL.

(1)(B) To the extent that the system established under subsection (b) is found not to be a secure system to determine employment eligibility in the United States, the PRESIDENT shall, subject to paragraph (3) and taking into account the results of any demonstration projects conducted under paragraph (4), implement such changes in (including additions to) the requirements of subsection (b) as may be necessary to establish a secure system to determine employment eligibility in the United States.
Of course, if any POTUS actually fixed this, who would work on nasty, giant poultry farms, in meat processing plants and in all of the other really nasty jobs where they don’t dare complain about working conditions or unionize because of their illegal status and easy replacement? Which is also why national, mandatory E-Verify will NEVER be enacted.

A company like this trucking company that obviously has a high christian standard would probably not hire illegals because this means they would probably not do it illegally. And so paying for all of those costs for an illegal (which would be the moral thing to do) puts them at a financial disadvantage to their competition. So from a business perspective, doing the right thing, in a world where corruption is prevalent and your competition will eat your lunch because you are a good guy, means that you are not inclined to even consider hiring illegals. it would cost you and you would be unfairly placed in a disadvantage to your competition who isn’t following the law and doing “the right thing”. plus there is the morale issue. Employees who are citizens may feel demoralized that company leadership is practicing in a business decision that prefers priority to illegal migrants and not local citizen workers.
I’ve seen this issue play out here in Lousiana and it is a very contentious set of issues. Fortunately, we don’t have nazi karens steaming around trying to high jack businesses and force them into submission. yet. But it’s coming. No one believes this area will be untouched by the DC nazi’s.

Use independent contractors which I’m sure the firm debated vs full time ee’s. Make sure the contractor provides proof of forming their own company with raised seal docs etc. with a valid form of ID. Then do like the ISIS League university’s do to avoid federal law: Make the independent contractor write an essay or answer certain questions on why they ought to be hired in legible handwriting. This makes the hiring process subjective versus who the firm decides to hire in the interview process just like the ISIS League schools in their admission format to keep out the proles as they define them.
Basically, this would neuter the ID document issue on who is hired going forward, The firm isn’t accepting applications for employment per se but rather is looking for a trusted business partner with shared values which is vaguely defined for maximum opaqueness just like the ISIS schools.

I applied to votech, same thing. It took a call to a US congressman and later senator to get me into a program. Once done, my job opportunities were fraught with lay offs due to racial quotas. Fortunately, the US military was hiring still due to the Vietnam conflict. And it was through that, that I was able to get into college, veteran, VFW status. And still to this today we are fighting the same discrimination in the hiring and legal systems. It has now metastasized to include all American citizens, and women.

Ask them also to fill in forms in front of you ato see how they can write because afterall they have to sign off on loaded and delivered goods. If a potential new hire couldn’t pick up parts and materials for the shop and deliver jobs, no way would I let them near any machine tools so they were worthless to me. If they could drive and read a map (gives away my age a bit), then they had some promise. I was amazed how many could do neither.

It is the LAW in the State of TN that Employers MUST verify the legality of the applicant to work in the USA. Not only that but illegals are NOT allowed to have professional licenses OR Driver’s Licenses! We elected a SUPER MAJORITY REPUBLICAN Legislative body to ENSURE these things. TN tried letting illegals have DLs in 2000 and it was a disaster. That was rectified after 9/11/2001 events.
I hope our Gov and our Atty General get involved here ASAP because the DOJ CANNOT override our LAWS–and our elected officials should make a stand on this immediately.
If “d8sparate review” is merely policy and not judicially reviewed law someone with standing needs to challenge it. But the $700,000 fine here would just be eaten up by attorney fees trying to beat the corrupt DOJ’s legion of resources.

If Covenant was hiring drivers, they would want to know the person was legal, knew English and was insurable before they send them out with a vehicle and load worth more than $750,000 minimum. My Grandson drives and hauls some loads worth more than $2,500.000.

I don’t know about anyone else but when I pass or have one of these tractor trailers behind me I am hoping that the driver is completely competent at what he is doing. The training for the class A license is very expensive and the testing to ensure you know what you are doing is extensive. I personally do not want anyone driving one of those rigs being hired because of his nationality. Govt needs to stay out of any business. Especially the ones who are responsible for the MESS America is in under their leadership. They did that when choosing their VP. We ended up with the dumbest person in Washington.
Go to any construction site near any major city from the Mexican border to the Canadian and you will find Spanish as the most common language spoken. These workers are obviously NOT all U.S. citizens or Green Card holders. The fact that many of them are either being paid “under the table” or willing to work for lower wages drives down the pay scales for legal workers. If this process continues, our citizenship will/has become a farce. Trump 2024.
Employers are required to let workers present whatever acceptable documentation the workers choose and cannot reject valid documentation that reasonably appears to be genuine and to relate to the worker.

I work for a temp staffing company (unskilled labor) in Middle Tennessee. What we are now seeing are people applying for jobs who have temporary work permits with no social security numbers/cards. And yes, we do E-Verify as is required by law but my company has been using e-verify since the early 2000’s.
And yes, this is becoming a major problem. This issue has been seen in all of our offices in different parts of Middle TN. Federal law says we can’t discriminate but we are required by law to pay taxes for any employee we pay. Yet we can’t pay these employees without a social security number. Our software system won’t accept a TIN number in lieu of a social security number. The laws says if the person has a “letter” from the Social Security Administration saying they have applied for a SSN then we can’t discriminate and not hire them. Yet we can’t pay them without the number.
It’s double jeopardy. We have told our offices to tell these applicants that we can do their onboarding and we could put them to work but we can’t issue them a payroll check until we receive their social security number.
I have been telling my boss/owner this was going to happen since 2022 when I heard that the Biden regime had come up with this illegal “refuge” app which gives out temporary work permits without question.
Talk about being between a rock a hard place? Federal trucking regulations much more stringent than just dealing with unskilled workers. Covenant is definitely being used as an example to destroy small business. I’d guess the Biden Crime Syndicate is going after mass amnesty and somehow they think this part of the route to attain this goal.
My company is now talking with our employment attorney’s to figure out a plan to deal with this slippery slope.
